Chauhan, J.\n<\/pre>\n<p>       This writ petition has been filed challenging the orders dated<br \/>\n31.1.2008 and 31.10.2009 passed by the Prescribed Authority and the<br \/>\nAppellate Authority respectively .\n<\/p>\n<p>       The facts in short giving rise to the present petition are that opposite<br \/>\nparty no.3 was employed with the petitioner on the basis of the contract<br \/>\nentered into between the parties on a consolidated salary. The said contract<br \/>\nwas entered for a period from 22.2.2002 to 21.2.2003 and thereafter from<br \/>\n22.2.2003 to 30.9.2005 and from 1.11.2006 to 30.9.2007.            Services of<br \/>\nopposite party no.3 were dispensed with by giving one month&#8217;s salary on<br \/>\n15.5.2007 and on 13.6.2007 he was discharged from service. Opposite party<br \/>\nno.3 moved an application before the Prescribed Authority for payment of<br \/>\ngratuity as contemplated under Section 7 of the Payment of Gratuity Act,<br \/>\n1972 (for short &#8220;the Act&#8221;). Opposite party no.3 stated that he has worked for<br \/>\nmore than five years continuously and therefore, he is entitled for payment of<br \/>\ngratuity. The Prescribed Authority allowed the claim of opposite party no.3<br \/>\nagainst which an appeal was filed by the petitioner. The said appeal also<br \/>\ncame to be dismissed by means of the order dated 31.10.2009 by the<br \/>\nappellate authority. Hence this writ petition.\n<\/p>\n<p>       Submission of learned counsel for the petitioner is that the gratuity is<br \/>\navailable to an employee, who is being paid wages. Opposite party no.3 was<br \/>\nnot being paid wages and therefore, he is not entitled for gratuity. It is also<br \/>\nsubmitted that he did not work continuously but there was a break in service<br \/>\nfor short intervals and therefore, he is not covered within the definition<br \/>\n&#8216;continuous service&#8217; as contemplated under Section 2-A of the Act.\n<\/p>\n<p>       Opposite party no.3 has appeared in person and he has submitted that<br \/>\nhe was appointed on contractual basis and according to the terms of the<br \/>\ncontract, he is entitled for payment of gratuity. He further submits that both<br \/>\nthe authorities have taken into consideration the arguments raised by the<br \/>\nlearned counsel for the petitioner and they have come to the conclusion that<br \/>\nhe (opposite party no.3) has rendered more than five years&#8217; continuous<br \/>\nservice, as such, he is entitled for salary irrespective of the fact that his<br \/>\nemployment was of a contractual nature. He also submits that Section 14 of<br \/>\n<span class=\"hidden_text\">                                          2<\/span><\/p>\n<p>the Act has been given overriding effect and therefore, any other provision of<br \/>\nany other Act will not effect his right. Opposite party no.3 has relied upon<br \/>\nthe judgments rendered in the cases of <a href=\"\/doc\/494100\/\">Ahmedabad Pvt. Primary<br \/>\nTeachers&#8217; Assn. vs. Administrative Officer and others<\/a>, (2004) 1 SCC<br \/>\n755 and Management of Goodyear India Limited vs. K.G. Devessar,<br \/>\n(1985) 4 SCC 45.\n<\/p>\n<p>       I have heard learned counsel for the parties and gone through the<br \/>\nrecord.\n<\/p>\n<p>       Clause (b) of Section 2 of the Act defines &#8220;completed year of service&#8221;<br \/>\nmeans continuous service for one year. In Clause (c) of Section 2 of the Act<br \/>\n&#8220;continuous service&#8221; has been defined means continuous service as defined<br \/>\nin Section 2-A. Section 2-A of the Act reads as under:-\n<\/p>\n<blockquote><p>          &#8220;Section:2-A. Continuous service. &#8211; For the purposes of this<br \/>\n          Act, &#8211;\n<\/p><\/blockquote>\n<blockquote><p>          (1) an employee shall be said to be in continuous service for a<br \/>\n          period if he has, for that period, been in uninterrupted service,<br \/>\n          including service which may be interrupted on account of<br \/>\n          sickness, accident, leave, absence from duty without leave (not<br \/>\n          being absence in respect of which an order [***] treating the<br \/>\n          absence as break in service has been passed in accordance with<br \/>\n          the standing orders, rules or regulations governing the<br \/>\n          employees of the establishment), lay off, strike or a lock-out or<br \/>\n          cessation of work not due to any fault of the employee,<br \/>\n          whether such uninterrupted or interrupted service was rendered<br \/>\n          before or after the commencement of this Act.\n<\/p><\/blockquote>\n<blockquote><p>          (2)   where an employee (not being an employee employed in<br \/>\n          a seasonal establishment) is not in continuous service within<br \/>\n          the meaning of clause (1), for any period of one year or six<br \/>\n          months, he shall be deemed to be in continuous service under<br \/>\n          the employer &#8211;\n<\/p><\/blockquote>\n<blockquote><p>                 (a) for the said period of one year, if the employee<br \/>\n          during the period of twelve calendar months preceding the date<br \/>\n          with reference to which calculation is to be made, has actually<br \/>\n          worked under the employer for not less than &#8211;\n<\/p><\/blockquote>\n<blockquote><p>                       (i) one hundred and ninety days, in the case of an<br \/>\n          employee employed below the ground in a mine or in an<br \/>\n          establishment which works for less than six days in a week;<br \/>\n          and\n<\/p><\/blockquote>\n<blockquote><p>                       (ii) two hundred and forty days, in any other<br \/>\n          case;\n<\/p><\/blockquote>\n<blockquote><p>                 (b) for the said period of six months, if the employee<br \/>\n          during the period of six calendar months preceding the date<br \/>\n          with reference to which the calculation is to be made, has<br \/>\n          actually worked under the employer for not less than &#8211;\n<\/p><\/blockquote>\n<blockquote><p>                        (i) ninety-five days, in the case of an employee<br \/>\n<span class=\"hidden_text\">                                        3<\/span><\/p>\n<p>       employed below the ground in a mine or in an establishment<br \/>\n       which works for less than six days in a week; and\n<\/p><\/blockquote>\n<blockquote><p>                    (ii) one hundred and twenty days, in any other<br \/>\n       case;\n<\/p><\/blockquote>\n<blockquote><p>       [Explanation: For the purposes of clause (2), the number of<br \/>\n       days on which an employee has actually worked under an<br \/>\n       employer shall include the days on which &#8211;\n<\/p><\/blockquote>\n<blockquote><p>                     (i) he has been laid-off under an agreement or as<br \/>\n       permitted by standing orders made under the Industrial<br \/>\n       Employment (Standing Orders) Act, 1946 (20 of 1946), or<br \/>\n       under the Industrial Disputes Act, 1947 (14 of 1947), or under<br \/>\n       any other law applicable to the establishment;\n<\/p><\/blockquote>\n<blockquote><p>                     (ii) he has been on leave with full wages, earned<br \/>\n       in the previous years;\n<\/p><\/blockquote>\n<blockquote><p>                     (iii) he has been absent due to temporary<br \/>\n       disablement caused by accident arising out of and in the course<br \/>\n       of his employment; and\n<\/p><\/blockquote>\n<blockquote><p>                     (iv) in the case of a female, she has been on<br \/>\n       maternity leave; so, however, that the total period of such<br \/>\n       maternity leave does not exceed twelve weeks.]<\/p>\n<p>              (3) Where an employee, employed in a seasonal<br \/>\n       establishment, is not in continuous service within the meaning<br \/>\n       of clause (1), for any period of one year or six months, he shall<br \/>\n       be deemed to be in continuous service under the employer for<br \/>\n       such period if he has actually worked for not less than seventy-<br \/>\n       five per cent, of the number of days on which the establishment<br \/>\n       was in operation during such period.]&#8221;<\/p><\/blockquote>\n<p>       The wages for the purposes of this Act have been defined under<br \/>\nClause (s) of Section 2 of the Act. Section 2 (s) reads as under:-\n<\/p>\n<blockquote><p>                     &#8220;(s) &#8220;wages&#8221; means all emoluments which are<br \/>\n              earned by an employee while on duty or on leave in<br \/>\n              accordance with the terms and conditions of his<br \/>\n              employment and which are paid or are payable to him in<br \/>\n              cash and includes dearness allowance but does not<br \/>\n              include any bonus, commission, house rent allowance,<br \/>\n              overtime wages and other allowance.&#8221;<\/p><\/blockquote>\n<p>       Opposite party no.3 has stated that Section 14 of the Act requires<br \/>\nappreciation of this Court on account of the fact that the Act has been given<br \/>\noverriding effect. Section 14 of the Act reads as under:-\n<\/p>\n<blockquote><p>              &#8220;14. Act to override other enactments, etc. &#8211; The<br \/>\n              provisions of this Act or any rule made there under shall<br \/>\n              have effect notwithstanding anything inconsistent<br \/>\n              therewith contained in any enactment other than this<br \/>\n              Act or in any instrument or contract having effect by<br \/>\n              virtue of any enactment other than this Act.&#8221;<\/p><\/blockquote>\n<p><span class=\"hidden_text\">                                        4<\/span><\/p>\n<p>       The petitioner, U.P. Bhumi Sudhar Nigam (for short &#8220;the<br \/>\nCorporation&#8221;), happens to be a Corporation. The said Corporation falls<br \/>\nwithin the definition of the establishment as defined in Section 2 (f) of the<br \/>\nAct wherein it has been provided that the &#8220;employer&#8221; means, in relation to<br \/>\nany establishment, factory, mine, oilfield, plantation, port, railway company<br \/>\nor shop&#8211;\n<\/p>\n<blockquote><p>                     (i) belonging to, or under the control of, the<br \/>\n              Central Government or a State Government, a person or<br \/>\n              authority appointed by the appropriate Government for<br \/>\n              the supervision and control of employees, or where no<br \/>\n              person or authority has been so appointed, the head of<br \/>\n              the Ministry or the Department concerned.<\/p><\/blockquote>\n<p>       From the definition of the establishment, there is no doubt in coming<br \/>\nto the conclusion that Nigam falls under the aforesaid provisions of the Act<br \/>\nand the provisions of the Act if read together, then the wages have been<br \/>\ndefined to mean all emoluments which are earned by an employee while on<br \/>\nduty or on leave in accordance with the terms and conditions of his<br \/>\nemployment.\n<\/p>\n<p>       Terms and conditions of the employment of opposite party no.3 are<br \/>\nevident by means of various agreements entered into between the parties<br \/>\nfrom time to time. The Act does not talk of salary but the Payment of<br \/>\nGratuity Act has cautiously used the word &#8220;wages&#8221; and has linked the same<br \/>\nwith the terms and conditions of the employment. The terms and conditions<br \/>\nof the employment are evident from the contract. Thus, the services of<br \/>\nopposite party no.3 would be deemed to be a fixed service as contemplated<br \/>\nunder Section 2-A of the Act and the fixed amount paid to him would be<br \/>\nincluded within the ambit of the wages defined under Section 2 (s) of the<br \/>\nAct. The terms &#8220;completed year of service&#8221; and &#8220;continuous service&#8221; as<br \/>\ndefined in Section 2 (b), 2 (c) and 2-A of the Act also lead to only one<br \/>\ninterpretation that employment of opposite party no.3 has to be treated as a<br \/>\ncontinuous employment. Provisions of Section 14 of the Act go to indicate<br \/>\nthat the Act has been given overriding effect, therefore, any other provisions<br \/>\nwhich are contrary and agreement will not prevail upon opposite party no.3<br \/>\nbut looking to the language implied in Section 14 of the Act, the provisions<br \/>\nof the Act will prevail and govern the field.\n<\/p>\n<p>       The Apex Court in the case of            Ahmedabad Pvt. Primary<br \/>\nTeachers&#8217; Assn. (supra) has ruled as under:-\n<\/p>\n<blockquote><p>               &#8220;6. The Act is a piece of social welfare legislation and<br \/>\n        deals with the payment of gratuity which is a kind of reitral<br \/>\n        benefit like pension, provident fund etc. As has been<br \/>\n<span class=\"hidden_text\">                                          5<\/span><\/p>\n<p>        explained in the concurring opinion of one of the learned<br \/>\n        Judges of the High Court &#8220;gratuity in its etymological sense<br \/>\n        is a git, especially for services rendered, or return for favours<br \/>\n        received&#8221;. It has now been universally recognized that all<br \/>\n        persons in society need protection against loss of income due<br \/>\n        to unemployment arising out of incapacity to work due to<br \/>\n        invalidity, old age etc. For the wage-earning population,<br \/>\n        security of income, when the worker becomes old or infirm,<br \/>\n        if of consequential importance. The provisions contained in<br \/>\n        the Act are in the nature of social-security measures like<br \/>\n        employment insurance, provident fund and pension. The Act<br \/>\n        accepts, in principle, compulsory payment of gratuity as a<br \/>\n        social-security measure to wage-earning population in<br \/>\n        industries, factories and establishments.\n<\/p><\/blockquote>\n<blockquote><p>                7. Thus, the main purpose and concept of gratuity is<br \/>\n        to help the workman after retirement, whether retirement is a<br \/>\n        result of rules of superannuation or physical disablement or<br \/>\n        impairment of vital part of the body. The expression<br \/>\n        &#8220;gratuity&#8221; itself suggests that it is a gratuitous payment given<br \/>\n        to an employee on discharge, superannuation or death.<br \/>\n        Gratuity is an amount paid unconnected with any<br \/>\n        consideration and not resting upon it, and has to be<br \/>\n        considered as something given freely, voluntarily or without<br \/>\n        recompense. It is a sort of financial assistance to tide over<br \/>\n        post-retiral hardships and inconveniences.&#8221;<\/p><\/blockquote>\n<p>       In the case of Management of Goodyear India Limited<br \/>\n(supra), the Apex Court has ruled as under:-\n<\/p>\n<blockquote><p>                &#8220;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;Gratuity will have to be paid to all<br \/>\n        those persons whose employment came to an end after the<br \/>\n        coming into force of the Act for that period during which he<br \/>\n        came within the definition of an employee within the<br \/>\n        meaning of Section 2 (e) of the Payment of Gratuity Act. To<br \/>\n        hold otherwise may render a whole class of persons who all<br \/>\n        their lives got wages of less than Rs 1000 per month, but on<br \/>\n        the eve of their retirement started getting wages of Rs 1000<br \/>\n        per month. Surely that could not have been the intention of<br \/>\n        Parliament. We think the only reasonable way of construing<br \/>\n        Section 4 in the light of the definition of employee in Section<br \/>\n        2 (e) is to hold that a person whose services are terminated for<br \/>\n        any of the reasons mentioned in Section 4 (1), after the<br \/>\n        coming into force of the Act is entitled to the payment of<br \/>\n        gratuity, if he has rendered continuous service for not less<br \/>\n        than five years, for that period during which he satisfied the<br \/>\n        definition of employee under Section 2 (e) of the Act.&#8221;<\/p><\/blockquote>\n<p>       Having considered the aforesaid dictum of the Apex Court as well as<br \/>\nthe provisions of the Act, the inevitable conclusion is that opposite party<br \/>\nno.3 is entitled for gratuity as he has rendered more than five years of<br \/>\ncontinuous service. I find no illegality in the orders passed by the Prescribed<br \/>\nAuthority as well as by the Appellate Authority. Learned counsel for the<br \/>\npetitioner could not raise any substantial legal point to indicate that the<br \/>\n<span class=\"hidden_text\">                                        6<\/span><\/p>\n<p>orders suffer from any illegality in any manner.\n<\/p>\n<p>        The writ petition is devoid of merit.
