Application No.899 of 2010 dated 25.08.2010<br \/>\nbefore the learned Magistrate and prayed that his written complaint<br \/>\ndated 04.08.2010 filed before the Makarpura Police Station be<br \/>\ndirected to be registered as FIR and procedure thereupon be<br \/>\nundertaken.\n<\/p>\n<p>=\tLearned<br \/>\nMagistrate rejected this application by his impugned order observing<br \/>\ninter alia that when no complaint under Section 190 of the Code of<br \/>\nCriminal Procedure disclosing commission of cognizance of offence has<br \/>\nbeen filed before him, he does not have any power to accept the<br \/>\nrequest of the petitioner for directing registration of FIR under<br \/>\nSection 156(3) of Cr.P.C.. Learned Magistrate was also opinion that<br \/>\nwhen no such complaint is before him, no steps as provided under<br \/>\nSection 202 of the Cr.P.C. are required to be taken. In the<br \/>\nconclusion, he observed that the entire attempt is to by-pass the<br \/>\ninquiry under Section 202 of the Cr.P.C. and to insist that<br \/>\ninvestigation be undertaken by the police under Section 156(3) of the<br \/>\nCr.P.C..\n<\/p>\n<p>\tLearned<br \/>\ncounsel for the petitioner submitted that along with the said<br \/>\nCriminal Misc. Application No.899 of 2010, the petitioner had also<br \/>\nannexed the complaint dated 04.08.2010 made to the concerned Police<br \/>\nStation. Learned Magistrate was, therefore, not right in observing<br \/>\nthat no complaint is before him upon which appropriate orders can be<br \/>\npassed. Though I am not largely in agreement with the above<br \/>\ncontention of the petitioner for two counts, I am of the opinion that<br \/>\nit would be appropriate that the petitioner files fresh complaint in<br \/>\nwriting before the learned Magistrate. Firstly, only prayer made in<br \/>\nthe Criminal Misc. Application No.899 of 2010 was for registration of<br \/>\nFIR under Section 156(3) of the Cr.P.C., no option was available<br \/>\nunder Cr.P.C. was left open to the learned Magistrate. Secondly, the<br \/>\nCriminal Misc. Application did not contain full details of the<br \/>\nallegations of the petitioner and he merely relied upon the complaint<br \/>\ndated 04.08.2010 made to the Makarpura Police Station to elaborate<br \/>\nthe allegations against the persons named therein.\n<\/p>\n<p>\tUnder<br \/>\nthe circumstances, this petition is disposed of permitting the<br \/>\npetitioner to file fresh written complaint before the learned<br \/>\nMagistrate narrating all the allegations against the proposed<br \/>\naccused. If such complaint is filed, learned Magistrate shall take<br \/>\nsuch steps as may be found necessary in accordance with law. In other<br \/>\nwords, he may either direct police investigation under Section<br \/>\n156(3) of the Cr.P.C. or if so found necessary at his discretion hold<br \/>\nCourt inquiry in terms of provisions contained in Section 200 &#8211; 202<br \/>\nof the Cr.P.C. This shall be done unmindful of the observations made<br \/>\nin the impugned order since even otherwise, I am of the opinion that<br \/>\nCriminal Misc. Application No.899 of 2010 itself could have been<br \/>\ntreated as written complaint by the learned Magistrate.
