Singh, vide his RTI application dated 20\/03\/2009, sought<br \/>\ninformation regarding the basis and department policy under which the interest free vehicle loan<br \/>\nwas granted to Shri Anil KumarArora, Development Officer, Karnal and others. The information<br \/>\nsought was from 01\/01\/2008 to till date.\n<\/p>\n<p>2.     This was responded to by the CPIO vide his letter dated 25\/03\/2009 stating that the<br \/>\ninformation asked for by the appellant was in respect of third person for which consent from the<br \/>\nperson concerned was necessary. The CPIO denied to give the information citing exemption<br \/>\ngranted u\/s 8(1)(e) of the RTI Act.\n<\/p>\n<p>3.     Dissatisfied with the decision of the CPIO, the appellant preferred his first appeal before<br \/>\nthe FAA on 12\/05\/2009 which was responded to by FAA vide his order dated 23\/06\/2009<br \/>\nupholding the stand taken by the CPIO.\n<\/p>\n<p>4.        Hence, the present appeal.\n<\/p>\n<p>5.     The matter came up for hearing today. The appellant is present. The public authority is<br \/>\nrepresented by the officers mentioned above. It is the submission of the appellant that he has not<br \/>\nreceived full and complete information sought by him from the CPIO.\n<\/p>\n<p>6.      In respect of Q i), the appellant has sought information regarding the amount of interest-<br \/>\nfree vehicle loan to which Shri Anil Kumar Arora, Development Officer was entitled and the price<br \/>\nof the vehicle which he purchased with the loan.\n<\/p>\n<p>7.     Furthermore, he has sought to receive a copy of the policy and rules under which interest-<br \/>\nfree vehicle loan have been granted to the above mentioned person along with hypothecation<br \/>\ndocuments.\n<\/p>\n<p>                                          DECISION\n<\/p>\n<p>8.      The public authority is directed to provide the appellant with a copy of the rules pertaining<br \/>\nto grant of interest-free loans for purchase of cars to Development Officers along with the amount<br \/>\nof the loan sanctioned to Shri Arora.\n<\/p>\n<p>9.      However, the information regarding the price at which the vehicle was purchased by the<br \/>\nthird party is exempt from disclosure under sub section (j)() of section 8(1) o the RTI Act.\n<\/p>\n<p> 10.     The appellant has sought copies of the hypothecation documents of the vehicle purchased<br \/>\nby the above mentioned Development Officer, which is also exempted from disclosure under sub<br \/>\nsection (j) of section 8(1) of the Act since once the loan is taken by an official of the public<br \/>\nauthority, that becomes personal to him and, therefore, the hypothecation documents are also<br \/>\nexempted from disclosure under the said section.\n<\/p>\n<p>iv):- In respect of names, place of posting, entitlement and sale price of vehicles for which loans<br \/>\nwas advanced to other Development Officers, this information too is exempted from disclosure<br \/>\nbeing third party information.\n<\/p>\n<p>12.     The information as directed above may be provided to the appellant by the public authority<br \/>\nwithin two weeks of receiving this order.\n<\/p>\n<p>13.
