During the hearing on 26.10.2009, through videoconferencing<br \/>\n(VC), in which the complainant was present at NIC VC facility at<br \/>\nAhmedabad and the respondents \u23af represented by Shri Amrik Singh,<br \/>\nUnder Secretary and Shri R.S. Bora, Section Officer \u23af were present at<br \/>\nCIC&#8217;s New Delhi office, CPIO, Shri Amrik Singh stated that they were<br \/>\nwilling to provide to the complainant all information relating to his<br \/>\nRTI-application, which was as follows:-\n<\/p>\n<blockquote><p>       &#8220;We draw your attention to our notice dated 30th Dec. 2006<br \/>\n       inter-alia, addressed to the Secretary, Ministry of Finance, Govt.<br \/>\n       of India, New Delhi u\/s 80 of Code of Civil Procedure, 1908<br \/>\n       claiming compensation of Rs.33,00,000\/- (Rupees Thirty three<br \/>\n       Lacs only) from Shri S.T. Mahadik, Presiding Officer, Debts<br \/>\n       Recovery Tribunal, Ahmedabad and Govt. of India. We request<br \/>\n       you to provide us with the following information in respect of<br \/>\n       the aforesaid notice.\n<\/p><\/blockquote>\n<blockquote><p>       (i)     When was this notice received by Ministry of Finance?\n<\/p><\/blockquote>\n<blockquote><p>       (ii)    When was this notice put up to the Secretary, Ministry of<br \/>\n               Finance?\n<\/p><\/blockquote>\n<blockquote><p>       (iii)   What was the decision taken by the Secretary, Ministry of<br \/>\n               Finance?\n<\/p><\/blockquote>\n<blockquote><p>       (iv)    When was the decision of Secretary, Ministry of Finance<br \/>\n               communicated?&#8221;\n<\/p><\/blockquote>\n<p>3.   It is directed that respondents provide the information to the<br \/>\ncomplainant within one week of the receipt of this order.\n<\/p>\n<p>AT-30102009-03.doc<br \/>\n<span class=\"hidden_text\">                                                              Page 1 of 3<\/span>\n<\/p>\n<p> 4.    As regards deemed-refusal of complainant&#8217;s RTI-application,<br \/>\nrespondents explained that this occurred on account of the fact that<br \/>\nthe Section 80 CPC notice referred to by the complainant in his<br \/>\nRTI-application could not be located and the file was circulated from<br \/>\none department to another for locating it. By the time the<br \/>\ncomplainant&#8217;s Section 80 notice was received from the Debts Recovery<br \/>\nTribunal, over four months had already lapsed. No reply was provided<br \/>\nto the complainant even then. The first time any response to these<br \/>\nqueries was furnished was when respondents replied to the CIC notice<br \/>\ndated 05.08.2008 through their communication dated 14.08.2008.\n<\/p>\n<p>5.    It is obvious that this matter has suffered considerable delay at<br \/>\nseveral levels.    Even if the respondents&#8217; reason for delay that<br \/>\ncomplainant&#8217;s Section 80 CPC notice was not traceable for considerable<br \/>\nlength of time, is conceded, it is yet unclear as to why when the file<br \/>\ncontaining the above notice was located on 12.12.2007, no reply was<br \/>\nfurnished to the complainant. The respondents corresponded with the<br \/>\ncomplainant only after they received the notice from CIC.\n<\/p>\n<p>6.    I find that the reason for delay in this matter is poor maintenance<br \/>\nof record in the two departments, viz. Department of Financial Services<br \/>\nand the Debts Recovery Tribunal and, a certain amount of confusion<br \/>\nabout whether such an information was liable for disclosure. But rather<br \/>\nthan subject the matter to such gross delays, the CPIO could have done<br \/>\nwell to take the complainant into confidence about the action he was<br \/>\ntaking to identify the record.\n<\/p>\n<p>7.    I do not wish to initiate any penalty proceedings against the CPIO<br \/>\ngiven the circumstances of this case which raises a reasonable belief<br \/>\nthat there was no deliberate attempt to withhold information from the<br \/>\ncomplainant, I think complainant is still entitled to receive<br \/>\ncompensation for the detriment he suffered on account of the<br \/>\nsubstantial delays.\n<\/p>\n<p>8.    It is, therefore, directed that notices may issue to the heads of<br \/>\nthe departments (the Secretary, Department of Financial Services and<br \/>\nthe Presiding Officer, Debts Recovery Tribunal-I, Ahmedabad), repeated<br \/>\nto the Appellate Authorities and the CPIOs, to show cause as to why a<br \/>\ncompensation of Rs.5000\/- should not be authorized under Section<br \/>\n19(8)(b) to the complainant for the detriment he suffered on account of<br \/>\ndelays in this matter.\n<\/p>\n<p>AT-30102009-03.doc<br \/>\n<span class=\"hidden_text\">                                                              Page 2 of 3<\/span>\n<\/p>\n<p> 9.
