SHAH\n\t\t\n\t\n\n \n\nDate\n: 14\/10\/2010 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\tBy<br \/>\nway of this petition under Article 227 of the Constitution of India<br \/>\nthe petitioner has prayed for an appropriate writ, order or direction<br \/>\nquashing and setting aside the impugned judgement and award dated<br \/>\n19\/05\/2010 passed by the Labour Court, Ahmedabad in Reference (L.C.A)<br \/>\nNo. 256\/1996 by which the Labour Court has partly allowed the<br \/>\nReference directing the petitioner to reinstate the<br \/>\nrespondent-workman with 30% back wages and continuity of service.\n<\/p>\n<p>2.\tShri<br \/>\nYogen Pandya, learned advocate appearing on behalf of the petitioner<br \/>\nhas vehemently submitted that  the respondent-workman has failed to<br \/>\nprove that he had worked for more than 240 days in the last preceding<br \/>\nyear  and as such it appears that the respondent had abandoned the<br \/>\nwork.  It is submitted that the finding given by the Labour Court<br \/>\nthat the respondent-workman has worked for more than one year is<br \/>\nbased on no evidence. It is further submitted that assuming that the<br \/>\nrespondent-workman had worked for more than 240 days in the last<br \/>\npreceding year, however, considering the fact that the total tenure<br \/>\nof the respondent-workman was 9 \u00bd months, the Labour Court has<br \/>\nmaterially erred in directing the petitioner to reinstate the<br \/>\nrespondent with 30% back wages as the respondent-workman was<br \/>\ngainfully employed during the interregnum period.  Relying upon the<br \/>\ndecision of the Hon&#8217;ble Supreme Court in the case of SENIOR<br \/>\nSUPERINTENDENT TELEGRAPH (TRAFFIC), BHOPAL Vs. SANTOSH KUMAR SEAL AND<br \/>\nORS reported in (2010) 6 SCC 773 it is requested to award<br \/>\nlumpsum monetary compensation in lieu of reinstatement and back wages<br \/>\nconsidering the fact that the respondent-workman had worked for 9 \u00bd<br \/>\nmonths only.\n<\/p>\n<p>3.\tShri<br \/>\nGadia, learned advocate appearing on behalf of the respondent has<br \/>\ntried to oppose the present petition, however, he is not in a<br \/>\nposition to substantiate and\/or justify the finding given by the<br \/>\nLabour Court  that the respondent-workman had worked for more than<br \/>\none year. He is also not in a position to satisfy how the<br \/>\nrespondent-workman worked for more than 240 days in the last<br \/>\npreceding year.  However, it is submitted that when there is a<br \/>\nfinding given by the Labour Court, the same is not required to be<br \/>\ninterfered with by this Court under Article 227 of the Constitution<br \/>\nof India.\n<\/p>\n<p>3.1.\tIt<br \/>\nis submitted that in case this Court inclines to quash and set aside<br \/>\nthe impugned judgement and award, in that case, it is requested to<br \/>\naward reasonable monetary compensation in lieu of reinstatement and<br \/>\nback wages.\n<\/p>\n<p>4.\tHeard<br \/>\nthe learned advocates appearing on behalf of the respective parties<br \/>\nat length.  Considering the impugned judgement and award, it prima<br \/>\nfacie appears that the finding given by the Labour Court that the<br \/>\nrespondent-workman had worked for one year is based on no evidence.<br \/>\nIt appears that as such the respondent has failed to establish and<br \/>\nprove that he had worked for more than 240 days in the last preceding<br \/>\nyear.  However, assuming that the respondent-workman had worked for<br \/>\nmore than 240 days in the last preceding year and that there was no<br \/>\nbreach of Section 25F  of the Industrial Disputes Act, in that case,<br \/>\nconsidering the total tenure of service of the respondent-workman of<br \/>\n9 \u00bd months only and considering the  fact that the<br \/>\nrespondent-workman was gainfully employed during the interregnum<br \/>\nperiod  and considering the recent decision of the Hon&#8217;ble Supreme<br \/>\nCourt in the case of SENIOR SUPERINTENDENT TELEGRAPH (TRAFFIC),<br \/>\nBHOPAL (supra), the respondent-workman can be compensated in<br \/>\nterms of lumpsum monetary compensation in lieu of reinstatement and<br \/>\nback wages.  It appears to the Court that considering the total<br \/>\nservice tenure of the respondent of 9 \u00bd months if Rs. 25,000\/-<br \/>\n is awarded by way of lumpsum compensation in lieu of reinstatement<br \/>\nand back wages and continuity of service it would sub-serve the ends<br \/>\nof justice.\n<\/p>\n<p>5.\tIn<br \/>\nview of the above and for the reasons stated hereinabove, the present<br \/>\npetition succeeds in part and the impugned judgement and award passed<br \/>\nby the Labour Court, Ahmedabad dated 31\/05\/2010 in Reference (L.C.A)<br \/>\nNo. 1605\/1996 is modified to the extent  that instead of<br \/>\nreinstatement with 30% back wages and continuity in service, the<br \/>\npetitioner to pay a total sum of Rs. 25,000\/-  to the respondent by<br \/>\nway of lumpsum monetary compensation in lieu of reinstatement, back<br \/>\nwages and continuity of service, which shall be paid by the<br \/>\npetitioner to the respondent by an account payee cheque within a<br \/>\nperiod of six weeks from today, failing which it shall carry interest<br \/>\nat the rate of 9%.  Rule is made absolute accordingly.
