It<br \/>\nis also not in dispute that private I.T.Is are getting 100 per cent<br \/>\ngrant in aid from the Government.  The counsel for the petitioner<br \/>\nsubmits that the petitioner is willing to go anywhere if is absorbed<br \/>\nin another institution.  In view of these facts it is certainly<br \/>\nwithin the competence of the respondent no. 3 to direct absorption of<br \/>\nthe petitioner in an institution where the post in question is<br \/>\nvacant.  The institution has no say in the matter as it is receiving<br \/>\n100 per cent grant in aid from the Government.  Respondent no. 3 has<br \/>\nall the prerogative to send an employee who has been declared surplus<br \/>\nfrom one institution to another institution which is receiving<br \/>\ngrant-in-aid.  In view of this position I consider it proper to<br \/>\ndispose of this special civil application with the direction to the<br \/>\nrespondent no. 3 that the case of the petitioner for absorption on<br \/>\nthe post of Draughtsman (Civil) in another institution where post is<br \/>\nlying vacant shall be considered within a period of three months from<br \/>\nthe date of receipt of copy of this order and appropriate order be<br \/>\npassed.  In case the petitioner cannot be absorbed in another<br \/>\ninstitution, respondent no. 3 shall pass a reasoned order and copy of<br \/>\nthe same may be sent to the petitioner by registered post A.D.  In<br \/>\nthat case liberty is granted to the petitioner for revival of this<br \/>\nspecial civil application till the matter of absorption of the<br \/>\npetitioner in another institution is decided, the interim relief<br \/>\ngranted by this Court shall continue to operate.  Subject to the<br \/>\naforesaid direction, petition stands disposed of.  Rule discharged.<br \/>\nNo order as to costs.\n<\/p>\n<p>3.\tIn<br \/>\nthe present case, interim relief was granted by this court on<br \/>\n06.04.1993 till further orders.  Since the issue involved in the<br \/>\npresent petition is similar to the aforesaid case, the present<br \/>\npetition shall also be governed by the aforesaid decision.\n<\/p>\n<p>4.\tAccordingly,<br \/>\nthis petition is disposed of with the direction to the respondent no.<br \/>\n3 that the case of the petitioner for absorption on the post of<br \/>\nSupervisor Instructor in another institution where post is lying<br \/>\nvacant shall be considered  within a period of three months from the<br \/>\ndate of receipt of copy of this order and appropriate order be<br \/>\npassed.  In case the petitioner cannot be absorbed in another<br \/>\ninstitution, respondent no. 3 shall pass a reasoned order and copy of<br \/>\nthe same may be sent to the petitioner by registered post A.D.
