Justice V.RAMKUMAR\n\n Dated :10\/12\/2010\n\n O R D E R\n                        V.RAMKUMAR, J.\n           ---------------------------------------------------\n              Bail Application No.8006 of 2010\n          -----------------------------------------------------\n        Dated this the 10th day of December, 2010\n\n                               ORDER\n<\/pre>\n<p>     Petitioners, who are accused Nos.1 to 4 in Crime No.471<\/p>\n<p>of 2010 of Nedumkandam Police Station for offences<\/p>\n<p>punishable under Sections 120(B), 464, 465, 468 &amp; 471 read<\/p>\n<p>with Section 34 I.P.C., seek anticipatory bail.<\/p>\n<p>     2.    The    learned      Public    Prosecutor      opposed    the<\/p>\n<p>application.\n<\/p>\n<p>     3.    After evaluating        the    factors     and parameters<\/p>\n<p>which are to be taken into consideration               in the light of<\/p>\n<p>paragraph 122 of the verdict dated 2-12-2010 of the Apex<\/p>\n<p>Court   in   <a href=\"\/doc\/1108032\/\">Siddharam Satlingappa Mhetre v. State of<\/p>\n<p>Maharashtra and Others (Crl.Appeal No.<\/a> 2271 of 2010),<\/p>\n<p>I am of the view that anticipatory bail cannot be granted in a<\/p>\n<p>case of this nature, since the investigating officer has not had<\/p>\n<p>the advantage of interrogating the petitioners.               But at the<\/p>\n<p>same time,      I am inclined to permit the petitioners to<\/p>\n<p>surrender before the Investigating Officer for the purpose of<\/p>\n<p>interrogation and then to have their              application for bail<\/p>\n<p>allowed by the Magistrate or the Court             having jurisdiction.<\/p>\n<p>Bail Appln.No.8006\/2010<br \/>\n<span class=\"hidden_text\">                                 : 2 :<\/span><\/p>\n<p>Accordingly, the petitioners shall surrender before the<\/p>\n<p>investigating officer on 20\/12\/2010 or on 21\/12\/2010 for<\/p>\n<p>the purpose of interrogation and recovery of incriminating<\/p>\n<p>material, if any. In case the investigating officer is of the<\/p>\n<p>view that having regard to the facts of the case arrest of the<\/p>\n<p>petitioners     is imperative he shall record his reasons for the<\/p>\n<p>arrest in the case diary as insisted in paragraph 129            of<\/p>\n<p>Siddharam Satlingappa Mhetre&#8217;s case (supra).                   The<\/p>\n<p>petitioners shall thereafter be produced before the Magistrate<\/p>\n<p>or the Court concerned and permitted to file an application<\/p>\n<p>for regular bail.      In case the interrogation of the petitioners<\/p>\n<p>is without arresting them, the petitioners shall thereafter<\/p>\n<p>appear before the Magistrate or the Court concerned            and<\/p>\n<p>apply for regular bail. The Magistrate or the Court on being<\/p>\n<p>satisfied that the petitioners have been interrogated by the<\/p>\n<p>police shall, after hearing the prosecution as well, release<\/p>\n<p>the petitioners on bail.\n<\/p>\n<p>      4. In case the petitioners while surrendering before<\/p>\n<p>the Investigating Officer have        deprived  the investigating<\/p>\n<p>officer    sufficient time for interrogation, the officer shall<\/p>\n<p>Bail Appln.No.8006\/2010<br \/>\n<span class=\"hidden_text\">                                  : 3 :<\/span><\/p>\n<p>complete the interrogation even if it is beyond the time limit<\/p>\n<p>fixed as above and submit a report to that effect                to the<\/p>\n<p>Magistrate or the Court concerned. Likewise, the Magistrate<\/p>\n<p>or the Court also will not be bound by the time limit fixed as<\/p>\n<p>above      if  sufficient    time    was not available        after the<\/p>\n<p>production or appearance of the petitioners .<\/p>\n<p>      5.     The release of the       petitioners shall be on each<\/p>\n<p>the petitioners executing a bond for `15,000\/- (Rupees fifteen<\/p>\n<p>thousand only) with two solvent sureties each for the like<\/p>\n<p>amount to the satisfaction of the            Court concerned       and<\/p>\n<p>subject to the following conditions:-\n<\/p>\n<blockquote><p>             1.     The petitioners      shall report before the<\/p>\n<p>             Investigating Officer between 9 a.m. and 11 a.m. on<\/p>\n<p>             all Wednesdays.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>             2. The petitioners shall make themselves available<\/p>\n<p>             for interrogation including custodial interrogation as<\/p>\n<p>             and when required by the Investigating Officer.<\/p>\n<\/blockquote>\n<blockquote><p>             3.     The petitioners shall not influence or intimidate<\/p>\n<p>             the prosecution witnesses nor shall they attempt to<\/p>\n<p>             tamper with the evidence for the prosecution.<\/p>\n<\/blockquote>\n<p>Bail Appln.No.8006\/2010<br \/>\n<span class=\"hidden_text\">                                  : 4 :<\/span><\/p>\n<p>             4.     The petitioners shall not commit any offence<\/p>\n<p>             while on bail.\n<\/p>\n<\/p>\n<p>              5.
