The Labour Court considered that on 29.9.1987<br \/>\n     the applicants were intimated that from 31.10.1987 their<br \/>\n     services will be terminated as the road work         was<br \/>\n     completed.    The   Labour   Court also considered the<br \/>\n     grievance made on behalf of the workmen that it was a<br \/>\n     case of violation of Sections 25F, 25G and 25H of the<br \/>\n     Industrial Disputes Act.    The Labour Court has also<br \/>\n     considered the case which was set up on behalf of the<br \/>\n Deputy Executive Engineer, Junagadh i.e.     the present<br \/>\npetitioner that the applicants were served with the<br \/>\nnotice, they were offered the retrenchment compensation<br \/>\nand they refused to take the same and as such there was<br \/>\nno breach of any provision of law. It was also noticed<br \/>\nby the Labour Court that the applicants were appointed<br \/>\nfor a particular work and on completion of work their<br \/>\nservices were terminated and the arguments raised on<br \/>\nbehalf of the Deputy Executive Engineer that the work had<br \/>\nbeen completed and thereafter the services of         the<br \/>\nconcerned workmen were terminated and therefore there was<br \/>\nno question of reinstatement. The Labour Court has held<br \/>\nthat it was not proved that the notices were served.   It<br \/>\nis also held that it was not proved that the compensation<br \/>\nwas sent and therefore the Labour Court has held that it<br \/>\nwas a case of violation of Sections 25F, 25G and 25H and<br \/>\ntherefore, the workmen were entitled to be reinstated.<br \/>\nHowever, the Labour Court has also noticed that they were<br \/>\ncasual workers and therefore, the backwages were denied<br \/>\nand the relief of reinstatement was granted.\n<\/p>\n<p>I have heard learned Counsel Ms.Nayana Panchal.<br \/>\nShe pointedly invited the attention of this Court to the<br \/>\nnotice dated 30.9.1987 and this notice dated 30.9.1987 is<br \/>\nself explanatory at least with regard to the violation of<br \/>\nsection 25F of the Industrial Disputes Act. As per this<br \/>\nnotice, the services of the concerned workmen were<br \/>\nterminated i.e.    the concerned workmen were retrenched<br \/>\nfrom 31.10.1987 and in this very notice, it is mentioned<br \/>\nthat the dues under the Industrial Disputes Act, the<br \/>\nwages and compensation under section        25F    of  the<br \/>\nIndustrial Disputes Act and any other dues, may be<br \/>\ncollected from the office of the Executive Engineer on<br \/>\n7.11.1987.   It is therefore ,clear that the workmen were<br \/>\nretrenched   from   31.10.1987   and   the    retrenchment<br \/>\ncompensation and the dues under sections 25F of the<br \/>\nIndustrial Disputes Act, were not paid on or before<br \/>\n31.10.1987 that is a date from which the retrenchment<br \/>\nbecame effective. In the order itself, it is mentioned<br \/>\nthat the dues are to be collected on 7.11.1987. It is,<br \/>\ntherefore, proved on the face of the notice dated<br \/>\n30.9.1987 itself that the pre requisite and condition<br \/>\nprecedent to the retrenchment as envisaged under section<br \/>\n25F of the Industrial Disputes Act, were not followed<br \/>\nrather the same have been violated         resulting   the<br \/>\nretrenchment to be void. In this view of the matter, the<br \/>\nfinding of the Labour Court that these workmen had been<br \/>\nretrenched in violation of Section 25F          cannot  be<br \/>\ninterfered with and whereas no backwages whatsoever have<br \/>\nbeen granted, there is no question of now going into the<br \/>\naspects relating to the backwages. Thus, I find that the<br \/>\n impugned award with regard to each of these ten concerned<br \/>\nworkmen does not warrant any interference and none of<br \/>\nthese ten Special Civil Applications can be entertained.<br \/>\nAccordingly, all these ten Special Civil Applications are<br \/>\nhereby dismissed and the notice issued by this Court in<br \/>\neach of the matters is hereby discharged.\n<\/p>\n<p>It appears from the order sheet dated 29.1.1997<br \/>\nthat the impugned award was stayed by this Court on<br \/>\ncondition that the petitioner shall deposit an amount of<br \/>\nRs.10,000\/- in the first instance towards the costs of<br \/>\nthe petition and the notice was issued on the condition<br \/>\nas aforesaid.     Ms.Devyani N.Dave has submitted that<br \/>\nwhereas the petitions are being dismissed an amount of<br \/>\nRs.1,000\/-    deposited towards costs in each of the<br \/>\npetition i.e. a sum of Rs.10,000\/- in all may be awarded<br \/>\nto the petitioners. The document dated 26.3.1997 filed<br \/>\nby Ms.N.V.Panchal, Advocate for the petitioner shows that<br \/>\nthis amount of Rs.10,000\/- has already been deposited in<br \/>\ncash in the registry of the High Court against costs i.e.<br \/>\nRs.1,000\/- per petition.    Since the concerned workmen<br \/>\nhave been dragged to this litigation which has resulted<br \/>\ninto rejection of this petition they are entitled to get<br \/>\nthis amount of Rs.1,000\/-.      Accordingly, it is ordered<br \/>\nthat this sum of Rs.10,000\/- is hereby permitted to be<br \/>\nwithdrawn by the concerned workmen and\/or the legal heirs<br \/>\nof the workmen in case the concerned workman has expired,<br \/>\nat the rate of Rs.1,000\/- per petition.
