Justice S.SIRI JAGAN\n\n Dated :23\/07\/2008\n\n O R D E R\n                      S.SIRI JAGAN, J\n                ==================\n                 W.P(C)No. 20762 of 2008\n                ==================\n          Dated this the 23rd day of July, 2008.\n\n                      J U D G M E N T\n<\/pre>\n<p>     The petitioner claims to be a Christian Parava who<\/p>\n<p>according to the petitioner comes within the category of<\/p>\n<p>&#8220;Other Christians&#8221; for the purpose of reservation in<\/p>\n<p>Government employment. The petitioner therefore seeks a<\/p>\n<p>direction to the 2nd respondent to issue a community<\/p>\n<p>certificate showing the petitioner as &#8220;Other Christian&#8221;. The<\/p>\n<p>learned Special Government Pleader submits that the<\/p>\n<p>petitioner is only a Latin Catholic and the community<\/p>\n<p>certificate showing him as a Latin Catholic can be issued to<\/p>\n<p>him, provided he repays the educational concession which<\/p>\n<p>he has received as a scheduled caste claiming himself to be<\/p>\n<p>a Christian Parava and also he makes necessary publication<\/p>\n<p>in the official gazette correcting his community in the<\/p>\n<p>S.S.L.C. certificate as Latin Catholic.\n<\/p>\n<p>     2. I am of opinion that for the purpose of issuing a<\/p>\n<p><span class=\"hidden_text\">W.P(C)No. 20762 of 2008        &#8211; 2 &#8211;<\/span><\/p>\n<p>community certificate to the petitioner, it is not necessary<\/p>\n<p>that the above procedure as suggested by the Special<\/p>\n<p>Government Pleader should be complied with. If on the<\/p>\n<p>basis of enquiry made by the 2nd respondent, the 2nd<\/p>\n<p>respondent is satisfied that the petitioner is a Latin Catholic<\/p>\n<p>a community certificate has to be issued to the petitioner to<\/p>\n<p>that effect. Of course it would be open to the respondents 1<\/p>\n<p>and 2 take appropriate action to recover any amounts of<\/p>\n<p>concession which the petitioner has received irregularly by<\/p>\n<p>taking appropriate proceedings in that regard separately.<\/p>\n<p>However, that shall not stand in the way of issuing<\/p>\n<p>community certificate to the petitioner. I also do not think<\/p>\n<p>that for that purpose any correction in the records is<\/p>\n<p>mandatory       since   according   to the  respondents    the<\/p>\n<p>community shown in the records is wrong. That should be<\/p>\n<p>left to the petitioner&#8217;s choice, if he wants to keep his<\/p>\n<p>records correct with the consequences he may suffer on<\/p>\n<p>account of such non-correction.\n<\/p>\n<p><span class=\"hidden_text\">W.P(C)No. 20762 of 2008      &#8211; 3 &#8211;<\/span><\/p>\n<p>      Accordingly, I dispose of this writ petition with a<\/p>\n<p>direction to the 2nd respondent to issue a community<\/p>\n<p>certificate to the petitioner showing his actual community<\/p>\n<p>within a period of one week from the date of receipt of a<\/p>\n<p>copy of this judgment. In order to make the records correct<\/p>\n<p>the petitioner may take appropriate steps to get his<\/p>\n<p>community corrected in the official records in tune with the<\/p>\n<p>community certificate to be issued by the 2nd respondent as<\/p>\n<p>above.
