Learned counsel appearing for the petitioner submits that<\/p>\n<p>       the petitioner was working on the post of Sub-Engineer in Block<\/p>\n<p>       Mahasamund. He was dismissed from service on 31.01.1981. <\/p>\n<p>  2.   The  petitioner,  by  this petition  seeks,  inter-alia,<\/p>\n<p>       following relief:\n<\/p>\n<p>            &#8221; 7.3     That this Hon&#8217;ble Court may kindly be<br \/>\n            pleased  to  hold the dismissal to be  illegal,<br \/>\n            arbitrary,   perverse,  biased,  malafide   and<br \/>\n            unconstitutional  and the petitioner  has  been<br \/>\n            acquitted  by learned Chief Judicial Magistrate<br \/>\n            vide judgment dated 8.12.2004 (Annexure P\/3) of<br \/>\n            the  charge falsely roped U\/s 409 I.P.C. he  be<br \/>\n            allowed  for  all  the service  rules  benefits<br \/>\n            provisional so for pension and retrial benefits<br \/>\n            gratuities  outstanding salary since  31.3.1981<br \/>\n            of  the  dismissal  relieving  order  and  with<br \/>\n            increased benefits salaries dues since date  of<br \/>\n            acquittal  dated  08.12.2004  in  view  of  the<br \/>\n            decision   of   Hon&#8217;ble   Supreme   Court   and<br \/>\n            provisions of law. Issue of writ direction  and<br \/>\n            order appropriate against the respondents.&#8221;<\/p>\n<p>  3.   On  query that whether the dismissal order was passed on<\/p>\n<p>       the basis of pendency of criminal case, and further what did<\/p>\n<p>       the petitioner do since 31.03.1981 till date. Learned counsel,<\/p>\n<p>       without replying to the query, contends that the case of the<\/p>\n<p>       petitioner is squarely covered by a decision of the Supreme<\/p>\n<p>       Court in case of G.M.Tank Vs. State of Gujrat1, as the facts<\/p>\n<p>       involved are similar.\n<\/p>\n<p>  4.   With regard to the laches and delay of more than 27 years<\/p>\n<p>       in filing the petition, the learned counsel submits that the<\/p>\n<p>       petitioner was waiting for decision in criminal case. The<\/p>\n<p>       learned counsel has miserably failed to establish the facts<\/p>\n<p>       that the departmental proceeding and the criminal case were<\/p>\n<p>       based on identical and similar set of facts and the charge in<\/p>\n<p>       the departmental case against the petitioner and the charge<\/p>\n<p>       before the criminal Court were one and the same.<\/p>\n<p>  5.   It  is well settled principle of law that a decision  is<\/p>\n<p>       authority for which it is decided and not what can logically be<\/p>\n<p>       deduced therefrom. A little difference in facts or additional<\/p>\n<p>       facts may make a lot of difference in the precedential value of<\/p>\n<p>       a decision.  (See Bhavnagar University Vs. Palitana Sugar Mills<\/p>\n<p>       Pvt. Ltd. and others)2.\n<\/p>\n<p>  6.   In  absence  of  supply  of the complete  facts,  it  is<\/p>\n<p>       difficult to hold that the dismissal of the petitioner and the<\/p>\n<p>       criminal case were based on identical and similar set of facts<\/p>\n<p>       and the charge in departmental case against the petitioner and<\/p>\n<p>       the charge before the criminal Court were one and the same.<\/p>\n<p>       Thus, the case of G.M.Tank (Supra) is distinguishable and is<\/p>\n<p>       not applicable to the facts of the instant case.<\/p>\n<p>  7.   It  is  well settled that High Court in exercise of  its<\/p>\n<p>       discretion does not ordinarily assist the tardy and  the<\/p>\n<p>       indolent or the acquiescent and the lethargic as the belated<\/p>\n<p>       approach may have the effect of inflicting not only hardship<\/p>\n<p>       and inconvenience but also injustice on third parties. (See<\/p>\n<p>       Jagdish Narain Maltiar Vs. The State of Bihar &amp; Others3,<\/p>\n<p>       P.S.Sadasivaswam Vs. State of Tamil Nadu4, State of M.P. &amp;<\/p>\n<p>       Others Vs. Nandlal Jaiswal and others5, Burn Standard Co. Ltd.<\/p>\n<p>       &amp; Others Vs. Dinabandhu Majumdar &amp; another6 and Karnataka Power  <\/p>\n<p>       Corporation Ltd. through its Chairman &amp; Managing Director &amp;<\/p>\n<p>       another Vs. K.Thangappan &amp; another7).\n<\/p>\n<p>  8.   In view of the foregoing, the petitioner has not made out<\/p>\n<p>       a case warranting interference with the order dated 31.01.1981,<\/p>\n<p>       dismissing the petitioner from service.\n<\/p>\n<p>  9.   On the basis of incomplete facts, the petition cannot be<\/p>\n<p>       decided. However, if the petitioner is of the view that his<\/p>\n<p>       termination order was passed on account of criminal case<\/p>\n<p>       pending in a criminal court, the petitioner is at liberty to<\/p>\n<p>       make a representation to the authorities concerned. In the<\/p>\n<p>       event a representation is made, the concerned authorities shall<\/p>\n<p>       consider the representation in accordance with law and pass<\/p>\n<p>       appropriate orders.\n<\/p>\n<p>  10.  In view of the foregoing, this petition stands disposed of<\/p>\n<p>       at motion stage.
