Deshpande, J.  <\/p>\n<p> 1. Heard Mr. Naresh Khandelwal alongwith Mr.<br \/>\nTripathi for the petitioner and Mr. I.S. Thakur,<br \/>\nAdd.P.P. for the State and detaining authority.\n<\/p>\n<p> 2. The petitioner was detained under Section 3(1)<br \/>\nof the Maharashtra Prevention of Dangerous<br \/>\nActivities of Slumlords, Bootleggers, Drug Offenders<br \/>\n&amp; Dangerous Persons Act, 1981, (hereinafter referred<br \/>\nto as the M.P.D.A. Act) by detention order dated<br \/>\n15.4.2002. The grounds of detention are of the even<br \/>\ndate. The detention is challenged on number of<br \/>\ngrounds, however, Mr. Naresh Khandelwal alongwith<br \/>\nMr. Tripathi restricted himself to the ground No.<br \/>\n5(xiii) and other grounds. Since we are allowing<br \/>\nthis petition on ground No. 5(xiii), we do not<br \/>\nthink it necessary to consider other grounds. We<br \/>\nwill be considering one C.R. which is made basis of<br \/>\nthe detention order and affects public order vide<br \/>\nC.R. No. 542 of 2001 registered at Saki Naka<br \/>\nPolice Station.\n<\/p>\n<p> 3. So far as the facts pertaining to the C.R.<br \/>\nare concerned, they are given in the grounds of<br \/>\ndetention in para 4(a)(i). The entire incident that<br \/>\nhas taken place on 26.9.2001 and 27.9.2001 in the<br \/>\noffice premises of Joshi Group of Company, only one<br \/>\npart of the incident is stated to have taken place<br \/>\nat the main gate when the watchman Dinesh Shrivastava<br \/>\nof the Joshi Group of Company tried to take search<br \/>\nof petitioner detenue and his associates. While<br \/>\nsaid Dinesh Shrivastav was taking search, the<br \/>\nassociates of the petitioner opposed and pushed him<br \/>\naside and started running towards auto-rikshaw which<br \/>\nwas already engaged by them. The search was to be<br \/>\ntaken for mobile phone and it is alleged that when<br \/>\nthe security guard Dinesh Shrivastav, Santosh Sawant<br \/>\nand Santosh Singh chased the detenue and his<br \/>\nassociates, suddenly the associates of the detenue<br \/>\nby name. Samirali and Nandkishore @ Tinku took out a<br \/>\nrevolver, pointed it towards Dinesh Shrivastav.<br \/>\nSantosh Sawant and Santosh Singh and threatened them<br \/>\nthat if they proceeded further they would be killed.<br \/>\nThe learned A.P.P. tried to contend that even<br \/>\ntaking out the revolver in open space is sufficient<br \/>\nto create law and order. However, we are not in<br \/>\nagreement with him, because in the next sentence<br \/>\nwhat is stated in that para is that, due to this<br \/>\nincident Shri Dinesh Shrivastav, Santosh Sawant and<br \/>\nSantosh Singh were terribly frightened. It is,<br \/>\ntherefore, clear that at that time nobody was there<br \/>\non the road and nobody was frightened or feared<br \/>\nbecause of taking out the revolver. This incident<br \/>\nhas occurred on 26.9.2001.\n<\/p>\n<p> 4. So far as incident dated 27.9.2001 is<br \/>\nconcerned, which has occurred in the office of the<br \/>\nsaid Joshi Group of Company and it is about the<br \/>\nconversation on telephone and the threats given.<br \/>\nThat incident also does not affect the public order.<br \/>\nHowever, this will not help the detenue in revoking<br \/>\nthe detention order because the two in-camera<br \/>\nstatements do show that the incidents stated by<br \/>\nwitnesses &#8220;A&#8221; &amp; &#8220;B&#8221; are affecting the public order.\n<\/p>\n<p> 5. So far as ground 5(xiii) is concerned, it<br \/>\nis the contention of the detenue as per the C.R.<br \/>\ngiven above, he got the order of bail on 29.1.2002.<br \/>\nThe police could not file chargesheet within the<br \/>\nstipulated period of 60 days. The bail order is<br \/>\nannexed in the compilation at page 435 from which it<br \/>\nis clear that because the chargesheet was not filed<br \/>\nwithin 60 days, the detenue petitioner was allowed<br \/>\nto be released on bail of Rs. 5000\/- cash and one<br \/>\nsurety in like amount. The detenue availed of bail<br \/>\nonly on 4.3.2002 but the two in-camera statements<br \/>\nwere recorded by the police on 5.3.2002 and thus<br \/>\naccording to Mr. Tripathi, it is highly suspicious<br \/>\nand the two in-camera statements were recorded only<br \/>\nto detain the detenue under the provisions of<br \/>\nM.P.D.A. Act.\n<\/p>\n<p> 6. Mr. Tripathi further contended that, in<br \/>\nboth the statements &#8220;A&#8221; &amp; &#8220;B&#8221; what has been narrated<br \/>\nby witnesses &#8220;A&#8221; &amp; &#8220;B&#8221; are alleged to have taken<br \/>\nplace in the first week of October 2001 and 3rd week<br \/>\nof September, 2001 respectively by witnesses &#8220;A&#8221; &amp;<br \/>\n&#8220;B&#8221;. He therefore contended that, firstly the<br \/>\npolice could not submit the chargesheet within 60<br \/>\ndays. In one matter, C.R. No. 542 of 2001 the<br \/>\nMagistrate granted bail and since the detenue<br \/>\navailed of the bail on 4.3.2002 immediately on the<br \/>\nnext date two in-camera statements came to be<br \/>\nrecorded and within the month thereafter the<br \/>\ndetention order came to be passed. He, therefore,<br \/>\ncontended that the in-camera statements are only for<br \/>\nthe purpose of claiming the detention order.\n<\/p>\n<p> 7. The learned A.P.P. tried to defend the<br \/>\ndetention order by contending that it could be of<br \/>\nco-incident that detenue could avail of the bail on<br \/>\n4.3.2002 and in-camera statements recorded on<br \/>\n5.3.2002. We are not satisfied with this<br \/>\nexplanation which is given in the affidavit newly<br \/>\nfiled by the detaining authority Mr. M.N. Singh,<br \/>\nthe Commissioner of Police. Firstly, the incident<br \/>\nthat has been narrated by witnesses &#8220;A&#8221; &amp; &#8220;B&#8221;<br \/>\noccurred in the first of October, 2001 and 3rd week<br \/>\nof September, 2001 and the in-camera statements are<br \/>\nrecorded on 5.3.2002 i.e. after 5 months and 6<br \/>\nmonths delay respectively. Even though it cannot be<br \/>\nsaid that the detenue and his associates had created<br \/>\nterror, the period of 5 and 6 months respectively<br \/>\ndoes not appear to be justified for witnesses coming<br \/>\nforward to give their statements. Secondly and most<br \/>\nimportant aspect of recording of the statements<br \/>\nimmediately on the next day of the release of the<br \/>\ndetenue on bail appears to be highly suspicious. In<br \/>\nWrit Petition No. 530 of 2002 decided by this Court<br \/>\non 10.7.2002 also a similar contention was raised.<br \/>\nIn that case the detenue came to be released on<br \/>\n22.2.2002 by virtue of the bail order dated 7.2.2002<br \/>\nand within two days thereafter i.e. on 24.2.2002<br \/>\ntwo in-camera statements of witnesses &#8220;A&#8221; &amp; &#8220;B&#8221; were<br \/>\nrecorded for the incident occurred in October, 2001.<br \/>\nMr. Tripathi had appeared in that matter also and<br \/>\nhad relied upon our Court&#8217;s decision in Criminal<br \/>\nWrit Petition No. 66 of 2002 and the Court upheld<br \/>\nthe contention of Mr. Tripathi and quash the<br \/>\ndetention order.\n<\/p>\n<p> 8. The learned A.P.P. further tried to<br \/>\ncontend that the authority which has recorded the<br \/>\nstatements of witnesses &#8220;A&#8221; &amp; &#8220;B&#8221; may not be aware<br \/>\nthat the detenue has availed the bail on 4.3.2002.<br \/>\nPerusal of the additional affidavit filed by the<br \/>\ndetaining authority shows that C.R. No. 542 of<br \/>\n2001 was registered by Saki Naka Police Station and<br \/>\nin-camera statements of witnesses A &amp; B were<br \/>\nrecorded on 5.3.2002 were also recorded by officer<br \/>\nof the Saki Naka Police Station. In this back<br \/>\nground, it cannot be allowed to be urged that the<br \/>\npolice officer of Saki Naka Police Station were not<br \/>\naware that the detenue had availed of bail on<br \/>\n4.3.2002. We therefore allow this petition.\n<\/p>\n<p> 9. Petition allowed.\n<\/p>\n<p> 10. Detention order is quashed. Petitioner be<br \/>\nreleased forthwith, if not required in any other<br \/>\ncase.\n<\/p>\n<p> 11.
