Kodekar, learned<br \/>\n\tAdditional<br \/>\n\tPublic Prosecutor,  waive the service of notice of<br \/>\n\trule on behalf of the respondent No.1 and 2 &amp; 3, respectively.\n<\/p>\n<p>With<br \/>\n\tthe consent of the learned advocates appearing on behalf of the<br \/>\n\trespective parties, the matter is taken up for final hearing today.\n<\/p>\n<p>By<br \/>\n\tway of this petition under Article 226 of the Constitution of India,<br \/>\n\tthe petitioner has prayed for appropriate writ, order and\/or<br \/>\n\tdirection directing the respondents more particularly respondent<br \/>\n\tNos.1 and 2 to take adequate effective step to curb, stop  and<br \/>\n\tprevent the illegal business of slaughtering of animals going on in<br \/>\n\tthe city of Rajkot by registering criminal cases against such<br \/>\n\tpersons under relevant provisions of Prevention of Cruelty to Animal<br \/>\n\tAct, 1960 (?SPCA Act?? for short), Indian Penal Code, Bombay<br \/>\n\tProvincial and Municipal Corporation Act (?SBPMC Act?? for<br \/>\n\tconvenience)  etc. by arresting the offenders, and by closing down<br \/>\n\tillegal slaughter houses, as suggested in the notices dtd.18\/7\/2006<br \/>\n\tand 27\/7\/2007 at the earliest so as to save the lives of thousands<br \/>\n\tof innocent living creatures.\n<\/p>\n<p>It<br \/>\n\tis the contention on behalf of the petitioner that in the area of<br \/>\n\tKrushnapura situated at Khatkiwada, Rajkot several persons used to<br \/>\n\trun illegal business of selling fish and slaughter houses and at the<br \/>\n\trelevant time the respondent No.1 had issued notices under sec.373A<br \/>\n\tof the BPMC Act and the same were challenged by some persons by way<br \/>\n\tof Special Civil Application Nos.7040  and  7041  of 1990, which<br \/>\n\tcame to be dismissed by the learned Single Judge of this Court.  It<br \/>\n\tis submitted that in Rajkot City more particularly in the aforesaid<br \/>\n\tarea many illegal slaughtering houses are running without licence<br \/>\n\tand therefore, to prevent the same, representations  have been made<br \/>\n\tto the respondent No.1, but no actions have been taken. It is<br \/>\n\tfurther submitted that as such under Right to Information Act, 2005<br \/>\n\t(?SRI Act??  for short), the petitioner demanded certain important<br \/>\n\tparticulars\/documents from the Public Officer of Department of Urban<br \/>\n\tDepartment, Sachivalaya, Gandhinagar regarding illegal slaughter<br \/>\n\thouses in the Krushnapura area of Rajkot City and in response to the<br \/>\n\tsame, it was intimated to the petitioner that no policy is<br \/>\n\tformulated by the State of Gujarat for slaughter house. It is also<br \/>\n\tfurther submitted that even the petitioner made an application under<br \/>\n\tRI Act to the   respondent No.1 ?  Municipal Commissioner,<br \/>\n\tMunicipal  Corporation, Rajkot demanding explanation\/clarification<br \/>\n\tand in reply to the same, even the Corporation has also admitted<br \/>\n\tthat the slaughter house was run  illegally and the details of the<br \/>\n\toperators doing illegal activities were also supplied. It is also<br \/>\n\tsubmitted that no licences have been given  by the Corporation to<br \/>\n\trun the slaughter house. It is submitted that  it is the statutory<br \/>\n\tduty of the respondent Nos.1 and 2  to close down the illegal<br \/>\n\tslaughter house and to stop the illegal business of slaughtering.\n<\/p>\n<p>Mr.Kapadia,<br \/>\n\tlearned advocate appearing on behalf of the petitioner  has relied<br \/>\n\tupon para 72 of the decision of the Hon&#8217;ble Supreme Court in the<br \/>\n\tcase of State of Gujarat Vs. Mirza Moti  Kureshi Kasab Jamat,<br \/>\n\treported in 2006 (2) GLH 201. Submitting accordingly,<br \/>\n\tit is requested to allow the present petition.\n<\/p>\n<p>Mr.Pranav<br \/>\n\tShah, learned advocate appearing on behalf of the  respondent No.1 ?<br \/>\n\tCorporation is not in a position to dispute that slaughter houses<br \/>\n\tare running in Krushnapura Area of Rajkot City without licence. It<br \/>\n\tis also not disputed that for running the slaughter house, licence<br \/>\n\tof the Corporation is must.\n<\/p>\n<p>Having<br \/>\n\theard the learned advocate appearing on behalf of the  respective<br \/>\n\tparties and considering the facts and circumstances of the case, it<br \/>\n\tis clear that it is statutory duty of the Corporation to see that<br \/>\n\tillegal slaughter houses which are being run without licence is<br \/>\n\tstopped after following  due process of law. Any slaughter house<br \/>\n\twhich is being run without licence is illegal  and  such illegal<br \/>\n\tactivity of slaughtering is against the provisions of PCA  as well<br \/>\n\tas BPMC Act and not stopping activity of such illegal slaughter<br \/>\n\thouse  can be said to be failing in performing statutory duty by the<br \/>\n\tCorporation and\/or appropriate authorities.  Under the<br \/>\n\tcircumstances, the respondents are required to be directed to<br \/>\n\tperform their statutory duty in accordance with law.\n<\/p>\n<p>In<br \/>\n\tthe result, the petition is allowed. The respondents are directed to<br \/>\n\ttake adequate effective step to curb, stop and prevent the illegal<br \/>\n\tbusiness of slaughtering of animals going on in the city of Rajkot<br \/>\n\tin accordance with law at the earliest However, the same shall be<br \/>\n\tdone after following due process of law and principles of natural<br \/>\n\tjustice at the earliest. While taking any action if a request is<br \/>\n\tmade by the Municipal Commissioner, Municipal Corporation, Rajkot, &#8211;<br \/>\n\trespondent No.1  or its officer,  for police protection, the<br \/>\n\tCommissioner of Police, Rajkot City, Rajiot  ?  respondent No.2 is<br \/>\n\tdirected to provide sufficient police protection to them so as to<br \/>\n\tavoid disturbance of law and order and safety.
