SARAN\n                                   -----------\n<\/pre>\n<p>2\/   26\/08\/2010               No one appears for the petitioners. Learned<\/p>\n<p>                  counsel for the State is present.\n<\/p>\n<p>                              Petitioners 2 and 3 have not approached this<\/p>\n<p>                  Court with clean hands when they state at paragraph-16<\/p>\n<p>                  that they have not approached this Court earlier. The<\/p>\n<p>                  counter affidavit discloses that they have moved this<\/p>\n<p>                  Court earlier as one of the petitioners in C.W.J.C.<\/p>\n<p>                  No.14058\/09       which   was       withdrawn    to   pursue<\/p>\n<p>                  departmental remedies.\n<\/p>\n<p>                              The application is therefore dismissed in<\/p>\n<p>                  limine with regard to them.\n<\/p>\n<p>                              Insofar as petitioner No.1 is concerned, he<\/p>\n<p>                  seeks    relief   under    advertisement        No.1\/04   for<\/p>\n<p>                  appointment of Constables. He asserts that he got 14<\/p>\n<p>                  points in the physical test, but does not state that any<\/p>\n<p>                  person with lesser marks has been appointed.<br \/>\n<span class=\"hidden_text\">                         -2-<\/span><\/p>\n<p>                Mere availability of vacancies in absence of<\/p>\n<p>     any allegations of arbitrariness or discrimination does not<\/p>\n<p>     vest a right to appointment unless at least his panel<\/p>\n<p>     position has been violated.
