For the lpurpose&quot; ofeoiivenience, the parties will be\nreferred to as&quot; they are referred to in the claim petition.\n\n MVC No. 352\/ 1998 Chandrappa was a\n\nvV&#039;,--;plillion rider org\ufb01aljiagi M--80 motorcycle bearing No.KA--2&#039;7\/E~287.\n\nl ll\u00e9wwhlenphiithes_.said~rnotorcyc1e came near the garden of one Nagalur\n\n _&#039; As1l_1n&#039;di4Ranebennur road, Mahindra Maxi cab bearing\n\n  \/ 2323 driven in a rash and negligent manner by its\n\n\n\ndriver dashed against the bajaj motorcycle. On account o_f_.__the\n\naccident both the rider of the motorcycle and the pillion u\n\ndown, sustained grievous injuries, the motor-ucyc1e_l&#039;&quot;w&#039;as&quot;e&#039;\n\ncompletely damaged. Immediately the  \n\nC.G.Hospita1, Davangere. Subsequentlyliitheyihlaveibgeen \nto Shivakrupa Hospital at Hubli  \nclaimant was working as a Peon in *highEschool.\nTherefore, he preferred a  claiining.Vcompensation\n\nfor the injuries sustained.._ Ei\u00e9eniitfie e_ofi&#039;th.el&#039;i1notorcycle also\n\nhas preferred&quot;l&#039;a iifpetitionvl  compensation. The\nowner of thellmotor  a claim petition. seeking\ndamages. The owner-ofl cab did not appear before the\nCourt.  he was...placed ex parte. The 2% respondent&quot;\n\ninsi.tran;ce = contested the claim by \ufb01ling a detailed\n\n =..ob3&#039;ection  However, they did not dispute the accident\n\n_4i_i&#039;:a.o4r the insurance coverage. The Tribunal framed four issues. It\n\n&#039;~fra.i:ried. four issues in the connected two cases and clubbed\n\nV&quot; i.fallp_&quot;&#039;theil;three petitions and posted for common trial. The\n\n\n\nclaimant was examined as PW--2. He also examined PW-4..._ijr.\n\nS.M.Duggani. They produced in all 147 documents \n\nmarked as exhibits--\u00bbP1 to P147. On behalf of \n\ncompany an official of the insurance COIl1pAEi1&#039;iy&#039;WEtS exa1nined.:\ufb02s&quot;i&#039;...\n\nRW--\u00bb1. Through him exhibits--R1 and R2 xtiete\u00e9eetrked .    \n\n3. T he Tribunal on consideration --the_ aforelsairloral and\ndocumentary evidence on record l11.eld\u00bb&#039;  &#039;raccident was on\n\naccount of the rash .Vandv..neg_li;_hospital.\"T1r1e_reafter, he was on leave for 15 days.\n\nTherefore} =award  1,500\/-- on the aforesaid head is meagre\n\n ...._aVV_1;;v.d weaward  sum of Rs. 1,ESOO\/ -- on the aforesaid head.\n\n he wasia_nvin--patient, his famiiy members have attended\n\n\u00abi_'_onA__liirn_tr'avelling from their native place to the hospital. No\n\n' -Viconipensation towards conveyance, nourishment and attendant\n\n\n\n8-\n\ncharges has been awarded and therefore, we award a sum of\n\nRs.5,000\/-- under the aforesaid head.
