November 27, 2008\n\nZakir Hussain                                      ......Petitioner\n                        Versus\nState of Haryana and others                        .....Respondents<\/pre>\n<p>Coram              Hon&#8217;ble Mr. Justice Hemant Gupta<br \/>\n                   Hon&#8217;ble Mr. Justice Nawab Singh<\/p>\n<p>Present            Mr. Satish Chaudhary, Advocate<br \/>\n                   for the petitioner.\n<\/p>\n<p>Hemant Gupta , J (Oral )<\/p>\n<p>             The challenge in the present writ petition is to the<br \/>\ncommunication dated 27.10.2008 ( Annexure P1 ) whereby District Food<br \/>\nand Supplies Controller, Mewat has been directed to register a case against<br \/>\nthe petitioner under the Essential Commodities Act, 1955 for selling<br \/>\nKerosene oil to the persons other than the ration card holders and also for<br \/>\nirregularities etc. in maintenance of the Stock Registers. It was also found<br \/>\nthat ration cards were checked which contain forged entries regarding<br \/>\ndistribution of Kerosene oil from the month of August 2008 to September<br \/>\n2008.\n<\/p>\n<p>             The argument of learned counsel for the petitioner is that before<br \/>\nregistration of a FIR, the petitioner has not been given show cause notice<br \/>\nwhich is required in terms of Section 6(A) of the Essential Commodities<br \/>\nAct, 1955.\n<\/p>\n<p>             We do not find any merit in the said argument. Section 6(A) of<br \/>\nthe Act deals with confiscation of the essential commodities for violation of<br \/>\nthe provisions of the Act.
