(Scheduled Bank), Maninagar<br \/>\n\tBranch, Ahmedabad, in presence of the bailiff, for the purpose of<br \/>\n\tsettlement of Civil Suit No. 45 of 2009, filed by the complainant<br \/>\n\tbefore the City Civil Court. It is alleged by the complainant that<br \/>\n\tthe said cheque was deposited in United Co-Operative Bank Ltd. which<br \/>\n\twas returned on 30.5.2009 with an endorsement &#8220;today&#8217;s opening<br \/>\n\tbalance insufficient&#8221;. Therefore, the complainant issued<br \/>\n\tnotice to the respondent &#8211; accused throug UPC and also by<br \/>\n\tregistered A.D., however, the same was not replied by the respondent<br \/>\n\tNo.2, nor the amount was paid by him. Therefore, the complainant<br \/>\n\tfiled complaint before the learned Metropolitan Magistrate, Court<br \/>\n\tNo.6, Ahmedabad on 04.07.2009.\n<\/p>\n<p>From<br \/>\n\tthe Rojkam it appears that on the very same day verification of the<br \/>\n\tcomplaint was also made and summons was also issued to respondent<br \/>\n\tNo.2 which was made returnable on 24.8.2009. However, thereafter, as<br \/>\n\tno parties were present and no report or application was produced on<br \/>\n\trecord, vide order dated 5.1.2010, the said complaint was dismissed<br \/>\n\tfor default by the learned Magistrate.\n<\/p>\n<p>Against<br \/>\n\tthe said order dated 5.1.2010, passed by the learned  Magistrate,<br \/>\n\tthe appellant &#8211; original complainant has preferred this<br \/>\n\tAppeal.\n<\/p>\n<p>Heard<br \/>\n\tlearned Advocate Mr. Dagli, appearing on behalf of the appellant &#8211;<br \/>\n\tcomplainant and learned A.P.P. Mr. Jani, appearing on behalf of<br \/>\n\trespondent &#8211; State of Gujarat.\n<\/p>\n<p>Learned<br \/>\n\tAdvocate Mr. Dagli has contended that the complaint is filed under<br \/>\n\tSection 138 of the Negotiable Instrument Act and a huge amount is<br \/>\n\tinvolved and on the very day of complaint, verification was also<br \/>\n\tmade and summons was issued to the respondent No.2. However, as the<br \/>\n\tcomplainant or his advocate could not remain present before the<br \/>\n\ttrial Court, the learned Magistrate has dismissed the complaint  and<br \/>\n\tthe case was not heard on merit. He has contended that the<br \/>\n\tcomplainant or his learned advocate were not aware about the last<br \/>\n\ttwo dates of the case, therefore, they could not remain present<br \/>\n\tbefore the Court. Mr. Dagli has contended that the ingredients of<br \/>\n\tSection 138 of the Act is covered, yet, the learned Magistrate has<br \/>\n\tnot considered that issue. He has contended that the learned<br \/>\n\tMagistrate has not decided the mater on merit and simply dismissed<br \/>\n\tthe matter for default. He, therefore, contended that the matter may<br \/>\n\tbe remanded to the trial Court for hearing the same on merit in<br \/>\n\taccordance with law. Mr. Dagli has also placed reliance on a<br \/>\n\tdecision of learned Single Judge of Kerala High Court, reported in<br \/>\n\t2005 CRI. L.J. 3259.\n<\/p>\n<p>I<br \/>\n\thave gone through the papers as well as the Rojkam of the trial<br \/>\n\tCourt, produced before me. I have also considered the submissions<br \/>\n\tadvance by the learned Advocate. From the papers, it appears that<br \/>\n\tthe complainant has filed complaint under Section 138 of the<br \/>\n\tNegotiable Instruments Act on 04.07.2009 and then the verification<br \/>\n\twas recorded on the same day. Thereafter, the learned Magistrate has<br \/>\n\tpassed order for inquiry under Section 202 Cr. P.C., and then the<br \/>\n\tcomplainant was directed to remain present before the Court with<br \/>\n\tsufficient evidence. No doubt, in such type of matters, in past this<br \/>\n\tCourt has remanded the matters for considering the issue on merits<br \/>\n\tand in accordance with law. However, in the present case in the<br \/>\n\tcomplaint, more particularly, in Para -2, the complainant himself<br \/>\n\thas stated that pursuant to the order passed by the City Civil Court<br \/>\n\tin Civil Suit No.45 of 2009, filed in the City Civil Court,<br \/>\n\tAhmedabad, the complainant, along with bailiff, had gone to the<br \/>\n\tplace of accused for recovering the legal dues and at that time the<br \/>\n\taccused had given a cheque of Rs.18,00,000\/-. From the contents of<br \/>\n\tsaid para, prima facie, it is established that it is a case of<br \/>\n\tcheating and the complainant has rigght to file complaint against<br \/>\n\tthe accused before the appropriate court for the offence under<br \/>\n\tSection 415 of I.P. Code, but, the complaint filed in the present<br \/>\n\tcase cannot be entertained.
