Learned counsel, Mr.Brahmbhatt referred to the statements<br \/>\n\tof the witnesses and submitted that the applicant was not present at<br \/>\n\tthe time of incident and he has not played any role and, hence, he<br \/>\n\tis not involved in the commission of alleged offence. He, therefore,<br \/>\n\tsubmitted that the present application may be allowed.\n<\/p>\n<p>Learned<br \/>\n\tSpecial P.P., Mr.J.M. Panchal appearing for the State referred to<br \/>\n\tthe observations in the impugned order of the Sessions Court<br \/>\n\trejecting the bail application of the applicant-accused and<br \/>\n\tsubmitted that the complainant has made an application with regard<br \/>\n\tto threats given by the accused before the authority. He, therefore,<br \/>\n\tsubmitted that the present application may not be entertained.\n<\/p>\n<p>Having<br \/>\n\theard learned counsel, Mr.Brahmbhatt for the applicant and learned<br \/>\n\tSpecial P.P., Mr.Panchal for the State and having considered the<br \/>\n\tnature\/gravity of the offence, role attributed and also considering<br \/>\n\tthe other circumstances including the guidelines with regard to<br \/>\n\tgrant of bail, where the aspect of reasonable apprehension is<br \/>\n\trequired to be considered, the present application cannot be<br \/>\n\tentertained.\n<\/p>\n<p>Accordingly,<br \/>\n\tthe present application stands rejected.
