(J)\n\nCITATION:\n 1994 SCC  Supl.  (2) 520\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t  ORDER\n<\/p>\n<p>1.   The  appellant  who was in service of  the\t respondent-<br \/>\nManagement as a staff-car driver was dismissed from  service<br \/>\non  the allegation that he was pilfering petrol and did\t not<br \/>\nhandle\tthe  car  efficiently.\t The  Labour  Court  on\t  an<br \/>\nappreciation  of the material placed before it came  to\t the<br \/>\nconclusion  that  the  said charge  was\t not  well  founded.<br \/>\nOrdinarily, therefore, the Labour Court would have  directed<br \/>\nhis reinstatement in service on that finding of fact but  it<br \/>\ndid  not  do so on the ground that &#8216;the job of\ta  staff-car<br \/>\ndriver\tis  rather  a  job  of\tconfidence&#8217;  and  since\t the<br \/>\nmanagement   has   lost\t  confidence   in   the\t   employee,<br \/>\nreinstatement in service would not be justified.  In  taking<br \/>\nthat view the Labour Court referred to the decision of\tthis<br \/>\nCourt  in  <a href=\"\/doc\/1815159\/\">Anil Kumar Chakraborty v.  Saraswatipur  Tea\t Co.<br \/>\nLtd.1 and<\/a> other decisions on the same line.  We need not  go<br \/>\ninto the case-law on this subject because it is well settled<br \/>\nthat if it is a case of loss of confidence the discretion is<br \/>\nvested in the Court to refuse reinstatement.  This is  based<br \/>\non  the\t doctrine of confidence.  We agree with\t the  Labour<br \/>\nCourt  that since the appellant was a staff-car driver\teven<br \/>\nif his termination is quashed on the ground that allegations<br \/>\nare  not  established, that would be a\tfactor\twhich  would<br \/>\nweigh with the court since the officer occupying the  staff-<br \/>\ncar would not have confidence in the person if he is  placed<br \/>\nin  charge of that vehicle.  Therefore, we are not  inclined<br \/>\nto  agree with the learned counsel for the  appellant  that.<br \/>\nthis  was  not\ta fit case for the Labour  Court  to  refuse<br \/>\nreinstatement on the ground of loss of confidence.\n<\/p>\n<p>2.   It\t appears  that at the time when\t special  leave\t was<br \/>\ngranted this Court had made an order dated September 3, 1982<br \/>\ndirecting  payment  of subsistence allowance of Rs  400\t per<br \/>\nmonth till final orders were made in the appeal.  There\t was<br \/>\nan indication that adjustment of this payment may be made at<br \/>\nthe hearing of the appeal.  It is, however, an admitted fact<br \/>\nthat  the  compensation of Rs 25,000 awarded by\t the  Labour<br \/>\nCourt  was  not\t paid  and that\t amount\t remained  with\t the<br \/>\nmanagement.  It is equally true that the appellant  received<br \/>\nsubsistence  allowance under the court orders.\tIf one\twere<br \/>\nto  calculate  the interest on the compensation\t amount\t and<br \/>\nadjust\tthe same with the subsistence allowance, the  figure<br \/>\nof  subsistence\t allowance actually  received  would  shrink<br \/>\nconsiderably.  The question then is whether the amount which<br \/>\nwas  received by way of subsistence allowance is  sufficient<br \/>\nto take care of the falling value of the rupee over a<br \/>\n1  (1982) 2 SCC 328: 1982 SCC (L&amp;S) 249<br \/>\n<span class=\"hidden_text\">522<\/span><br \/>\nperiod\tof time.  Balancing these factors, the amount of  Rs<br \/>\n25,000 awarded by the Labour Court needs to be increased  to<br \/>\nRs 40,000 having regard to the fall in the rupee value.\t  We<br \/>\ndirect that this amount may be paid within three months from<br \/>\ntoday failing which thereafter it will carry interest at 15%<br \/>\nper  annum.
