No.26\/2005 &amp; allied<br \/>\nmatters dated 09.01.2006, which reads as under;\n<\/p>\n<p>&#8220;1.\tThis<br \/>\nset of appeals came to be admitted by order dated 8th<br \/>\nFebruary, 2005 and were ordered to be fixed for final hearing on 27th<br \/>\nApril, 2005.  However, the final hearing has taken place today.\n<\/p>\n<p>2.\tIn<br \/>\nthis set of Appeals from Order, the appellant is original defendant<br \/>\nNo.3 in various suits preferred by respondent No.1 against the<br \/>\nappellant and rest of the respondents for damages in respect of<br \/>\ncollapse of building in earthquake, which was developed by a firm,<br \/>\nJay Associates, of which the present appellant was one of the<br \/>\npartners.\n<\/p>\n<p>3.\tAn<br \/>\ninjunction was sought against the defendants, particularly defendant<br \/>\nNo.3-present appellant, restraining him from transferring or<br \/>\nalienating the properties indicated in paragraph 5 of the application<br \/>\nfor Notice of Motion, which includes three properties stated as under<br \/>\n:-\n<\/p>\n<p>(1)\t&#8216;Jay<br \/>\nIndustries&#8217; with its office, factory building and office furniture<br \/>\nat Soni&#8217;s Chawl, Beside Chemical factory, Near Old Tolnaka, Rakhial,<br \/>\nAhmedabad.\n<\/p>\n<p>(2)\t&#8216;Jay<br \/>\nIndustries&#8217;, a factory manufacturing water pumps, situate at Rajkamal<br \/>\nEstate, Soni&#8217;s Chawl, Beside Chemical factory, Near Old Tolnaka,<br \/>\nRakhial, Ahmedabad.\n<\/p>\n<p>(3)\t&#8216;Jay<br \/>\nHouse&#8217;, a building located at Rambaug, Maninagar, Ahmedabad.\n<\/p>\n<p>The<br \/>\ninjunction was sought only with a view to ensure that the decree that<br \/>\nmay be passed does not get frustrated, if the properties are<br \/>\ntransferred by the defendants.\n<\/p>\n<p>4.\tThe<br \/>\ndefendants in the Trial Court chose not to contest the Notices of<br \/>\nMotion except the present appellant, who filed written statement to<br \/>\nthe plaint and reply to the application specifically contending that<br \/>\nhe owns a property in Jaihind Society, which he does not intend to<br \/>\ntransfer to anyone.  His case is that, he is a partner of Jay<br \/>\nIndustries engaged in the manufacture of tools, but he has no<br \/>\nconnection whatsoever with Jay Industries engaged in manufacture of<br \/>\nwater pumps and the property described as Jay House, located at<br \/>\nManinagar and, therefore, no such injunction could be sought by the<br \/>\nplaintiff in respect of these two properties.\n<\/p>\n<p>5.\tThe<br \/>\nTrial Court, after hearing both the sides, passed the impugned orders<br \/>\non 15th September, 2003, allowing the  Notices of Motion<br \/>\nand confirming the ad-interim injunction granted earlier in terms of<br \/>\nparagraph 7(a) and (c).\n<\/p>\n<p>6.\tLearned<br \/>\nAdvocate, Mr. Patel, for the appellant submitted that the appellant<br \/>\nhas no objection so far as the grant of prayer at paragraph 7(a) is<br \/>\nconcerned.  He submitted that, so far as the relief at paragraph 7(c)<br \/>\nis concerned, the appellant is aggrieved for the reason that Jay<br \/>\nIndustries engaged in manufacture of tools is a firm of which the<br \/>\nappellant is only one of the partners.  That firm has nothing to do<br \/>\nwith the development of the building which collapsed in the<br \/>\nearthquake and the properties of that firm cannot be restrained from<br \/>\nbeing dealt with only on this count because the suit is for damages,<br \/>\na decree is yet to be passed and, if it is passed, only the share of<br \/>\nthe appellant in that firm can be attached for execution of the<br \/>\ndecree. So far as the other firm manufacturing water pumps and the<br \/>\nproperty called Jay House are concerned, the appellant has no<br \/>\nconnection whatsoever and, therefore, the relief could not have been<br \/>\ngranted against those properties.\n<\/p>\n<p>7.\tLearned<br \/>\nAdvocate, Mr. Baxi, submitted that the appellant was the developer of<br \/>\nthe building which collapsed in the earthquake and he is trying to<br \/>\nconfuse the issue by showing his involvement or non-involvement in<br \/>\nJay Industries and Jay House, which is not relevant at  all.  Mr.<br \/>\nBaxi submitted that, if the properties are permitted to be dealt<br \/>\nwith, all that the plaintiffs would be getting is a paper decree and<br \/>\nwith a view to protect the interest of the plaintiffs, the orders are<br \/>\npassed.  He submitted that, this Court may not, therefore, interfere<br \/>\nwith the orders.\n<\/p>\n<p>8.\tThis<br \/>\nCourt has taken into consideration rival side contentions.  When the<br \/>\nplaintiffs approached the Court seeking a particular relief, the onus<br \/>\nwas upon them to establish the case in their favour and to establish<br \/>\nthat defendant, No.3-appellant herein,  has interest in the<br \/>\nproperties in respect of which injunction is sought.  The<br \/>\nappellant-original defendant No.3 has come with a specific case that<br \/>\nhe has no interest in the property known as Jay House or Jay<br \/>\nIndustries manufacturing water pumps.  Even, thereafter, no steps<br \/>\nwere taken by the plaintiff to bring on record any material to show<br \/>\nthat defendant No.3 is interested in that firm or property and, in<br \/>\nabsence of any material showing any interest of defendant No.3 either<br \/>\nin the firm or in the property, the orders could not have been passed<br \/>\nby the Trial Court.  The orders to that extent, therefore, stands<br \/>\nvitiated and cannot be permitted to stand.\n<\/p>\n<p>9.\tSo<br \/>\nfar as the orders in respect of Jay Industries engaged in manufacture<br \/>\nof tools is concerned, it is the case of the appellant that he is one<br \/>\nof the partners of the firm.  Undisputedly, that firm has nothing to<br \/>\ndo with the development and\/or construction of the building which<br \/>\ncollapsed in the earthquake.  The developer was Jay Associates in<br \/>\nwhich the appellant was again one of the partners.  Injunction<br \/>\nagainst defendant No.3 in respect of a firm which has nothing to do<br \/>\nwith the development of the building and a firm of which he is only<br \/>\none of the partners, in absence of any order against rest of the<br \/>\npartners of that firm or in absence of any order against the firm<br \/>\nitself would be of no virtue.  The decree for damages is yet to be<br \/>\npassed and transactions of a firm, which has no nexus with the<br \/>\ndevelopment or construction of the building, cannot be permitted to<br \/>\nbe affected in this manner only because there is a common partner in<br \/>\nthe two firms and, therefore, to that extent also, the injunction<br \/>\norder could not have been passed.  The order, therefore, is not<br \/>\nsustainable.\n<\/p>\n<p>10.\tFor<br \/>\nthe foregoing reasons, the appeals deserve to be allowed the the same<br \/>\nare allowed.  The orders passed by the Trial Court, which are<br \/>\nimpugned in these appeals, are hereby set aside.  It is, however,<br \/>\nclarified that the appellant shall stand bound by his averment in the<br \/>\nwritten statement that he does not intend to transfer the property<br \/>\nlocated at Plots No.9 and 9-A, Jaihind Society, admeasuring 667 sq.<br \/>\nyards till the final disposal of the suits.  No costs.\n<\/p>\n<p>11.\tAt<br \/>\nthis stage, a request is made by learned Advocate, Mr. Baxi, to<br \/>\nsuspend the operation of this order for a period of four weeks, as<br \/>\nthe injunction granted by the Trial Court is operating till today to<br \/>\nenable the respondents-original plaintiffs to approach the higher<br \/>\nforum.  Learned Advocate, Mr. Patel, has no objection.  The operation<br \/>\nof the order passed today stands suspended for a period of four<br \/>\nweeks, i.e. upto 9th February, 2006.&#8221;\n<\/p>\n<p>2.\tSince<br \/>\nthe present appeal from order is similarly situated, it stands<br \/>\ndisposed of in terms of the above order.
