Mohamed Idrees    \t\t\t\t..Respondents\n\n\n\n\nPrayer:   This  revision petition has been  preferred  under\nArticle  227 of the Constitution of India against the  order\ndated  19.4.2007 made in O.A.No.11\/2005 on the file  of  The\nTamil Nadu Wakf Appellate Tribunal      ( I Assistant Judge,\nCity Civil Court) at Chennai.\n\n\n\n\n      For Petitioners   : Mr.B.Kumar, Senior Counsel for Mr.J.Nandagopal\n\n      For Respondents   : Mr.Siraj  (for R1 to R3)\n                          Mr.J.Jaseem Mohamed (for R5 to R8)\n                              \n\n\n                                 ORDER\n<\/pre>\n<p>      The  Wakf Board in its order dated 28.9.2005 has taken<\/p>\n<p>over  the management of the Wakf under question for a period<\/p>\n<p>of  six  months from 28.9.2005 from the President and  other<\/p>\n<p>Office bearers and the secretary, who was a managing trustee<\/p>\n<p>as  per  the trust deed.  An application has been  preferred<\/p>\n<p>against  the  said  order  of  the  Wakf  Board  before  the<\/p>\n<p>appellate Authority\/Tribunal (I Assistant Judge, City  Civil<\/p>\n<p>Court, Chennai) in O.A.No.11 of 2005.  The learned appellate<\/p>\n<p>Authority\/Tribunal  had confirmed the order  passed  by  the<\/p>\n<p>Wakf Board, which has necessitated this revision.<\/p>\n<p>      2.The learned Senior Counsel Mr.Kumar appearing of the<\/p>\n<p>revision  petitioners would challenge the impugned order  of<\/p>\n<p>the Wakf Board dated 28.9.2005 on the ground that only under<\/p>\n<p>two  circumstances, the order under Section 65 of  the  Wakf<\/p>\n<p>Act  can  be passed and those two circumstances are  (1)  If<\/p>\n<p>suitable  person  is  not  available  to  be  appointed   as<\/p>\n<p>Muthavali   (2)  If  the appointment of  the  Muthavali  was<\/p>\n<p>prejudicial to the interest of the Wakf, and that  there  is<\/p>\n<p>absolutely no material on record to show that the above said<\/p>\n<p>two  requirements  under Section 65 of  the  Act  have  been<\/p>\n<p>complied  with warranting an order under Section 65  of  the<\/p>\n<p>Act.   The learned Senior Counsel would also point out  that<\/p>\n<p>the said order was passed mainly on the ground of allegation<\/p>\n<p>and counter allegation against the nine Muthavalies.  It has<\/p>\n<p>further been observed in the impugned order that the Wakf in<\/p>\n<p>question was not properly maintained by the trustees.   Only<\/p>\n<p>on  that ground the management of the Wakf was taken away by<\/p>\n<p>the Wakf Board under the impugned order for six months.  Now<\/p>\n<p>it is fairly admitted by the learned Senior Counsel that six<\/p>\n<p>months  period  stipulated  under  the  impugned  order  has<\/p>\n<p>already  been expired by the end of March-2006  and  nothing<\/p>\n<p>survives in this revision.\n<\/p>\n<\/p>\n<p>      3.The learned counsel for the Wakf Board Mr.Sirajudeen<\/p>\n<p>would  contend that the paramount importance is the  welfare<\/p>\n<p>of the Wakf and that some arrangements shall be made by this<\/p>\n<p>Court for the proper functioning of the  Wakf.  If the  Wakf<\/p>\n<p>Board has got any grievance against the running of the Wakf,<\/p>\n<p>the  remedy  open  to  them  is  to  follow  the  provisions<\/p>\n<p>contemplated under Section 64 to 67 of the Wakf Act.<\/p>\n<p>      4.At  this juncture the learned counsel appearing  for<\/p>\n<p>the  respondents  4 to 8 would focus the attention  of  this<\/p>\n<p>Court  to  the  order  passed  in  WP.No.40100  of  2005   &amp;<\/p>\n<p>WPMP.No.42995 of 2005 that the petitioner &#8211; K.M.Basheer, who<\/p>\n<p>had  challenged  the impugned order before this  Court,  was<\/p>\n<p>directed to approach the Tribunal.  The said order was  also<\/p>\n<p>confirmed  by the Division Bench of this Court in  WA.No.341<\/p>\n<p>of  2006  dated 17.3.2006.  But the Division Bench  had  set<\/p>\n<p>aside  the  imposition  of costs on the  petitioner  by  the<\/p>\n<p>learned Single Judge. Now, as correctly represented  by  the<\/p>\n<p>learned  Senior Counsel, there is nothing survives  in  this<\/p>\n<p>Civil Revision Petition since the impugned order of the Wakf<\/p>\n<p>Board itself has expired and the same is not in force as  on<\/p>\n<p>today.\n<\/p>\n<\/p>\n<p>      5.The  learned  counsel for the Wakf Board  represents<\/p>\n<p>that  Wakf  Board  may be given liberty to take  appropriate<\/p>\n<p>action against the Wakf.   Under the provisions of Wakf Act,<\/p>\n<p>the  Wakf Board has been empowered with necessary power  and<\/p>\n<p>the  Wakf  Board can take appropriate action as contemplated<\/p>\n<p>under  the  provisions of Wakf Act within four  months  from<\/p>\n<p>today,  if  the  mismanagement of the Wakf by  the  Managing<\/p>\n<p>trustee found continued.\n<\/p>\n<\/p>\n<p>      6.It  is further represented on behalf of the revision<\/p>\n<p>petitioners  that  even  after  the  expiry  of  the  period<\/p>\n<p>stipulated under the impugned order, the Wakf Board has  not<\/p>\n<p>handed  over the management to the trustees.  If it  is  so,<\/p>\n<p>the  Wakf  Board  has  to  entrust  the  management  to  the<\/p>\n<p>President,  who  in  turn will hand over  the  same  to  the<\/p>\n<p>Managing  Trustee.  The learned counsel for the  Wakf  Board<\/p>\n<p>requests  a  weeks  time to hand over  the  management.  His<\/p>\n<p>request is acceded.\n<\/p>\n<\/p>\n<p>       With  the  above  observation,  this  civil  Revision<\/p>\n<p>Petition  is  disposed of. No costs.
