1.\t\tOne Smt.Pushpaben
\nManubhai Vaniya is before this Court being aggrieved by an order
\npassed by respondent No.2 – Shri M.V.Joshi or his successor in
\nhis office of Designated Authority and Settlement Commissioner and
\nDirector, Land Records, State Government dated 07.02.2011, a copy of
\nwhich is produced at Annexure-C, page No.60.\n<\/p>\n
2.\t\tLearned Advocate
\nMr.U.A.Trivedi for the petitioner vehemently submitted that the
\nauthority has committed an error in not answering the contention
\nraised by the petitioner that, ‘whip in question was not issued by
\nthe authority recognized for the purpose’.  In this regard, he relied
\nupon Clause-(b) of sub-section (1) of Section 3 of the Act, i.e.
\nGujarat Provision for Disqualification of Members of Local Authority
\nfor Defection Act, 1986.\n<\/p>\n
3.\t\tThe very name of the
\nAct suggests that it is for the purpose of curbing the indiscipline
\nprevailing in the elected members of all the parties.  The very
\nobject of the Act will be frustrated if the matters are decided on
\nsuch technical grounds.\n<\/p>\n
3.1\t\tThe facts of the
\ncase which are not in dispute are that a whip was issued by the
\nDistrict President of the Congress Committee.  This whip was received
\nby all other elected members and except the petitioner herein,
\neverybody obeyed the whip.  Taking a plea in the nature of splitting
\nhair and submit that whip is not issued by the competent authority of
\nthe party should have been brought to the notice of the party office
\nbearers so that if found substance in that, they could have condoned
\nthe lapse on the part of the petitioner.  But, that is not done.\n<\/p>\n
4.\t\tLearned Advocate for
\nthe petitioner submitted that the reference to Rule-10 of 1987 Rules
\nby the Designated Authority is not warranted.\n<\/p>\n
5.\t\tThe  said  Rule  is
\nmade  only  with  a  view to  take  further, the  object of the Act.
\nBy that Rule, an obligation is cast on an elected member to ascertain
\nthe  whip and if required, also ascertain the legality and validity
\nof such whip.  The petitioner has chosen not to undertake that
\nexercise, though she very well knew that whip is issued.  It is only
\nan afterthought that a defence is taken to the effect that the whip
\nis not issued by the competent authority of the party.\n<\/p>\n
6.\t\tLearned Advocate for
\nthe petitioner relied upon a decision of the Hon’ble the Apex Court
\nin the matter of Sadashiv H.Patil etc. Vs. Vithal D.Teke &
\nOrs., reported in AIR 2000 S.C. 3044.  He invited
\nattention of the Court to paras-13 and 14 of the judgment and
\nsubmitted that the provisions are para-materia.  Paras-13 and 14 of
\nthe judgment are reproduced for ready perusal:-\n<\/p>\n
“13.\tA finding
\nas\tto disqualification under the Act  has the effect of unseating a
\nperson from an elected office held by him  pursuant to his victory at
\nthe polls in accordance with democratic procedure of constituting a
\nlocal authority.  The consequences befall not only him as an
\nindividual but also the constituency represented by him which would
\ncease to be represented on account of his having been disqualified.
\nLooking at the penal consequences flowing from an elected Councillor
\nbeing  subjected to disqualification and its repercussion on  the
\nfunctioning of the local body as\talso the city or township governed
\nby  the  local  body the provisions  have to  be  construed
\nstrictly.  A rigorous compliance with the provisions of the Act and
\nthe Rules must be shown to have taken place while dealing with a
\nreference under Section 7 of the Act.\n<\/p>\n
14.\tIn Civil Appeal
\nNos.6266-6268\/98 no rules or regulations of Janta  Aghadi are shown
\nto have been filed with the Collector.  The record does not show that
\nany such rules or regulations exist.  Had they been there an effort
\ncould have been made to find out authorisation to issue whip having
\nbeen provided therein.  During the course of hearing we asked the
\nlearned counsel for the appellant to show any resolution of Janta
\nAghadi authorising the signatories  of the  whip  to issue the whip.
\nNo such resolution was  filed before the Collector or the High Court
\nand not even shown to us.  The contents  of the whip do not
\nalso\tcontain any recital spelling out the existence of any such
\nauthorisation which also goes to show that there was no such
\nauthorisation given.  In the absence of proof of the signatories of
\nthe whip having been authorised by the Janta Aghadi to issue the whip
\nthe violation\tthereof would not attract the applicability of Section
\n3(1)(b) of the Act.\tMay be that the  party,  Aghadi  or front had
\nresolved  to  sponsor  a particular  persons  candidature at the
\nelection.  Acting contrary  to such resolution, howsoever strongly
\nworded, may render its member liable to disciplinary proceedings at
\nthe party  level.  But to incur disqualification under the Act there
\nmust be a direction issued and such direction must be either by the
\nparty, Aghadi or front to which the Councillor proceeded  against
\nbelongs or be by any person or authority authorised in this  behalf.
\nMere resolution is not a substitute  for direction.  On this single
\nground alone the judgment of the High Court deserves to be
\nmaintained.\n<\/p>\n
7.\t\tThe Court is not
\nable to accept the contention raised by the learned Advocate for the
\npetitioner for the simple reason that the petitioner has not
\napproached this Court with clean hands.  If at all the petitioner was
\nacting in a bonafide, the moment she learnt about whip, she should
\nhave inquired about the same and she should have ascertain the
\nthings.\n<\/p>\n
8.\t\tIn the result, the
\npetition fails and the same is dismissed.\n<\/p>\n
