No.3742 of 2011\n                                 OM PRAKASH YADAV\n                                           Versus\n                                THE STATE OF BIHAR\n                                         -----------\n<\/pre>\n<p>3   23.03.2011            Heard learned counsel for the petitioner as well as<\/p>\n<p>                 learned counsel for the state.\n<\/p>\n<p>                          Petitioner   is   languishing   in   jail   custody   since<\/p>\n<p>                 03.05.2010 in connection with Thakraha P.S. Case No. 22 of<\/p>\n<p>                 2010 registered under section-376 and other minor sections of<\/p>\n<p>                 the Indian Penal Code as well as various provisions of SC &amp; ST<\/p>\n<p>                 (Prevention of Atrocities) Act.\n<\/p>\n<p>                          The informant has stated in her fardbeyan that on<\/p>\n<p>                 03.04.2010 , the petitioner entered her house and committed<\/p>\n<p>                 rape on her but in course of investigation, at Paragraph-3, she<\/p>\n<p>                 stated that there was physical relationship with petitioner since<\/p>\n<p>                 last one year and on account of aforesaid physical relationship,<\/p>\n<p>                 she became pregnant and when she disclosed the aforesaid<\/p>\n<p>                 fact to the petitioner, the petitioner gave a medicine for her<\/p>\n<p>                 abortion. The informant further stated in her further statement<\/p>\n<p>                 that she, herself consumed the aforesaid medicine as a result<\/p>\n<p>                 of which, miscarriage was done and thereafter she disclosed<\/p>\n<p>                 the above-said fact to her parent resulting the institution of the<\/p>\n<p>                 instant case.\n<\/p>\n<p>                          Learned counsel for the petitioner points out that the<\/p>\n<p>                 above-said statement of informant clearly suggests this fact that<br \/>\n<span class=\"hidden_text\">                             -2-<\/span><\/p>\n<p>        she was consenting party and at the time of above-said<\/p>\n<p>        occurrence, she was major as is evident from perusal of report<\/p>\n<p>        of Medical Board.\n<\/p>\n<p>                 Although learned counsel for the state opposes the<\/p>\n<p>        prayer for bail but he fairly conceded this fact that the informant<\/p>\n<p>        has completely given a go-by to her previous statement in the<\/p>\n<p>        statement recorded in course of investigation.<\/p>\n<p>                 Considering the aforesaid facts and circumstances as<\/p>\n<p>        well as materials available in the case diary, let   the petitioner,<\/p>\n<p>        namely, Om Prakash Yadav be released on bail on furnishing<\/p>\n<p>        bail bond of Rs 10,000\/- (ten thousand) with two sureties of the<\/p>\n<p>        like amount each in connection with Thakraha P.S.
