SIRI JAGAN, J.\n                  - - - - - - - - - - - - - - - - - - - - - - -\n                     W.P.(C)No. 18356 of 2010\n                  - - - - - - - - - - - - - - - - - - - - - - -\n               Dated this the 26th day of July, 2010\n\n                            J U D G M E N T\n<\/pre>\n<p>     The petitioner lost his S.S.L.C. book.                    He wanted a<\/p>\n<p>duplicate S.S.L.C. Book. He applied for the same. He has<\/p>\n<p>not been favoured with one. Therefore he had filed this writ<\/p>\n<p>petition seeking the following reliefs:<\/p>\n<blockquote><p>     &#8220;[a]   Issue a writ in the nature of mandamus or any other<br \/>\n            appropriate writ, direction or order commanding the<br \/>\n            respondent to issue a duplicate S.S.L.C. Book to the<br \/>\n            petitioner pursuant to Ext.P3 application submitted by<br \/>\n            him and on the basis of Exts.P4 to P7 documents.&#8221;<\/p><\/blockquote>\n<p>     2.     A statement has been filed by the Government<\/p>\n<p>Pleader wherein it is stated thus:\n<\/p>\n<blockquote><p>            &#8220;2.   The petitioner holder of SSLC with Register<br \/>\n     No.306089 of March 1982 was an applicant for the duplicate<br \/>\n     SSLC as per application No.Ex-J5\/68449\/2009.              As per the<br \/>\n     existing rules every applicant who apply in duplicate copy of<br \/>\n     the SSLC should produce the following documents, failing<br \/>\n     which the application will be treated as incomplete and hence<br \/>\n     liable to be rejected. The required documents are<\/p>\n<\/blockquote>\n<blockquote><p>            1.    Application duly filed up by the candidate in the<br \/>\n                  prescribed format&#8217;<\/p>\n<\/blockquote>\n<blockquote><p>            2.    Original chalan receipt (for Rs.200\/- for duplicate,<br \/>\n                  Rs.500\/- for triplicate) remitted in the name of<br \/>\n                  applicant in a Government treasury of the Kerala<br \/>\n                  State<\/p>\n<p>W.P.(C)No. 18356 of 2010<br \/>\n<span class=\"hidden_text\">                                       -2-<\/span><\/p>\n<\/blockquote>\n<blockquote><p>             3.    Declaration in the stamped paper of the candidate,<br \/>\n                   attested by a 1st Class Magistrate of the Judicial<br \/>\n                   Department under the seal of his Court&#8217;<\/p>\n<\/blockquote>\n<blockquote><p>             4.    If the original certificate is damaged the remnants<br \/>\n                   of the certificate is to be enclosed.\n<\/p><\/blockquote>\n<blockquote><p>             5.    The prescribed notice (specimen copy attached<br \/>\n                   with the application form) to be published in any<br \/>\n                   daily newspapers approved by Public Relations<br \/>\n                   Department for obtaining the duplicate SSLC.\n<\/p><\/blockquote>\n<blockquote><p>             6.    The application should be duly signed by applicant<br \/>\n                   and     duly   signed    and    forwarded      by    the<br \/>\n                   Headmaster\/Principal of the school, from which the<br \/>\n                   applicant has presented to the SSLC Examination<br \/>\n                   first time.\n<\/p><\/blockquote>\n<blockquote><p>             3.     In the case of the petitioner, his application was<br \/>\n       incomplete in the sense that he has not submitted the<br \/>\n       prescribed press notice as required in Sl.No.5 above. Hence<br \/>\n       his application was rejected and he was directed to resubmit<br \/>\n       the application, after rectifying the defects noted vide this<br \/>\n       office letter No.J5\/68449\/2009\/N.Dis dated 10.12.2009.            At<br \/>\n       present no application of the petitioner is pending in this office.<br \/>\n       If the petitioner submit the application in full shape the<br \/>\n       respondent can issue the duplicate certificate within a<br \/>\n       reasonable period of time&#8217;. It is further submitted that, since<br \/>\n       the application is disposed as &#8216;N.Dis&#8217; no file is kept in the office.<br \/>\n       The application itself was retained with endorsement to cure<br \/>\n       the defect and it was recorded in the Personal Register of the<br \/>\n       concerned Clerk.     Therefore the respondent is not able to<br \/>\n       produce the communication referred above.&#8221;<\/p><\/blockquote>\n<p>      3.     The petitioner submits that the petitioner has<\/p>\n<p>already complied with all the requirements stated in the<\/p>\n<p>statement. Apparently the dispute is as to compliance with<\/p>\n<p>condition No.5. The Government Pleader would take the<\/p>\n<p>contention that the petitioner has not published a notice as<\/p>\n<p>W.P.(C)No. 18356 of 2010<br \/>\n<span class=\"hidden_text\">                                      -3-<\/span><\/p>\n<p>per the specimen copy attached with the application form.<\/p>\n<p>The petitioner would rely on Ext.P3 application form and<\/p>\n<p>Ext.P4 paper publication made by him to show that he has<\/p>\n<p>actually complied with that requirement also. Therefore I<\/p>\n<p>passed an order on 19.07.2010 as follows:<\/p>\n<blockquote><p>      &#8220;Learned counsel for the petitioner points out that the only<br \/>\n      defect in the application for duplicate SSLC book filed by the<br \/>\n      petitioner, noted as per the statement filed by the Government<br \/>\n      Pleader is that the prescribed notice has not been published in<br \/>\n      the news papers as per the specimen copy attached with the<br \/>\n      application form. According to him, there is no such defect at<br \/>\n      all as is clear from Exts.P3 and P4. He points out that the<br \/>\n      specimen advertisement is given at the bottom of Exts.P3 and<br \/>\n      P4 advertisement made by the petitioner is in terms of that<br \/>\n      specimen only. On a comparison of Exts.P3 and P4 although<br \/>\n      there is some minor changes in words, substantially both<br \/>\n      appears to be identical. The learned Government Pleader seeks<br \/>\n      time to get instructions on the same.&#8221;<\/p><\/blockquote>\n<p>      4.     I have heard the learned Government Pleader also<\/p>\n<p>today. The learned Government Pleader could not satisfy<\/p>\n<p>me that Ext.P4 publication in the newspaper is not in<\/p>\n<p>accordance with the specimen form prescribed in Ext.P3.<\/p>\n<p>Therefore I am satisfied that the petitioner has complied<\/p>\n<p>with all the requirements for obtaining a duplicate S.S.L.C.<\/p>\n<p>Book.     Accordingly this writ petition is allowed and the<\/p>\n<p>respondent is directed to issue a duplicate S.S.L.C. Book to<\/p>\n<p>W.P.(C)No. 18356 of 2010<br \/>\n<span class=\"hidden_text\">                            -4-<\/span><\/p>\n<p>the petitioner as expeditiously as possible, at any rate<\/p>\n<p>within a period of two weeks from the date of receipt of a<\/p>\n<p>copy of this judgment.\n<\/p>\n<\/p>\n<p>                                           S.
