This order shall dispose of C.W.P. Nos. 13121 of 1998<\/p>\n<p>and 1140 of 1997. However, the facts are referred from C.W.P. No.<\/p>\n<p>13121 of 1998. This petition was filed in the year 1998 with a prayer<\/p>\n<p>for issuance of mandamus to the respondents directing them to<\/p>\n<p>remove encroachments from the common purposes land such as<\/p>\n<p>parks, roads, vacant sites for public goods and stopping the pollution<\/p>\n<p>of the water and environment in the area of Mata Rani Mandir,<\/p>\n<p>Phagwara. Similar prayer has been made in the connected petition<\/p>\n<p>and directions have been sought for implementation of the<\/p>\n<p>development scheme dated 20.8.1969 by taking possession of the<\/p>\n<p>land of Municipal Committee, Phagwara, meant for common<\/p>\n<p>purposes including parks and roads from al unauthorised persons.<\/p>\n<p>2.          After issuance of notice of motion various orders have<\/p>\n<p>been passed to ensure that all unauthorised construction and<\/p>\n<p>encroachments are removed. On 2.6.1999, learned counsel for the<\/p>\n<p>Municipal Committee, Phagwara, had stated that proceedings were<\/p>\n<p>already initiated for removal of encroachments by issuing notices to<\/p>\n<p>the      persons       who        had        made        unauthorised<\/p>\n<p>constructions\/encroachments.    On 25.1.2000, the Division Bench<\/p>\n<p>noticed existence of large scale encroachments and the efforts being<\/p>\n<p>made by the respondent Municipal Committee to regularise those<\/p>\n<p>encroachments. Some industrial units operating within the residential<\/p>\n<p>area in the Town Planning Scheme No. 5 Part-II were also subjected<br \/>\n<span class=\"hidden_text\"> C.W.P. No. 13121 of 1998                                          3<\/span><\/p>\n<p>to certain orders and assurance was given by the respondent<\/p>\n<p>Municipal Committee that steps would be taken for removal of<\/p>\n<p>encroachments from public roads and parks, as is evident from order<\/p>\n<p>dated 19.10.2000. It would be appropriate to take notice of the order<\/p>\n<p>dated 5.3.2001. The Bench while refusing to record any conclusive<\/p>\n<p>finding on the status of the existing constructions was fully convinced<\/p>\n<p>that it was in public interest to direct that no transfer of the land<\/p>\n<p>earmarked for public parks should be permitted and action should be<\/p>\n<p>taken by the Municipal Council for removing the encroachments from<\/p>\n<p>public roads and parks.     It restrained that no transfer deed for<\/p>\n<p>alienation of the land forming part of public parks be registered by<\/p>\n<p>the concerned authorities of the State. The District Administration<\/p>\n<p>was also directed to help the Municipal Council to carry out the task<\/p>\n<p>of removing encroachments from public roads and parks. The Bench<\/p>\n<p>also directed the Courts at Phagwara and Kapurthala to expeditiously<\/p>\n<p>dispose of the pending cases involving encroachments on public<\/p>\n<p>roads and parks and issued direction to them not to grant ad interim<\/p>\n<p>injunctions without giving notice to the Municipal Council.           A<\/p>\n<p>detailed status report with regard to removal of encroachments from<\/p>\n<p>public roads and parks was to be filed by the Municipal Council,<\/p>\n<p>Phagwara.    Thereafter, some applications under Order I Rule 10<\/p>\n<p>C.P.C. were moved for becoming parties, which were allowed on<\/p>\n<p>22.5.2001. The demolition of constructed houses and other buildings<\/p>\n<p>was stayed on 10.5.2001 but it was not to include removal of<\/p>\n<p>encroachments existing on the roads.\n<\/p>\n<p><span class=\"hidden_text\"> C.W.P. No. 13121 of 1998                                         4<\/span><\/p>\n<p>3.          The petition was admitted on 19.7.2001. However, the<\/p>\n<p>matter was again taken up by the Division Bench and the order dated<\/p>\n<p>19.7.2001 admitting the petition was recalled on 22.3.2007.       The<\/p>\n<p>Deputy Commissioner, Kapurthala, appeared before the Court and<\/p>\n<p>made various suggestions which are evident from the perusal of order<\/p>\n<p>dated 13.7.2007, which reads thus:-\n<\/p>\n<blockquote><p>            &#8221;     i)     that open spaces\/parks should be maintained<\/p>\n<p>            by Municipal Council, Phagwara by fencing up the<\/p>\n<p>            existing park area and by maintaining them.<\/p>\n<blockquote><p>                  ii)    Municipal     Council,   Phagwara     should<\/p>\n<p>            retrieve some of the encroached\/deviated area in Parks<\/p>\n<p>            P3 and P4.\n<\/p><\/blockquote>\n<blockquote><p>                  iii)   Municipal Council, Phagwara can acquire<\/p>\n<p>            an area of 33275 Sq. feet (being deficient park area)<\/p>\n<p>            from the private owners of existing open spaces, in<\/p>\n<p>            accordance with the provisions of the law governing the<\/p>\n<p>            T.P. Scheme under Punjab Municipal Act, 1911.<\/p>\n<\/blockquote>\n<blockquote><p>                  iv)    Municipal     Council,   Phagwara     should<\/p>\n<p>            remove the encroachments of 4237.5 Sq. feet caused by<\/p>\n<p>            projections and 555 Sq. feet caused by footsteps\/ramps<\/p>\n<p>            from residential houses.\n<\/p><\/blockquote>\n<blockquote><p>                  v)     24 factory units operating in the area, which<\/p>\n<p>            are non polluting nature may be allowed to continue in<\/p>\n<p>            the area and M\/s Bhalla Ball Bearings and other<br \/>\n<span class=\"hidden_text\"> C.W.P. No. 13121 of 1998                                             5<\/span><\/p>\n<p>            industries which are causing pollution, may be permitted<\/p>\n<p>            to shift their unit from this area within six months.<\/p>\n<\/blockquote>\n<blockquote><p>                     vi)   Municipal    Council,    Phagwara        should<\/p>\n<p>            complete the rest of the formalities under the T.P.<\/p>\n<p>            Scheme as required by the Punjab Municipal Act, 1911<\/p>\n<p>            and protect and maintain the existing parks\/open spaces,<\/p>\n<p>            roads.\n<\/p><\/blockquote>\n<blockquote><p>                     Affidavit for implementing       the scheme by<\/p>\n<p>            Municipal Council, Phagwara shall be filed within four<\/p>\n<p>            weeks. Copy of the same be given to the counsel for the<\/p>\n<p>            other parties and objections\/observations, if any, be<\/p>\n<p>            made by them on the next date of hearing.<\/p>\n<\/blockquote>\n<blockquote><p>                     Mr. Sandhawalia, Advocate who is present on<\/p>\n<p>            behalf of M\/s Bhalla Ball Bearings Industry says that the<\/p>\n<p>            site where the industries including M\/s Bhalla Ball<\/p>\n<p>            Bearings Industry are to be shifted, though identified,<\/p>\n<p>            has not yet been developed.\n<\/p><\/blockquote>\n<blockquote><p>                     We take judicial notice of this fact and direct the<\/p>\n<p>            authorities to develop the site and file the report on the<\/p>\n<p>            next date of hearing.&#8221;\n<\/p><\/blockquote>\n<p>4.          Thereafter the matter was taken up on 20.8.2007, the<\/p>\n<p>Division Bench in its order dated 20.8.2007 notices the conclusion<\/p>\n<p>and summary of suggestions made by the Deputy Commissioner and<\/p>\n<p>the same reads thus:-\n<\/p>\n<p><span class=\"hidden_text\"> C.W.P. No. 13121 of 1998                                             6<\/span><\/p>\n<blockquote><p>           &#8221;            Pursuant to our order on May 15, 2007, we<\/p>\n<p>           had asked the Deputy Commissioner, Kapurthala, to go<\/p>\n<p>           into the whole gamut of unauthorised constructions and<\/p>\n<p>           unregulated development in the colony in question and<\/p>\n<p>           find out as to how they can be regulated so that green<\/p>\n<p>           patches, roads and streets of uniform size can be cared<\/p>\n<p>           out and the existing colony be improved and the<\/p>\n<p>           necessary infrastructure like sewerage, rain water<\/p>\n<p>           drainage, garbage disposal etc. be provided.<\/p>\n<\/blockquote>\n<blockquote><p>                        Pursuant    to       our    order,   the   Deputy<\/p>\n<p>           Commissioner, Kapurthala, submitted his report after<\/p>\n<p>           having a detailed survey of the area and suggested some<\/p>\n<p>           remedial measures that find reflection in our order<\/p>\n<p>           passed on July 13, 2007.\n<\/p><\/blockquote>\n<blockquote><p>                        On the last date of hearing, we had directed<\/p>\n<p>           the Municipal Council, Phagwara, to file an affidavit<\/p>\n<p>           with regard to the implementation of the Scheme, as<\/p>\n<p>           suggested by the Deputy Commissioner, Kapurthala,<\/p>\n<p>           which has now been filed through its Executive Officer<\/p>\n<p>           Mr. Paramjit Singh, who is present in Court. The<\/p>\n<p>           affidavit reads as under:-\n<\/p><\/blockquote>\n<blockquote><p>                 &#8221;            1.        xx     xx     xx     xx.\n<\/p><\/blockquote>\n<blockquote><p>                              2.        That penultimate para of the<\/p>\n<p>                 report of the Deputy Commissioner reads as<\/p>\n<p>                 under:-\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\"> C.W.P. No. 13121 of 1998                                           7<\/span><\/p>\n<blockquote>\n<\/blockquote>\n<blockquote><p>                      &#8220;11. CONCLUSION AND SUMMARY<\/p>\n<p>                      OF SUGGESTIONS:\n<\/p><\/blockquote>\n<blockquote><p>                              11.1 Considering the fact that this<\/p>\n<p>                      T.P. Scheme is a still born scheme, which<\/p>\n<p>                      remained in papers and could not be<\/p>\n<p>                      implemented due to the fact that a lot of<\/p>\n<p>                      development had taken place prior to the<\/p>\n<p>                      notification of the scheme, and the necessity<\/p>\n<p>                      to maintain a reasonable level of civil<\/p>\n<p>                      facilities like parks, roads etc. the following<\/p>\n<p>                      are suggested:\n<\/p><\/blockquote>\n<blockquote><p>                              11.2 As regards open spaces\/parks,<\/p>\n<p>                      the Municipal Council, Phagwara should<\/p>\n<p>                      fence up the existing park area and maintain<\/p>\n<p>                      them.<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>                              11.3 Municipal Council, Phagwara<\/p>\n<p>                      should      retrieve        some    of           the<\/p>\n<p>                      encroached\/deviated area in Parks P-3 and<\/p>\n<p>                      P-4.\n<\/p><\/blockquote>\n<blockquote><p>                              11.4 Municipal Council, Phagwara<\/p>\n<p>                      can acquire an area of 33275 sq. ft (being<\/p>\n<p>                      the deficient park area) from the private<\/p>\n<p>                      owners     of    existing   open   spaces,        in<\/p>\n<p>                      accordance with the provisions of the law<br \/>\n<span class=\"hidden_text\"> C.W.P. No. 13121 of 1998                                        8<\/span><\/p>\n<p>                       governing the T.P Scheme under the Punjab<\/p>\n<p>                       Municipal Act, 1911.\n<\/p><\/blockquote>\n<blockquote><p>                             11.5 Municipal Council, Phagwara<\/p>\n<p>                       should remove the encroachments of 4237.5<\/p>\n<p>                       sq. ft. caused by projections and 555 sq. ft.<\/p>\n<p>                       caused by footsteps from residential houses.<\/p>\n<\/blockquote>\n<blockquote><p>                             11.6 The 24 factory units operating<\/p>\n<p>                       in the area, which are of non-polluting<\/p>\n<p>                       nature may be allowed to continue in the<\/p>\n<p>                       area and M\/s. Bhalla Ball Bearings, who are<\/p>\n<p>                       causing pollution, may be permitted to shift<\/p>\n<p>                       their unit from this area within 6 months.<\/p>\n<\/blockquote>\n<blockquote><p>                             11.7. Municipal Council, Phagwara<\/p>\n<p>                       should complete the rest of the formalities<\/p>\n<p>                       under the T.P. Scheme as required by the<\/p>\n<p>                       Punjab Municipal Act, 1911 and protect and<\/p>\n<p>                       maintain the existing parks\/open spaces,<\/p>\n<p>                       roads.&#8221;<\/p><\/blockquote>\n<\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>                             3.     That para No. 11.1 of the report<\/p>\n<p>                 dated July 13, 2007 does not require any comment.<\/p>\n<\/blockquote>\n<blockquote><p>                             4.     That so far as para No. 11.2 of<\/p>\n<p>                 the report is concerned, the Municipal Council,<\/p>\n<p>                 Phagwara has decided to accept the report in toto.<\/p>\n<p>                 The Municipal Council, Phagwara will do the<\/p>\n<p>                 fencing of the existing parks and will maintain<br \/>\n<span class=\"hidden_text\"> C.W.P. No. 13121 of 1998                                       9<\/span><\/p>\n<p>                 them. Municipal Council, Phagwara has passed the<\/p>\n<p>                 Resolution bearing No. 124 dated July 17, 2002 in<\/p>\n<p>                 which provisional amount of Rs. 2.50 lacs has<\/p>\n<p>                 been passed for fencing the existing park area. The<\/p>\n<p>                 Municipal Council has called the tender and after<\/p>\n<p>                 completing the tender formalities, the works shall<\/p>\n<p>                 be allotted to the contractor for fencing the<\/p>\n<p>                 existing parks area. So far as the maintaining of<\/p>\n<p>                 the existing parks is concerned, the Municipal<\/p>\n<p>                 Council will develop the existing park areas one<\/p>\n<p>                 by one as the Municipal Council, Phagwara faced<\/p>\n<p>                 the scarcity of the funds in these days and these<\/p>\n<p>                 parks are vested only in one ward and the<\/p>\n<p>                 Municipal Council has responsibility to look after<\/p>\n<p>                 the whole city of Phagwara.\n<\/p><\/blockquote>\n<blockquote><p>                             5.      That the Municipal Council,<\/p>\n<p>                 Phagwara has accepted para No. 11.3 of the report.<\/p>\n<p>                 The Municipal Council, Phagwara shall make the<\/p>\n<p>                 earnest   efforts   to   retrieve   the   possible<\/p>\n<p>                 encroachment\/deviated area in Park P-3 and P-4.<\/p>\n<p>                 In this regard Municipal Council has given notice<\/p>\n<p>                 under Section 172 of Punjab Municipal Act, 1911<\/p>\n<p>                 to the encroacher Tarsem Lal son of Daulat Singh<\/p>\n<p>                 bearing No. 1171 dated July 31, 2007 to vacate the<\/p>\n<p>                 encroached area within 30 days and failing which<br \/>\n<span class=\"hidden_text\"> C.W.P. No. 13121 of 1998                                           10<\/span><\/p>\n<p>                 the   Municipal    Council   will     demolish     the<\/p>\n<p>                 encroached area in Parks P-3 and P-4.<\/p>\n<\/blockquote>\n<blockquote><p>                             6.     That so far as para 11.4 of the<\/p>\n<p>                 report is concerned, it is not within the<\/p>\n<p>                 competence of Municipal Council, Phagwara to<\/p>\n<p>                 acquire the area (deficient park area) from the<\/p>\n<p>                 private owners of existing open space. It is the<\/p>\n<p>                 State Government alone who can acquire the area<\/p>\n<p>                 as suggested by the Deputy Commissioner in his<\/p>\n<p>                 report dated July 13, 2007. It may be stated here in<\/p>\n<p>                 its judgment as report in AIR 1994 Supreme Court<\/p>\n<p>                 2550 <a href=\"\/doc\/705262\/\">Yogendra Pal and others v. Municipality,<\/p>\n<p>                 Bhatinda and<\/a> another, the Hon&#8217;ble Apex Court has<\/p>\n<p>                 struck down the provision of Section 192 sub-<\/p>\n<p>                 section 1 (c) of the Punjab Municipal Act, 1911.<\/p>\n<\/blockquote>\n<blockquote><p>                             7.     That as per para 11.5 of the<\/p>\n<p>                 report, the Municipal Council, Phagwara would<\/p>\n<p>                 remove    the    encroachments      caused   by    the<\/p>\n<p>                 projections and by the foot-steps\/ramps from the<\/p>\n<p>                 residential houses. Necessary notices dated July<\/p>\n<p>                 26, 2007 under Section 172 of the Punjab<\/p>\n<p>                 Municipal Act, 1911 have been issued to the<\/p>\n<p>                 encroachers (50 in numbers) asking them to<\/p>\n<p>                 remove the encroachment within 30 days and in<br \/>\n<span class=\"hidden_text\"> C.W.P. No. 13121 of 1998                                               11<\/span><\/p>\n<p>                   default thereof, the Municipal Council would get it<\/p>\n<p>                   demolished in accordance with law.<\/p>\n<\/blockquote>\n<blockquote><p>                                  8.     That so far as para 11.6 of the<\/p>\n<p>                   report is concerned, it is the Industry Department<\/p>\n<p>                   of the Punjab Government which can remove M\/s.<\/p>\n<p>                   Bhalla Ball Bearings a polluting unit as suggested<\/p>\n<p>                   in the report.\n<\/p><\/blockquote>\n<blockquote><p>                                  9.     That so far as para No. 11.7 of<\/p>\n<p>                   the report is concerned, Municipal Council,<\/p>\n<p>                   Phagwara will make every efforts to protect and<\/p>\n<p>                   maintain existing parks\/open space. In this regard,<\/p>\n<p>                   Municipal Council has installed the Board in the<\/p>\n<p>                   existing      parks   displaying   parks   belong        to<\/p>\n<p>                   Municipal Council and fall under the T.P. Scheme<\/p>\n<p>                   5 Part-II.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>                         Let implementation of the Scheme as per the<\/p>\n<p>            affidavit of the Municipal Council, Phagwara, be done.<\/p>\n<\/blockquote>\n<blockquote><p>                         Be notified for hearing on October 05, 2007.<\/p>\n<p>                         Copy of the order be given &#8216;Dasti&#8217; under the<\/p>\n<p>            signatures of the Special Secretary.&#8221;<\/p>\n<\/blockquote>\n<p>5.          When the matter came up for further consideration on<\/p>\n<p>21.10.2008, learned counsel for the petitioners apprise the Court that<\/p>\n<p>the directions issued on 20.8.2007 have not been carried in letter and<\/p>\n<p>spirit nor any status report as per direction has been filed.           He<\/p>\n<p>complained that there were still residential houses in the park, which<br \/>\n<span class=\"hidden_text\"> C.W.P. No. 13121 of 1998                                          12<\/span><\/p>\n<p>claim was contested by the learned counsel for the respondent<\/p>\n<p>Municipal Council, Phagwara.       As there was no comprehensive<\/p>\n<p>affidavit giving details about the implementation of the directions<\/p>\n<p>issued by this Court on 20.8.2007 and 5.10.2007, we called for<\/p>\n<p>comprehensive report. Accordingly, an affidavit dated 15.11.2008<\/p>\n<p>was filed by Shri Adarsh Kumar Sharma, Executive Officer,<\/p>\n<p>Municipal Council, Phagwara. The affidavit of the Executive Officer<\/p>\n<p>disclosed a number of steps which have been taken in respect of Park<\/p>\n<p>No. P-3 and P-4. It has been deposed that free access to the parks<\/p>\n<p>have been made and there is no hindrance in the free movement to the<\/p>\n<p>general public on their way to these parks and that open spaces\/parks<\/p>\n<p>have been partially covered through boundary wall and partially<\/p>\n<p>through fencing with iron wire and concrete pillars. It has also been<\/p>\n<p>pointed out that priority is being given to provide drinking water<\/p>\n<p>supply and sewerage facilities to the residents of the municipal area.<\/p>\n<p>The Executive Officer has also deposed that drinking water and<\/p>\n<p>sanitation is being provided to the residents of the locality of Town<\/p>\n<p>Planning Scheme No. 5 Part-II and it is persuading the residents of<\/p>\n<p>the locality of Town Planning Scheme No. 5 Part-II for purchasing<\/p>\n<p>deficient park area at collector rates. In case the nearby residents of<\/p>\n<p>do not show their willingness to sell their land then process for<\/p>\n<p>compulsory acquisition would be initiated through the Deputy<\/p>\n<p>Commissioner, Kapurthala. A comprehensive rehabilitation plan is<\/p>\n<p>required to remove small factory units operating in the area because<\/p>\n<p>thousands of workers and their families are dependent on these small<br \/>\n<span class=\"hidden_text\"> C.W.P. No. 13121 of 1998                                            13<\/span><\/p>\n<p>units. The Municipal Council, Phagwara, has already made a request<\/p>\n<p>to the General Manager, District Industries Centre, Kapurthala as well<\/p>\n<p>as the Executive Engineer, Punjab Pollution Control Board,<\/p>\n<p>Jalandhar, to take necessary legal action against these units, vide their<\/p>\n<p>letter dated 7.11.2008.\n<\/p>\n<p>6.           It is pertinent to notice that there is some dispute with<\/p>\n<p>regard to notification and de-notification of the Town Planning<\/p>\n<p>Scheme, which is subject matter of other petitions. The controversy<\/p>\n<p>raised in these petitions would not cover the issue of notification\/de-<\/p>\n<p>notification of the Town Planning Scheme as the same is involved in<\/p>\n<p>a bunch of other petitions which are pending and dealt with<\/p>\n<p>separately. The order passed in these petitions, therefore, shall not be<\/p>\n<p>taken to have any effect on the pending petitions.\n<\/p>\n<p>7.           When the matter came up for consideration on<\/p>\n<p>20.11.2008 before this Court, again the issue of encroachments in the<\/p>\n<p>park area was raised by referring to Park No. P-3. It was claimed that<\/p>\n<p>no specific affidavit was filed with regard to demolition of house<\/p>\n<p>belonging to one Shri Tarsem Lal in Park No. P-3. This Court has<\/p>\n<p>noticed that in the affidavit dated 25.1.2008, the only statement made<\/p>\n<p>by the Executive Officer was that the Municipal Council had<\/p>\n<p>retrieved the possible encroachment\/deviated area in Park No. 3 and<\/p>\n<p>Park No. 4 and it has removed the encroachment of footsteps\/ramps<\/p>\n<p>from the residential area by clearing the road and the streets by using<\/p>\n<p>JCB machine. The Court expressed dissatisfaction because nothing<\/p>\n<p>was said about demolition of encroachment to which reference was<br \/>\n<span class=\"hidden_text\"> C.W.P. No. 13121 of 1998                                          14<\/span><\/p>\n<p>made in the order dated 20.8.2007.        Accordingly, we asked the<\/p>\n<p>Municipal Council, Phagwara to file specific affidavit of its<\/p>\n<p>Executive Officer that the encroacher has vacated the encroached<\/p>\n<p>area.\n<\/p>\n<p>8.             Shri   Adarsh   Kumar    Sharma,    Executive   Officer,<\/p>\n<p>Municipal Council, Phagwara, has filed affidavit dated 1.12.2008 by<\/p>\n<p>stating that on 31.7.2007 the encroacher Shri Tarsem Lal was asked<\/p>\n<p>to vacate the encroached area of Park No. P-3 and after receiving the<\/p>\n<p>notice he has himself demolished the excess\/encroached portion of<\/p>\n<p>his house in Park No. 3.\n<\/p>\n<p>9.             After hearing learned counsel for the parties, we are of<\/p>\n<p>the considered view that no useful purpose would be served by<\/p>\n<p>keeping these petitions alive as necessary steps have already been<\/p>\n<p>taken. Accordingly, these writ petitions are disposed of with the<\/p>\n<p>observation that Municipal Council, Phagwara shall ensure that there<\/p>\n<p>is no encroachments by the unwarranted elements. We wish to make<\/p>\n<p>it clear that any observation made in this order shall not have any<\/p>\n<p>adverse effect on the pending litigation with regard to the polluted<\/p>\n<p>industries in the residential area or any scheme by the respondents in<\/p>\n<p>that regard.<\/p>\n<pre>\n\n\n\n\n                                              (M.M.
