    Petitioners  are   accused   6  and   8  in<\/p>\n
C.C.1134\/2009 on the file of Judicial First<\/p>\n
Class   Magistrate’s   Court,   Punalur   taken<\/p>\n
cognizance for the offence under section 420<\/p>\n
read with section 34 of Indian Penal Code<\/p>\n
against  nine  accused,  on  Annexure  2  final<\/p>\n
report.   Second respondent is the de facto<\/p>\n
complainant. Annexure 1 F.I.R was registered on<\/p>\n
recording the First Information Statement of<\/p>\n
the second respondent.  Prosecution case, as is<\/p>\n
clear from Annexure 2 final report, is that<\/p>\n
nine  accused  are  partners  of  Jayabharatham<\/p>\n
Financiers and the said financiers collected<\/p>\n
Rs.4,75,000\/- as fixed deposit and Rs.42,679\/-<\/p>\n
as subscription    of the chitty from first<\/p>\n
charge witness and  Rs.1,25,000\/- was collected<\/p>\n

from the second charge witness and       in the name of<\/p>\n
the      daughter    of   the  third   charge   witness<\/p>\n
Rs.7,78,315\/- was collected from the third charge<\/p>\n
witness,       in the name of the mother of the  fourth<\/p>\n
charge witness Rs.2,20,000\/- was collected from the<\/p>\n
fourth       charge   witness,  and   Rs.50,000\/-   was<\/p>\n
collected        from the  fifth  charge   witness  and<\/p>\n
Rs.1,15,000\/- was collected as fixed deposit from<\/p>\n
the sixth charge witness and cheated all of them by<\/p>\n
not repaying the amount when demanded       and thereby<\/p>\n
committed the offences.        This petition is filed<\/p>\n
under section 482 of the Code of Criminal Procedure<\/p>\n
contending that       petitioners are accused 6 and 8<\/p>\n
and they were implicated only on the allegation<\/p>\n
that they are partners of the firm “Jayabharatham<\/p>\n
Financiers” and though petitioners, who are wives<\/p>\n
of the two brothers of the first accused, and they<\/p>\n
were earlier partners of Jayabharatham Financiers,<\/p>\n
the said firm was defunct from 1995 onwards and a<\/p>\n
lawyer notice was sent at the instance of the<\/p>\n
petitioners, to the first accused for dissolution<\/p>\n
of the said firm and for settlement of the account<\/p>\n

stating that as the firm is defunct and a firm at<\/p>\n
will, steps are to be taken for dissolution of the<\/p>\n
firm     and settlement of the accounts.    Petitioners<\/p>\n
have filed Annexure 6 plaint before Sub Court,<\/p>\n
Kottarakkara as O.S.270\/1995 for dissolution of the<\/p>\n
firm.      By Annexure 7 judgment Sub Court   dissolved<\/p>\n
the partnership firm Jayabharatham Financiers and a<\/p>\n
preliminary decree was passed.      There is finding in<\/p>\n
Annexure 7 that even           according to the first<\/p>\n
accused, the managing partner the firm was not<\/p>\n
functioning after 1995. It is contended that in<\/p>\n
such       circumstances,    petitioners    cannot   be<\/p>\n
prosecuted for the amount collected by the first<\/p>\n
accused or the other accused.         Annexure 3 and 4<\/p>\n
deed of partnership were also produced to show that<\/p>\n
first       accused    and   others   had   constituted<\/p>\n
Jayabharatham       Financiers   and   Chits        and<\/p>\n
petitioners are not partners of       firms and if the<\/p>\n
other accused had collected money, petitioners are<\/p>\n
not liable and continuation of the proceedings as<\/p>\n
against the       petitioners is an abuse of process of<\/p>\n
the court.\n<\/p>\n
Crl.M.C.3466\/2009             4<\/span><\/p>\n
      2.         Learned  counsel  appearing   for   the<\/p>\n
petitioners, second respondent and learned Public<\/p>\n
Prosecutor were heard.\n<\/p>\n
      3.      Petitioners who are none other than the<\/p>\n
wives of two other brothers of the first accused,<\/p>\n
were implicated in the case only on the allegation<\/p>\n
that     they    were  partners  of  the  firm  by  name<\/p>\n
Jayabharatham Financiers.       Though Annexure 6 plaint<\/p>\n
and Annexure 7 judgment in O.S.270\/1995, shows that<\/p>\n
the firm Jayabharatham Financiers was constituted<\/p>\n
on 1.5.1982 and both the petitioners were       partners<\/p>\n
of the firm, by Anneuxre 7 judgment the firm was<\/p>\n
dissolved. Annexure 7 judgment also shows that even<\/p>\n
according       to  the  first  accused  the    managing<\/p>\n
partner of the       firm was not functioning from 1995<\/p>\n
onwards.        Annexure 3 and 4 establish that first<\/p>\n
accused       and   others  had  started   Jayabharatham<\/p>\n
Financiers and Chits by Annexure 3 Partnership Deed<\/p>\n
dated      1.4.1992    and  by   Annexure  4   deed   of<\/p>\n
partnership       dated 1.4.2003, which was continuation<\/p>\n
of    the      original  partnership   firm  which   was<\/p>\n
constituted on 1.11.1992.        Therefore even if the<\/p>\n

partners       of   the  Jayabharatham  Financiers   had<\/p>\n
collected amount for the firm constituted under<\/p>\n
Annexure 3 or 4, petitioners cannot be made liable<\/p>\n
as they are not partners of the firm.               When<\/p>\n
Annexure 7 judgment shows that, as claimed by the<\/p>\n
petitioners       in  Annexure  5  notice  Jayabharatham<\/p>\n
Financiers       was   defunct  from  1995,  petitioners<\/p>\n
cannot be prosecuted for either the collection or<\/p>\n
deposits subsequent to 1995 or its non payment.<\/p>\n
Therefore        continuation  of  the  prosecution   as<\/p>\n
against the          petitioners is only an abuse of<\/p>\n
process of the court.\n<\/p>\n
      Petition     is  allowed.    Cognizance  taken  as<\/p>\n
against         petitioners  the  accused  6 and  8   in<\/p>\n
C.C.1134\/2009         by Judicial First Class Magistrate<\/p>\n
Court is quashed.\n<\/p>\n<\/p>\n
