Heard the learned counsels for the<\/p>\n<p>                   petitioners and the State.\n<\/p>\n<p>                                The     petitioners            are    apprehending<\/p>\n<p>                   their    arrest          in    a    case    registered          under<\/p>\n<p>                   Sections 427, 504 of the Indian Penal Code<\/p>\n<p>                   and Section \u00be of the Explosive Substances<\/p>\n<p>                   Act.\n<\/p>\n<p>                                It is alleged that due to explosion<\/p>\n<p>                   in the mining work, stone cheeps fell in the<\/p>\n<p>                   land    of    the        informant         causing       damage    to<\/p>\n<p>                   crops    and       water       pipe    which       was    used     in<\/p>\n<p>                   irrigation of land.\n<\/p>\n<p>                                It     is    submitted          by    the     learned<\/p>\n<p>                   counsel       for        the       petitioners           that     the<\/p>\n<p>                   petitioners are licensee for mining hence,<\/p>\n<p>                   no case is made out under Sections 3 and 4<\/p>\n<p>                   of     the    Explosive            Substances      Act.     It     is<\/p>\n<p>                   further       submitted            that      the     prosecution<\/p>\n<p>                   report       does    not       reflect      that     crops       were<\/p>\n<p>                   damaged due to explosion.\n<\/p>\n<p>                                Considering the aforesaid facts, let<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>        the petitioners, Santosh Chaurasia and Arun<\/p>\n<p>        Kumar    Singh,       be    released         on    bail   in   the<\/p>\n<p>        event    of    arrest       or    surrender           before   the<\/p>\n<p>        learned       court       below    within         a   period      of<\/p>\n<p>        twelve weeks from today in connection with<\/p>\n<p>        Kasma P.S. Case No. 17 of 2010 on furnishing<\/p>\n<p>        bail bond of Rs.10,000\/-(Ten Thousand) each<\/p>\n<p>        with two sureties of the like amount each to<\/p>\n<p>        the     satisfaction         of        the     learned    C.J.M.<\/p>\n<p>        Aurangabad,       subject         to     the      conditions      as<\/p>\n<p>        laid down under Section 438(2) of the Code<\/p>\n<p>        of Criminal Procedure.\n<\/p>\n<\/p>\n<pre>U.
