JUSTICE S.D.ANAND.\n\n\nPresent:     Mr. Vijay Sharma, Advocate for the petitioner\n\n             Mr. Rajpal Kansal,Advocate for the respondent.\n                                  *****\n\nS.D.ANAND, J.\n<\/pre>\n<p>             The impugned order directed the closure of rebuttal evidence<br \/>\nof the plaintiff-petitioner by noticing that no witness was present on that<br \/>\ndate inspite of the fact that sufficient opportunities for the purpose<br \/>\naforementioned had already been granted to the plaintiff-petitioner.\n<\/p>\n<p>             In support of the argument that Mr. N.K.Jain, Hand-writing and<br \/>\nFinger Print Expert was present on that date with a duly sworn affidavit<br \/>\nwhich was to be tendered in evidence in lieu of examination-in-chief.,<br \/>\nlearned counsel has placed on record a photocopy of the affidavit of the<br \/>\nexpert aforementioned which purports to have been attested on 11.4.2008<br \/>\nitself. In that very context, the learned counsel has placed on record a<br \/>\nphotocopy of the report dated 6.4.2008 ( and also the photo copies of the<br \/>\ndisputed and admitted signatures).\n<\/p>\n<p>             Without commenting upon the merits of the case, the petition<br \/>\nshall stand allowed in the circumstances of the case.
