NANAVATI\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     Substitution allowed.\n<\/p>\n<p>     This  appeal,   by\t special   leave,  arises  from\t the<br \/>\nreversing judgment  of the  High Court\tof Orissa  in Second<br \/>\nAppeal No.8\/75,\t dated 2.8.1978.  The admitted\tposition  is<br \/>\nthat in\t Suit No.29\/23 of 1937 in the Court of Small Causes,<br \/>\nexecution was  laid in\tM.S. No.217\/37.\t 1\/4th share  of the<br \/>\nproperty bearing  Touzi Nos.2498 and 2503\/354 was brought to<br \/>\nsale on\t 16.2.1938,  One  Babu\tSuryanarayan,  a  practicing<br \/>\nadvocate of that court, had become the auction purchaser. He<br \/>\nhad the possession of the 1\/4th specified share therein from<br \/>\nthe court.  Subsequently, h sold the self-same property by a<br \/>\nregistered sale\t deed in  1940 to one Hemamali Devi daughter<br \/>\nof another  practicing advocate.  Hemamali Devi in turn sold<br \/>\nthe property  to the  appellant in 1950 under Ex.2(A), dated<br \/>\n14.10.1950. On\tthe basis  thereof , the appellant filed the<br \/>\nsuit for  partition.  The  respondents\thand  purchased\t the<br \/>\nproperty and  other properties\tfrom the  judgment-debtor in<br \/>\nthe  suit.   They  disclaimed  the  purchase  made  by\tBabu<br \/>\nSuryanarayan and  his sale  in favour  of Hemamali  Devi and<br \/>\nfurther sale  in favour\t of the appellant. thus it is a case<br \/>\nof total  denial of  the title\tof the\tappellant. The trial<br \/>\nCourt decreed the suit and the appellate Court confirmed the<br \/>\nsame for partition of 1\/4th share and delivery of possession<br \/>\nby metes and bound by passing a final degree. The High Court<br \/>\nreversed the said decree primarily on two grounds, viz. that<br \/>\nthere is  no proof  of possession  of the property delivered<br \/>\nunder the  court sale, and that the appellant has not proved<br \/>\nwhat extent  of the  land they\thad purchased.\tUnder  these<br \/>\ncircumstances,\tthe  appellant\tcannot\tseek  possession  by<br \/>\npartition of  the land . The view taken by the high Court is<br \/>\nclearly illegal. It is seen that the Sale Certificate issued<br \/>\nby the\tcourt clearly indicates the particulars of the lands<br \/>\nmentioned as under;\n<\/p>\n<blockquote><p>     &#8220;1. Touzi\tNo.2498 &#8211;  Thana No.214,<br \/>\n     Mouza &#8211;  Baharabishabar in District<br \/>\n     Cuttack,  P.S.,   Thana  and   Sub-\n<\/p><\/blockquote>\n<blockquote><p>     registrar\t Cuttack    Sadar,   Ph.<br \/>\n     Bakhrabad in  Khata No.431 &#8211; Area &#8211;<br \/>\n     Ac.0.19 &#8211;\trent &#8211;\tRs.0.12.6.  From<br \/>\n     this  four\t  annas\t share\t of  the<br \/>\n     defendant &#8211;  debtor is  Ac.0.04  -7<br \/>\n     Kadis rent Rs.0.3. 2-1\/2. This land<br \/>\n     is auctioned at a sum of Rs.4\/-<br \/>\n     Schedule<br \/>\n     Khasada No.1609 &#8230;. Ac.9.19.<br \/>\n     Rs.9.4.0\tannas\tshare\tof   the<br \/>\n     defendant\tdebtor\t Ac.0.04   Kadis<br \/>\n     0.07.\n<\/p><\/blockquote>\n<blockquote><p>     2. Touzi No.2502\/354 &#8211; Thana No.214<br \/>\n     in District Cuttack, P.S. and Thana<br \/>\n     and subregistrar  Cuttack Sadar Ph.<br \/>\n     Bakhrabad,\t Mouza\t Baharabisnabar,<br \/>\n     Khata No.894  &#8211; Area Ac.0. 170 Dec.\n<\/p><\/blockquote>\n<blockquote><p>     &#8211;\trebd  Rs.0.9.3.\t From  this  the<br \/>\n     share of  the defendant-debtor  and<br \/>\n     his   brother    is   eight   annas<br \/>\n     (Rs.0.3.0) Area  Ac.0.84 Dec.  10 &#8211;<br \/>\n     Kadis &#8211;  rent &#8211;  Rs.0.4.7-1\/2 which<br \/>\n     is auctioned at a price of Rs.20\/-.<br \/>\n     Description<br \/>\n     From the  Tafsil No.  811\tAc.0.170<br \/>\n     Dec. the  4  annas\t share\tof  this<br \/>\n     defendant-debtor is  Ac.0.42 dec. 5<br \/>\n     Kadis.&#8221;<\/p><\/blockquote>\n<p>     The same was sold with description of boundaries in the<br \/>\nsale made  in favour  of Hemamali  Devi and  also    in\t the<br \/>\nsubsequent sale\t to the appellant under Ex.2 (A). Thus it is<br \/>\nclear that  Babu Suryanarayan  had purchased the 1\/4th share<br \/>\nin the\tabove described\t property. Thereby  he became  a co-<br \/>\nowner with  other  3\/4th  shareholders\twhose  property\t was<br \/>\npurchased by the respondents. The High Court also is clearly<br \/>\nin error  in holding  that there  is no proof of possession.<br \/>\nSince the  appellant had  sought summoning of the warrant of<br \/>\ndelivery of  possession, which\twas not available, the court<br \/>\nregister was  summoned which  contained an  entry  regarding<br \/>\ndelivery of  the possession. No doubt the description of the<br \/>\nproperty  delivered   was  not\tmentioned  in  the  delivery<br \/>\nwarrant. When  the entry maintained in the court register of<br \/>\ndelivery of  possession is  read with  the sale\t certificate<br \/>\nissued by  the court,  it is obvious that what was delivered<br \/>\nto  Babu   Suryanarayan,  a  practicing\t advocate,  was\t the<br \/>\nproperty mentioned in the sale certificate. The property was<br \/>\nleased out  and rent was realised. Thereby he became the co-<br \/>\nowner.\tThe  appellant\tbeing  successor-in-interest  having<br \/>\npurchased the  self-same property, had become co-owner along<br \/>\nwith the  respondents. Thereby\tthe suit  for partition\t was<br \/>\nrightly decreed by the courts below.\n<\/p>\n<p>     The appeal\t is accordingly\t allowed. The  judgment\t and<br \/>\ndecree of  the High  Court stands  set aside and that of the<br \/>\ntrial court  as\t confirmed  by\tthe  appellate\tCourt  stand<br \/>\nconfirmed. It  is open\tto the\tparties to  proceed with the<br \/>\nexecution of the decree in filing an application for passing<br \/>\na final\t decree and  take further steps according to law.
