Justice ANTONY DOMINIC\n\n Dated :05\/01\/2011\n\n O R D E R\n                        ANTONY DOMINIC, J.\n                      ================\n                   W.P.(C) NO. 37364 OF 2010\n                 =====================\n\n            Dated this the 5th day of January, 2011\n\n                           J U D G M E N T\n<\/pre>\n<p>      Petitioner is an Advocate enrolled with the 2nd respondent. In<\/p>\n<p>this writ petition, his prayer is to quash Ext.P6 resolution, whereby<\/p>\n<p>the 2nd respondent has resolved to fix the date of polling to<\/p>\n<p>12\/3\/2011. He also seeks a direction to respondents to conduct<\/p>\n<p>the polling as per Ext.P1 and the schedule attached thereto.<\/p>\n<p>Among the various grievances urged, main one was that, on<\/p>\n<p>coming to know of Ext.P6, he along with others made Exts.P7 to<\/p>\n<p>P9 representations to the Bar Council of Kerala requesting that<\/p>\n<p>the election be held as per Ext.P1 itself or atleast on any other<\/p>\n<p>working day.        It is stated that inspite of having made<\/p>\n<p>representations, the Bar Council has not considered the requests.<\/p>\n<p>      2.    Learned Standing counsel appearing for the Bar<\/p>\n<p>Council submitted that, the Bar Council has already decided to<\/p>\n<p>consider the representations made, in its next meeting. Now that<\/p>\n<p>the Bar Council has agreed to consider the representation of the<\/p>\n<p>petitioner in its next meeting, which is schedule to be held on 9th<\/p>\n<p>of this month, I do not think it necessary for this Court to enter<\/p>\n<p>WPC No. 37364\/10<br \/>\n<span class=\"hidden_text\">                                :2 :<\/span><\/p>\n<p>into the merits of the controversy raised in the writ petition.<\/p>\n<p>      Therefore, recording the submission of the learned standing<\/p>\n<p>counsel for the 2nd respondent that the representations made by<\/p>\n<p>the petitioner and others requesting for rescheduling the election<\/p>\n<p>now notified pursuant to Ext.P6, this writ petition is disposed of.<\/p>\n<p>                                       ANTONY DOMINIC, JUDGE<br \/>\nRp<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Mathai Varkey Muthirenthy vs The Bar Council Of India on 5 January, 2011 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C).No. 37364 of 2010(U) 1.
