enhancement of compensation as against  in
\nMVC No.1167\/2004\u00bb. By the vs-aid award;hotbed”i71fibun\u00aba1″has granted<\/p>\n
the compensation of Rs.38,000a\/–$.  ht  .2<\/p>\n
2. The learned  ..e\u00a7pe11ent while seeking<\/p>\n
enhancement 1 of 1′ the:V;.corn’pen’s’a”tion’A-‘ contend that no<\/p>\n
cornpensation; has .bAee-nw–atz(rarded”t.owards ‘loss of future earnings’
\neven though thee._dqocto’r”wh’o’ ha’d_:trVeated the claimant has stated
\nthat there is ‘2″7′?.o disab,iIit\u00a7t and 9% to the Whole body. it is further<\/p>\n
contendedvl”that:’ under the other heads the compensation<\/p>\n
 granted  inad\u00e9et-:1t1at.e.in as much as the claimant was a sugar<\/p>\n
T’v.__c’on1’ractot’—andv_ vh’a_d}iost suf\ufb01ciently in View of the injuries suffered<\/p>\n
 in  accident. Hence it is contended that the<\/p>\n
 ‘c\u00abornpe’ns’a,t_io\u00abn has to be enhanced.<\/p>\n

3. On behalf of the respondent, the award passed byabthe<\/p>\n
Tribunal is sought to be justified. It is contended<\/p>\n
though the nature of the disability as stated by    <\/p>\n
noticed by the Tribunal, the Tribunal has”rightly_ not<\/p>\n
same since the same does not relate to functional disabil,it_V.” <\/p>\n
further contended that, on the other also the “Triiibun’aliiihas it<\/p>\n
granted appropriate compensation and doles-iinoti call for
\ninterference. he i A<\/p>\n
4. In the light ‘.Of~\\:?:’\\:7l’i.<",-Li'.  ion perusal of the
\nfacts involveCi.i~4'n'itl1e,:  iitiviViou'ldi indicate that the nature
\nof injuries suffered  inhthe accident which occurred
\non 05.11.2003 not  in dispute. The claimant had
\ne;_<\u00abam_ined,_':_liirnse1fV_ as l5VJ.l.___.a,\u00ab;v1d the Dental Practitioner Dr. B. S.<\/p>\n
Bagi, whio-.had'itreated_ the claimant was examined as PW2. The<\/p>\n
ii"i._d,0curnents=indicating'the nature of the injuries and the treatment<\/p>\n
i:"–.{'CT'aCl,\u00a73I'Cd the claimant in respect of the said accident was<\/p>\n
i  at~..E}xs:Pl to P9. The fact that the claimant had lost three<\/p>\n
 had also suffered injuries all over his face, more<\/p>\n
 ' \u00bbv._vApartiicularly to the jaw cannot be disbelieved.<\/p>\n

5. In a matter of this nature, the question arises is_..as to<\/p>\n
whether the disability as stated by the doctor could be <\/p>\n
the present case. In my view, even though the learned  *<\/p>\n
for the appellant has contended in this _regard,  uh’<\/p>\n
rightly not accepted the disability for  p3i_irpose’~_o’f <\/p>\n
future income, since there is not}ii._ng..zindicated. and “r_efer.red to r ‘<\/p>\n
show that based on said injuries_ui’the=_,_Vclaihmant  been
\nincapacitated. Further, havingfsaid,  that requires to be<\/p>\n
noticed is that, in that bacitgroiiiid compensation<\/p>\n
awarded is jL3;s’th’ar1d.:pr0pe:’r’L’<\/p>\n
6. Even, thought<no_farnoun't– could be granted towards the
\n'loss of future e'arningVs',_ 'since\ufb02the nature of injuries would not
\nindicate  udisability',i._.but there will be discomfort and in that<\/p>\n
regard,Wsome iamgouvnt requires to be granted under 'loss of<\/p>\n
 arneniiiti.es.?,_Vg\u00ab'I'heirefore',"a sum of Rs. 15,000\/– is awarded under the<\/p>\n
 said head? Further, since the claimant had suffered facial injuries,<\/p>\n
, _ftl'1e"'anioL1.nt awarded towards 'pain and suffering' is on the lower<\/p>\n
iand"a"s such a further sum of Rs.l5,000\/– is awarded and<\/p>\n

7. Hence, the claimant\/appellant in all is
