\t\tRULE.\n<\/p>\n
 Mr. Maulik G. Nanavati, learned APP, waives service of notice of
\nrule on behalf of respondent No.1-State and Mr. Hardik A. Dave,
\nlearned Advocate, waives for respondent No.2.\n<\/p>\n
1.\t\tPetitioner is the
\noriginal accused, who is facing a complaint for dishonour of cheque,
\nunder Section 138 of the Negotiable Instruments Act.  In the said
\nproceedings, he had filed an application for sending the disputed
\ncheque for handwriting expert’s opinion.  However, the said request
\nwas turned down by the learned Magistrate, on the ground that the
\nstage for calling the opinion of handwriting expert has not yet come.
\n Later on, at the stage of recording of his statement under Section
\n313 of the Criminal Procedure Code, he filed a fresh application
\nExhibit-62 and revised his request.  In the said application it is
\nstated inter alia that, the account from which the cheque was
\nalleged to be issued, was closed down in the year 2001. The booklet,
\nwhich contained the disputed cheque, was issued in the year 1998. It
\nis, therefore, apparent that he would not have issued such a cheque
\nin the year 2004, when the said cheque is alleged to have been given.
\nAfter 1998, other cheque books have been issued.  He, therefore,
\nprayed that to verify the details filled up in the said cheque, i.e.
\nthe age of the signature and handwritings in the cheque and also to
\nverify whether the signature and the handwritings are of same person
\nor not, it is necessary to send the disputed cheque for handwriting
\nexpert’s opinion.\n<\/p>\n
2.\t\tThis application was
\nturned down by the learned Magistrate by order dated 22.02.2010,
\ninter alia on the ground that when the accused has admitted
\nhis signature on the cheque, it is not necessary to call for the
\nexpert’s report, regarding other details. His revision application
\nwas also dismissed by the learned Additional District Judge, by order
\ndated 26.04.2010.  He has, therefore, approached this Court, in the
\npresent petition.\n<\/p>\n
3.\t\tI have heard learned
\nCounsel for the petitioner. He submitted that the Courts below have
\ncommitted serious error in rejecting the application of the
\npetitioner. He contended that, since several disputes were raised
\nregarding the disputed cheque, it was very essential that the same be
\nsend for handwriting expert’s opinion.\n<\/p>\n
4.\t\tHe relied on a
\ndecision of the Apex Court in the case of  T. Nagappa Vs.
\nY.R. Muralidhar  reported in AIR 2008 SC 2010, in support
\nof the petition.\n<\/p>\n
5.\t\tOn the other hand,
\nlearned Counsel for the complainant opposed the petition, supported
\nthe decision of the Courts below and contended that the petitioner
\nhad not led any evidence for the prayer made in the application
\nExhibit-62.  He relied on a decision of the learned Single Judge of
\nthis Court in the case of  Madhubhai Gandabhai Patel VS.
\nJoitaram Jividas Patel and Another  reported in 2005 (3)
\nGLH 535.\n<\/p>\n
6.\t\tHe also drew my
\nattention to the reply filed by the petitioner to the notice under
\nSection 138 of the Negotiable Instruments Act, issued by the
\ncomplainant.\n<\/p>\n
7.\t\tI have also heard
\nlearned APP for respondent No.1-State.\n<\/p>\n
8.\t\tThough, it is true
\nthat the petitioner has admitted his signature on the disputed
\ncheque, he has been disputing other aspects related to the drawing of
\nthe cheque. For example, he contended that the contents of the cheque
\nare not written by him.  He also, in the application Exhibit-62,
\nstated that the account itself was closed in the year 2001, the
\ncheque book was issued in the year 1998, and therefore, the disputed
\ncheque could not have been issued in the year 2004.\n<\/p>\n
9.\t\tWithout, further,
\nelaborating on this aspect of the matter, so as not to prejudice the
\ncomplainant or the petitioner during the pendency of the trial, in my
\nopinion the request of the petitioner to send the disputed cheque for
\nhandwriting expert’s opinion, ought to have been accepted, more
\nparticularly, when the petitioner requested that the age of the
\nsignature itself be verified. His admission of his signature on the
\ndisputed cheque, therefore, was not the sole consideration, on which
\nhis request should have been turned down.\n<\/p>\n
10.\t\tIn the case of  T.\n<\/p>\n
Nagappa (Supra), the Apex Court has held and observed as
\nunder:\n<\/p>\n
 7.\t\tWhen a
\ncontention has been raised that the complainant has misused the
\ncheque, even in a case where a presumption can be raised under
\nSection 118(a) or 139 of the said Act, an opportunity must be granted
\nto the accused for adducing evidence in rebuttal thereof.  As the law
\nplaces the burden on the accused, he must be given an opportunity to
\ndischarge it.\n<\/p>\n
11.\t\tIn the result, the
\npetition is allowed. The impugned order dated 22.02.2010, passed by
\nthe Judicial Magistrate First Class(Additional Senior Civil Judge),
\nViramgam, below application Exhibit-62 in Criminal Case No. 1067 of
\n2004 and the order dated 26.04.2010, passed by the learned Additional
\nDistrict Judge, F.T.C. No.2, Ahmedabad(Rural) at Viramgam, below
\napplication Exhibit-7 in Criminal Revision Application No.2 of 2010,
\nare QUASHED.  Application, EXHIBIT-62, is
\nALLOWED. Learned MAGISTRATE shall take
\nthe CONSEQUENTIAL steps.  The report from FSL may be
\ncalled expeditiously.  Rule is made absolute.\n<\/p>\n
