Justice V.GIRI\n\n Dated :20\/02\/2008\n\n O R D E R\n                                  V.GIRI,J.\n\n                            -------------------------\n\n                      W.P ( C) No. 5573  of 2008\n\n                           --------------------------\n\n                Dated this the 20th   February, 2008\n\n\n                             J U D G M E N T\n<\/pre>\n<p>      While   working   as   a   Police   Constable   in   the<\/p>\n<p>Commissionerate of  Police, Kozhikode, petitioner  was convicted<\/p>\n<p>for   an   offence   under   Section   55(a)   of   the   Abkari   Act   and   was<\/p>\n<p>sentenced to undergo R.I for 5 years with fine of Rs.1 lakh by the<\/p>\n<p>Fast   Track   Court   II,   Kozhikode   in   SC   8\/2003.   On   the   basis   of<\/p>\n<p>such   conviction,   petitioner   was   dismissed   from   service,   by<\/p>\n<p>Exhibit   P1   order   passed   by   the   3rd  respondent     on   the   premise<\/p>\n<p>that  it is considered that the conduct of the petitioner which has<\/p>\n<p>led to his conviction is such as to render his further retention in<\/p>\n<p>public service  undesirable.\n<\/p>\n<p>      2.     Petitioner   challenged   his   conviction   and   sentence<\/p>\n<p>under Section  55(a) of the Abkari Act in Crl.A. No.556 of 2005.\n<\/p>\n<p>This   Court   held     that     the   conviction   under   Section   55(a)   is<\/p>\n<p>unsustainable     and   accordingly   set   aside   the   same.   But   the<\/p>\n<p>petitioner   was   instead  convicted for   the  offence   under  Section<\/p>\n<p>63   of   the   Abkari   Act   and   was   sentenced   to   pay   a   fine   of<\/p>\n<p>W.P ( C) No. 5573  of 2008<\/p>\n<p><span class=\"hidden_text\">                                        2<\/span><\/p>\n<p>Rs.1,500\/-.\n<\/p>\n<p>      3.       Petitioner   has   submitted   Exhibit   P3   before   the   3rd<\/p>\n<p>respondent   for   reconsideration   of   the   order   by   which   he   was<\/p>\n<p>dismissed   from   service.     In   circumstances   where   the   basis   of<\/p>\n<p>Exhibit   P1,   according   to   him,   has   been   changed,   this   writ<\/p>\n<p>petition has been filed seeking a direction to the 3rd  respondent<\/p>\n<p>to consider and pass appropriate orders on Exhibit P3.\n<\/p>\n<p>      4.       I   heard   the   learned   counsel   for   the   petitioner<\/p>\n<p>Mr.T.G.Rajendran   and  the   learned   Government   Pleader.     In   my<\/p>\n<p>view, the 3rd respondent is obliged to consider his request under<\/p>\n<p>Exhibit P2, since  there is a change of circumstances, in as much<\/p>\n<p>as that the conviction of the petitioner under Section 55(a) of the<\/p>\n<p>Abkari   Act   has   been   set   aside   by   this   Court   in   Exhibit   P2<\/p>\n<p>judgment.\n<\/p>\n<p>      In the  result, the writ petition  is disposed  of directing  the<\/p>\n<p>3rd  respondent   to   consider   and   pass   appropriate   orders   on<\/p>\n<p>Exhibit P3, within a period of four weeks from the date of receipt<\/p>\n<p>of a copy of this judgment.\n<\/p>\n<p>                                                         (V.GIRI, JUDGE)<\/p>\n<p>ma<\/p>\n<p>W.P ( C) No. 5573  of 2008<\/p>\n<p><span class=\"hidden_text\">                              3<\/span><\/p>\n<p>                                    K.THANKAPPAN,J<\/p>\n<p>                                   CRL.A.
