Application No.1056\/2006 whereby the present appellant was<br \/>\ndirected to hand over the custody of minor within 30 days from the<br \/>\ndate of the order.\n<\/p>\n<p>2.\tThe<br \/>\nmarriage between the appellant and respondent had taken place about<br \/>\n17 years back and out of the said wedlock they have  three children<br \/>\nnamed daughter Puja aged 16 years, son Vikas aged 14 years and<br \/>\ndaughter Sraddha aged 9 years. Due to difference of opinion, the<br \/>\nappellant had  left the respondent and the children in pursuance of<br \/>\nwhich an application under section 97 CPC came to be filed to give<br \/>\nthe custody of children to the respondent. Ultimately there was a<br \/>\nsettlement wherein the appellant was to be paid Rs.1600\/- per month<br \/>\nand the present respondent  has liberty to meet the children.<br \/>\nThereafter  Puja and Vikas started staying with the present<br \/>\nrespondent and therefore the respondent stopped paying their portion<br \/>\nof maintenance. Ultimately the present respondent filed  Misc. Civil<br \/>\nApplication No.1056 of 2006 in the court of learned Presiding<br \/>\nOfficer, Fast Track Court No.2, Rajkot stating that he wanted to send<br \/>\nher daughter to a good school and to give her good education. He,<br \/>\ntherefore prayed that custody of Sraddha may be given to him. The<br \/>\nJoint District Judge and 2nd Fast Track Court, Rajkot<br \/>\nallowed the said application and directed to hand over the custody of<br \/>\nminor within 30 days from the date o the order. Against the said<br \/>\norder the present appeal has been filed.\n<\/p>\n<p>3.\tMr.\n<\/p>\n<p>Patel, learned Advocate for the appellant has submitted that  the<br \/>\nappellant is the mother of the minor and therefore no other person in<br \/>\ncomparison of the mother can take care of the minor. He submitted<br \/>\nthat  the minor is a female child aged 10 years and therefore only<br \/>\nappellant can consider all the matters of welfare of the female<br \/>\nminor. According to the appellant the respondent is of angry nature<br \/>\nand he cannot take care of the minor child and this appeal may be<br \/>\nallowed.\n<\/p>\n<p>4.\tMr.\n<\/p>\n<p>P.S. Gondalia, learned Advocate appearing for the respondent<br \/>\nsubmitted that the lower court has taken into consideration all the<br \/>\nfacts and circumstances of the case and no  case is made out to cause<br \/>\ninterference in the present appeal. He therefore submitted that the<br \/>\npresent appeal deserves to be dismissed.\n<\/p>\n<p>5.\tAs<br \/>\na result of hearing of learned Advocates and perusal of the record it<br \/>\nis found that the trial court has considered all the aspects<br \/>\nincluding the  financial aspect of the matter. The Court has also<br \/>\nconsidered the fact that the other two children are staying with the<br \/>\npresent respondent and it would be in the interest of the minor child<br \/>\nto stay with them. The trial court has also considered the financial<br \/>\ncondition of the respondent, the social status and the welfare of the<br \/>\nminor child and found that it would be in the interest of the minor<br \/>\nto stay with the respondent who can take care of her  in a better<br \/>\nmanner. Learned Advocate for the appellant is unable to point out<br \/>\nanything to reverse the finding of the trial court. I am in complete<br \/>\nagreement with the reasoning adopted and the findings arrived at by<br \/>\nthe trial court.\n<\/p>\n<p>6.\tIn<br \/>\nthe premises aforesaid, I do not find any merits in the appeal. The<br \/>\nappeal is, therefore, dismissed.
