\/>\nThe\u00a0Full\u00a0Bench\u00a0of\u00a0this\u00a0court\u00a0in\u00a0Ajit\u00a0Singh\u00a0@\u00a0Muraha\u00a0v.\u00a0State\u00a0of\u00a0U.P.\u00a0and\u00a0others\u00a0(2006\u00a0<br \/>\n(56)\u00a0ACC\u00a0433)\u00a0reiterated\u00a0the\u00a0view\u00a0taken\u00a0by\u00a0the\u00a0earlier\u00a0Full\u00a0Bench\u00a0in\u00a0Satya\u00a0Pal\u00a0v.\u00a0State\u00a0of\u00a0<br \/>\nU.P. \u00a0 and \u00a0 others \u00a0 (2000 \u00a0 Cr.L.J. \u00a0 569) \u00a0 that \u00a0 there \u00a0 can \u00a0 be \u00a0 no \u00a0 interference \u00a0 with \u00a0 the\u00a0<br \/>\ninvestigation\u00a0or\u00a0order\u00a0staying\u00a0arrest\u00a0unless\u00a0cognizable\u00a0offence\u00a0is\u00a0not\u00a0ex\u00adfacie\u00a0discernible\u00a0<br \/>\nfrom\u00a0the\u00a0allegations\u00a0contained\u00a0in\u00a0the\u00a0F.I.R.\u00a0or\u00a0there\u00a0is\u00a0any\u00a0statutory\u00a0restriction\u00a0operating\u00a0<br \/>\non\u00a0the\u00a0 power\u00a0of\u00a0the\u00a0Police\u00a0to\u00a0investigate\u00a0a\u00a0case\u00a0as\u00a0laid\u00a0down\u00a0by\u00a0the\u00a0Apex\u00a0Court\u00a0in\u00a0<br \/>\nvarious\u00a0decisions\u00a0including\u00a0State\u00a0of\u00a0Haryana\u00a0v.\u00a0Bhajan\u00a0Lal\u00a0and\u00a0others\u00a0(AIR\u00a01992\u00a0SC\u00a0604)\u00a0<br \/>\nattended\u00a0with\u00a0further\u00a0elaboration\u00a0that\u00a0observations\u00a0and\u00a0directions\u00a0contained\u00a0in\u00a0Joginder\u00a0<br \/>\nKumar&#8217;s\u00a0case\u00a0(Joginder\u00a0Kumar\u00a0v.\u00a0State\u00a0of\u00a0U.P.\u00a0and\u00a0others\u00a0(1994)\u00a04\u00a0SCC\u00a0260\u00a0contradict\u00a0<br \/>\nextension\u00a0to\u00a0the\u00a0power\u00a0of\u00a0the\u00a0High\u00a0Court\u00a0to\u00a0stay\u00a0arrest\u00a0or\u00a0to\u00a0quash\u00a0an\u00a0F.I.R.\u00a0under\u00a0article\u00a0<br \/>\n226\u00a0and\u00a0the\u00a0same\u00a0are\u00a0intended\u00a0to\u00a0be\u00a0observed\u00a0in\u00a0compliance\u00a0by\u00a0the\u00a0Police,\u00a0the\u00a0breach\u00a0<br \/>\nwhereof, \u00a0 it \u00a0 has \u00a0 been \u00a0 further \u00a0 elaborated, \u00a0 may \u00a0 entail \u00a0 action \u00a0 by \u00a0 way \u00a0 of \u00a0 departmental\u00a0<br \/>\nproceeding\u00a0or\u00a0action\u00a0under\u00a0the\u00a0contempt\u00a0of\u00a0Court\u00a0Act.\u00a0The\u00a0Full\u00a0Bench\u00a0has\u00a0further\u00a0held\u00a0<br \/>\nthat \u00a0 it \u00a0 is \u00a0 not\u00a0 permissible\u00a0 to \u00a0 appropriate \u00a0 the \u00a0 writ\u00a0 jurisdiction \u00a0 under \u00a0 Article\u00a0 226 \u00a0 of \u00a0 the\u00a0<br \/>\nconstitution\u00a0as\u00a0an\u00a0alternative\u00a0to\u00a0anticipatory\u00a0bail\u00a0which\u00a0is\u00a0not\u00a0invocable\u00a0in\u00a0the\u00a0State\u00a0of\u00a0<br \/>\nU.P.\u00a0attended\u00a0with\u00a0further\u00a0observation\u00a0that\u00a0what\u00a0is\u00a0not\u00a0permissible\u00a0to\u00a0do\u00a0directly\u00a0cannot\u00a0<br \/>\nbe\u00a0done\u00a0indirectly.\u00a0\n<\/p>\n<p>The \u00a0 learned \u00a0 counsel \u00a0 for \u00a0 the \u00a0 petitioners \u00a0 have \u00a0 not \u00a0 brought \u00a0 forth \u00a0 anything \u00a0 cogent \u00a0 or\u00a0<br \/>\nconvincing \u00a0 to \u00a0 manifest \u00a0 that \u00a0 no \u00a0 cognizable \u00a0 offence \u00a0 is \u00a0 disclosed \u00a0 prima \u00a0 facie \u00a0 on \u00a0 the\u00a0<br \/>\nallegations\u00a0contained\u00a0in\u00a0the\u00a0F.I.R.\u00a0or\u00a0that\u00a0there\u00a0was\u00a0any\u00a0statutory\u00a0restriction\u00a0operating\u00a0on\u00a0<br \/>\nthe\u00a0police\u00a0to\u00a0investigate\u00a0the\u00a0case.\n<\/p>\n<p>Having\u00a0scanned\u00a0the\u00a0allegations\u00a0contained\u00a0in\u00a0the\u00a0F.I.R.\u00a0the\u00a0Court\u00a0is\u00a0of\u00a0the\u00a0view\u00a0that\u00a0the\u00a0<br \/>\nallegations\u00a0in\u00a0the\u00a0F.I.R.\u00a0do\u00a0disclose\u00a0commission\u00a0of\u00a0cognizable\u00a0offence\u00a0and\/therefore\u00a0no\u00a0<br \/>\nground\u00a0 is\u00a0made\u00a0out\u00a0warranting\u00a0interference\u00a0by\u00a0this\u00a0Court.\u00a0The\u00a0petition\u00a0is\u00a0accordingly\u00a0<br \/>\ndismissed.\n<\/p>\n<p>However,\u00a0it\u00a0is\u00a0provided\u00a0that\u00a0in\u00a0case\u00a0the\u00a0petitioners\u00a0surrender\u00a0and\u00a0apply\u00a0for\u00a0bail\u00a0within\u00a015\u00a0days\u00a0from\u00a0<br \/>\ntoday \u00a0 before \u00a0 the \u00a0 courts \u00a0 below, \u00a0the \u00a0 same \u00a0 shall \u00a0 be \u00a0 considered \u00a0 and \u00a0 decided \u00a0 expeditiously \u00a0 on \u00a0 its\u00a0<br \/>\nintrinsic\u00a0merit\u00a0by\u00a0the\u00a0courts\u00a0below\u00a0in\u00a0accordance\u00a0with\u00a0the\u00a0provisions\u00a0of\u00a0Gangsters\u00a0Act.\u00a0\n<\/p>\n<p>Order Date
