NO.3733     OF 2008\n            ===========================\n\n      Dated this the 1st day of January,2009\n\n                       ORDER\n<\/pre>\n<p>    Revision petitioner is the complainant in CMP<\/p>\n<p>No.4124\/2006 on the file of Judicial First Class<\/p>\n<p>Magistrate,   Payyannur.      Learned    Magistrate<\/p>\n<p>dismissed the complaint under section 203 of the<\/p>\n<p>Code  of  Criminal   Procedure.     The  order  is<\/p>\n<p>challenged in this revision petition filed under<\/p>\n<p>section  397  and  401  of  the  Code  of  Criminal<\/p>\n<p>Procedure.\n<\/p>\n<p>    2.  Learned counsel appearing for the revision<\/p>\n<p>petitioner was heard.\n<\/p>\n<p>    3.  The argument of the learned counsel is that<\/p>\n<p>learned Magistrate was not justified in dismissing<\/p>\n<p>the complaint and if the opinion of an expert was<\/p>\n<p>obtained it would have proved that the signature in<\/p>\n<p>the disputed records is not that of the revision<\/p>\n<p>petitioner  and   therefore     dismissal  of   the<\/p>\n<p>complaint is illegal.\n<\/p>\n<p><span class=\"hidden_text\">CRRP 3733\/2008              2<\/span><\/p>\n<p>     4.     On hearing the learned counsel and going<\/p>\n<p>through the impunged order, I find no reason to<\/p>\n<p>interfere with the order dismissing the complaint<\/p>\n<p>under     section   203  of  the  Code   of  Criminal<\/p>\n<p>Procedure. As canvassed by the revision petitioner,<\/p>\n<p>even if it is proved that the signature in the<\/p>\n<p>records      available   with  the   Civil   Supplies<\/p>\n<p>Department is not that of the revision petitioner,<\/p>\n<p>it   will     not show  that  accused  committed  the<\/p>\n<p>offence.       Unless there is material to prove that<\/p>\n<p>the signature in the records is that of the accused<\/p>\n<p>by merely showing that the signature is not that of<\/p>\n<p>the revision petitioner,     case against the accused<\/p>\n<p>will   not    lie.    It  is for  that  valid  ground<\/p>\n<p>learned Magistrate dismissed the complaint under<\/p>\n<p>section 203 of the Code of Criminal Procedure.    The<\/p>\n<p>order is perfectly legal.
