No.1311 of 2005\n          ------------------------------------------------\n           Dated this the 18th day of June, 2008\n\n                         JUDGMENT\n<\/pre>\n<p>    This   Court           vide          order           dt.02\/06\/08<\/p>\n<p>directed the counsel for the appellant who was<\/p>\n<p>granted two weeks&#8217; time as prayed for to cure<\/p>\n<p>the defects, that defects are to be cured<\/p>\n<p>positively in two weeks. The defect was that<\/p>\n<p>service was not complete on respondents 3, 5,<\/p>\n<p>6,  9  and  11       to      14      on      C.M.        Application<\/p>\n<p>No.833\/05 seeking condonation of delay of 155<\/p>\n<p>days in filing the R.S.A. The R.S.A is one<\/p>\n<p>filed on 15\/11\/05 with a delay of 155 days.<\/p>\n<p>Even after lapse of two and a half years the<\/p>\n<p>appellant was not able to have notice served<\/p>\n<p>on the respondents in the C.M. Application<\/p>\n<p>enabling this Court to pass order one way or<\/p>\n<p>the other in the delay condonation petition.<\/p>\n<p>Today counsel for the petitioner has filed<\/p>\n<p><span class=\"hidden_text\">R. S. A. No.1311 of 2005           -2-<\/span><\/p>\n<p>      I.A.1291\/08 seeking for condonation of delay<\/p>\n<p>      in taking steps. On perusal of the affidavit<\/p>\n<p>      accompanying C.M.Application No.833\/05, it is<\/p>\n<p>      seen that the reasons assigned to have the<\/p>\n<p>      delay condoned is quite unsatisfactory. The<\/p>\n<p>      judgment          under  appeal  was  delivered on<\/p>\n<p>      31\/01\/04; copy of the judgment was applied for<\/p>\n<p>      on      03\/02\/04;      stamp papers  called for on<\/p>\n<p>      01\/06\/04 were produced on 04\/06\/04 and though<\/p>\n<p>      copy was ready and 18\/03\/05 was fixed as the<\/p>\n<p>      date       to     appear and  receive copy, it was<\/p>\n<p>      received only after four months on 18\/07\/05.<\/p>\n<p>      According to the petitioner, he was under the<\/p>\n<p>      impression that his counsel would intimate him<\/p>\n<p>      when        copy    is  received  and that  in the<\/p>\n<p>      meanwhile, he fell sick and was suffering from<\/p>\n<p>      Asthma and Bronchitis and therefore, he could<\/p>\n<p>      go over to the office only on 20\/10\/05 and<\/p>\n<p>      could understand that the copies were taken<\/p>\n<p>      delivery of by his lawyer on 18\/07\/05.<\/p>\n<p><span class=\"hidden_text\">R. S. A. No.1311 of 2005            -3-<\/span><\/p>\n<p>              2. There is absolutely no evidence to<\/p>\n<p>      show       that     the  petitioner  was  having  any<\/p>\n<p>      ailment or that he was bedridden nor does he<\/p>\n<p>      say that he was bedridden. Such lame excuses<\/p>\n<p>      to cover up the wanton neglect on the part of<\/p>\n<p>      the appellant coupled with the neglect on the<\/p>\n<p>      part of the counsel or his clerk to receive<\/p>\n<p>      copy       of     judgment when   date  was fixed  to<\/p>\n<p>      receive          copy  are  not  circumstances  which<\/p>\n<p>      enable such inordinate delay being condoned.<\/p>\n<p>              3.      It   is  worthy   to  note that  the<\/p>\n<p>      successful party cannot wait indefinitely to<\/p>\n<p>      see whether any appeal is filed from the<\/p>\n<p>      judgment          in  his favour.   Rights that  have<\/p>\n<p>      accrued to the successful party by reason of<\/p>\n<p>      non-filing of the appeal cannot be lightly<\/p>\n<p>      interfered with also when the defeated party<\/p>\n<p>      files appeal at his own whims and fancies<\/p>\n<p>      taking his own sweet time. I am not satisfied<\/p>\n<p>      that       just     and  sufficient  cause exists  to<\/p>\n<p><span class=\"hidden_text\">R. S. A. No.1311 of 2005         -4-<\/span><\/p>\n<p>      condone the delay of as much as 155 days in<\/p>\n<p>      filing the appeal.\n<\/p>\n<p>              4.
