JUSTICE KANWALJIT SINGH AHLUWALIA\n\n\nPresent :    Mr. Ramesh Goyat, Advocate for\n             Mr. Sudershan Goel, Advocate for the petitioner.\n\nKANWALJIT SINGH AHLUWALIA, J.\n<\/pre>\n<p>             Present writ petition has been filed by Mahender Singh-<\/p>\n<p>petitioner (hereinafter called the &#8216;workman&#8217;) aggrieved against the award<\/p>\n<p>dated 26th February, 2008 (Annexure P-8) passed by the Labour Court,<\/p>\n<p>whereby his prayer for reinstatement with continuity in service and full back<\/p>\n<p>wages, has been declined by the Labour Court.\n<\/p>\n<p>             Briefly stated, workman had served demand notice (Annexure<\/p>\n<p>P-1) on 7th November, 2000, wherein he stated that he was appointed as<\/p>\n<p>labourer on 01.06.1988 on daily wage basis and he continued to work till<\/p>\n<p>his services were terminated on 26th January, 1995. It has been stated that<\/p>\n<p>services of the petitioner had been terminated without complying with the<\/p>\n<p>mandatory provisions of Section 25-F of the Industrial Disputes Act, 1947<\/p>\n<p>(hereinafter called the &#8216;Act&#8217;). Thereafter, the matter was referred to the<br \/>\n<span class=\"hidden_text\"> CWP 14923 of 2008                                                            2<\/span><\/p>\n<p>Labour Court by the Government of Haryana and following reference was<\/p>\n<p>made:\n<\/p>\n<blockquote><p>                &#8220;Whether the termination of services of workman Shri<br \/>\n         Mahender Singh is legal and justified or not? If not so, to what<br \/>\n         relief he is entitled?&#8221;\n<\/p><\/blockquote>\n<blockquote><p>                Thereafter, claim statement (Annexure P-2) was filed by the<\/p>\n<p>workman reiterating what was stated in his demand notice. It was further<\/p>\n<p>averred that respondent No.2 &#8211; management has also not followed the<\/p>\n<p>provisions of Section 25 (G and H) of the Act. Written statement (Annexure<\/p>\n<p>P-3) was filed by the respondent-management, wherein claims made by<\/p>\n<p>the workman were denied. It was stated therein that sixteen labourers<\/p>\n<p>including the petitioner had preferred CWP No. 6743 of 1992 against the<\/p>\n<p>State of Haryana, which has been dismissed and thereafter petitioners<\/p>\n<p>instituted a civil suit, which was also dismissed as withdrawn. It was further<\/p>\n<p>stated that the petitioner-workman was engaged as labourer, as and when<\/p>\n<p>respondent-management required to remove grass and dry grass in the<\/p>\n<p>school on muster roll as per local rates fixed by the Deputy Commissioner,<\/p>\n<p>Sonepat and it was stated that petitioner was a labourer on daily wage<\/p>\n<p>basis.<\/p><\/blockquote>\n<p>                We have heard counsel for the petitioner. He has stated that a<\/p>\n<p>similarly situated workman Mohammad was ordered to be reinstated by the<\/p>\n<p>Labour Court and a writ petition preferred by the management against the<\/p>\n<p>award, whereby Mohammad was reinstated, was dismissed. Therefore,<\/p>\n<p>petitioner be also reinstated on parity and also on the ground that<\/p>\n<p>Mohammad was junior to the petitioner.\n<\/p>\n<p>                We are of the view that petitioner is not entitled to the relief,<\/p>\n<p>which has been granted to Mohammad. Following finding returned by the<br \/>\n<span class=\"hidden_text\"> CWP 14923 of 2008                                                        3<\/span><\/p>\n<p>Labour Court demolish the argument raised by the counsel for the<\/p>\n<p>petitioner:\n<\/p>\n<blockquote><p>              &#8220;15.   However, these contentions are devoid of force<br \/>\n      because though MW-1 Sh. N.K.Bakshi has deposed that the<br \/>\n      above named Mohammad was working as per the Award of<br \/>\n      the Court and has also admitted that the Civil Writ Petition, as<br \/>\n      preferred against the aforesaid award, was also dismissed but<br \/>\n      during his cross-examination itself, he has specifically and<br \/>\n      categorically denied the suggestion that the case of aforesaid<br \/>\n      Mohammad was on the similar footing to the case of the<br \/>\n      workman. Moreover, the workman has even failed to produce<br \/>\n      the copy of the award as passed by the Labour Court and the<br \/>\n      copy of the Judgment as passed by the Hon&#8217;ble High Court in<br \/>\n      the Civil Writ Petition, in favour of Mohammad from where it<br \/>\n      could be ascertained as to on what grounds he had<br \/>\n      succeeded in proving his case in both the above said Courts<br \/>\n      and as to whether those grounds were available to the<br \/>\n      workman or not. Again, though the afore named MW-1 has<br \/>\n      stated during his cross-examination that the afore named<br \/>\n      Jagdish, Satbir and Murari are still working but he has also<br \/>\n      deposed that they are working against the sanctioned posts<br \/>\n      and has also categorically deposed in para No.1 of his<br \/>\n      affidavit Ex. MW-2 that there is no sanctioned post of<br \/>\n      Labourer\/ Mazdoor in the school establishment. From these<br \/>\n      depositions, it is crystal clear that the afore-named workers<br \/>\n      are not working on the post of Labourers and are not given<br \/>\n      appointment against sanctioned posts on the basis of length of<br \/>\n      their service as daily wagers and moreover, MW-1 has also<br \/>\n      specifically deposed during his cross-examination that they<br \/>\n      have neither appointed any labourer nor have regularized the<br \/>\n      services of any labourer. The workman has also not been able<br \/>\n      to prove that he was senior to the afore named Mohammad,<br \/>\n      Jagdish, Satbir, Murari etc. and that Jagdish, Satbir and<br \/>\n      Murari were appointed in violation of the prescribed rules and<br \/>\n<span class=\"hidden_text\"> CWP 14923 of 2008                                                      4<\/span><\/p>\n<p>      regulations for such like appointments. Then, while deposing<br \/>\n      as WW-1, he has also failed to even disclose the names of<br \/>\n      persons who were allegedly given new appointment after the<br \/>\n      termination of his services.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>            As per his own claim, workman was verbally appointed on<\/p>\n<p>daily wage basis. His appointment into public employment was not in<\/p>\n<p>pursuance of any advertisement issued, affording opportunity to other<\/p>\n<p>persons, nor his services were requisitioned through employment<\/p>\n<p>exchange. No equal opportunity was afforded to similarly situated persons.\n<\/p><\/blockquote>\n<p>In the present case, workman was not appointed as per rules and<\/p>\n<p>regulations but was a contractual employee on daily wage basis and<\/p>\n<p>termination of his services did not amount to retrenchment.<\/p>\n<p>            He could not be reinstated in view of judgment of the Hon&#8217;ble<\/p>\n<p>Supreme Court in <a href=\"\/doc\/1591733\/\">State of Karnataka and others v. Umadevi and others<\/a><\/p>\n<p>(2006) 4 SCC 1.\n<\/p>\n<p>            We find that the view taken by the Hon&#8217;ble Supreme Court in<\/p>\n<p><a href=\"\/doc\/1667788\/\">Municipal Council, Samrala v. Raj Kumar<\/a> (2006) 3 SCC 81 is that unless<\/p>\n<p>an employee is appointed as per rules and regulations, his\/her appointment<\/p>\n<p>cannot be treated to be consistent with Articles 14 and 16 of the<\/p>\n<p>Constitution. Appointment given de hors the rules and regulations is liable<\/p>\n<p>to termination and is covered under Section 2(oo) (bb) of the Act and thus,<\/p>\n<p>does not amount to retrenchment. Similarly, in <a href=\"\/doc\/885748\/\">Gangadhar Pillai v.<\/p>\n<p>Siemens Limited<\/a> (2007) 1 SCC 533, Indian Drugs &amp; Pharmaceuticals<\/p>\n<p>Ltd. v. Workmen (2007) 1 SCC 408, Reserve Bank of India v. Gopinath<\/p>\n<p>Sharma and another (2006) 6 SCC 221 and UP Power Corporation Ltd.<\/p>\n<p>and another v. Bijli Mazdoor Sangh and others (2007) 5 SCC 755, it has<\/p>\n<p>been held that reinstatement of a workman in public employment will not be<br \/>\n<span class=\"hidden_text\"> CWP 14923 of 2008                                                      5<\/span><\/p>\n<p>consistent with Article 14 unless a workman had been appointed by<\/p>\n<p>following rules and regulations.\n<\/p>\n<p>             In view of the above, we find no merit in the present writ<\/p>\n<p>petition and the same is liable to be dismissed.
