Justice R.BASANT\n\n Dated :13\/07\/2007\n\n O R D E R\n                                   R.BASANT, J\n\n                        = = = = = = = = = = = = =\n\n                             B.A.No.4242 of 2007\n\n                       = = = = = = = = = = = = = =\n\n                     Dated this the 13th day of July, 2007\n\n\n                                       ORDER\n<\/pre>\n<p>       Application for anticipatory bail.   The petitioners are accused   1<\/p>\n<p>to   5.     The   petitioners   and   defacto   complainant   are   neighbours.<\/p>\n<p>Consequent to a dispute between the wife of the 1st  accused and the<\/p>\n<p>defacto complainant,   the petitioners had allegedly gone to the house<\/p>\n<p>of the defacto complainant and indulged in contumacious and culpable<\/p>\n<p>overt   acts.     Though   allegations   under   Secs.325,   379   etc.   were   also<\/p>\n<p>raised,  now   the   prosecution   persists   in   the   allegations   under   Section<\/p>\n<p>452, 323  and 447 read with 149 IPC only.\n<\/p>\n<\/p>\n<p>       2.     The   learned   counsel   for   the   petitioner   prays,   the   learned<\/p>\n<p>Public Prosecutor does not seriously oppose the said prayer and I am<\/p>\n<p>satisfied   that   in   the   peculiar   facts   of   the   case   explained   above<\/p>\n<p>anticipatory bail can be granted to the petitioner subject to appropriate<\/p>\n<p>conditions.\n<\/p>\n<\/p>\n<p>       3.     In   the   result,   this   application   is   allowed.     The   following<\/p>\n<p>directions were issued under Section 438 Cr.P.C.:-<\/p>\n<p>       i)     The petitioners shall appear before the Learned Magistrate<\/p>\n<p>having jurisdiction at 11 a.m on 20.07.2007.   They shall be enlarged<\/p>\n<p>on   regular   bail   on   their   executing   bonds   for   Rs.25,000\/-(Rupees<\/p>\n<p><span class=\"hidden_text\">B.A.No. 4242 of 2007                        2<\/span><\/p>\n<p>Twenty Five thousand only) each with two solvent sureties each for the<\/p>\n<p>like sum to the satisfaction of the learned Magistrate.<\/p>\n<p>       ii)     The   petitioners   shall   make   themselves   available   for<\/p>\n<p>interrogation   before   the   investigating   officer   between   10   a.m.   and   3<\/p>\n<p>p.m   on   21.07.2007   and   thereafter   they   shall   make   themselves<\/p>\n<p>available for interrogation before the investigating officer between  10<\/p>\n<p>a.m and 12 noon on all  Mondays and Fridays for a period of 2 months<\/p>\n<p>and subsequently as and when directed by the Investigating Officer in<\/p>\n<p>writing to do so.\n<\/p>\n<\/p>\n<p>       iii)    If   the   petitioners   do   not   surrender   before   the   learned<\/p>\n<p>Magistrate   as   directed   in   clause   (i),   all   directions   issued   above   shall<\/p>\n<p>thereafter stand revoked and the police shall be at liberty to arrest the<\/p>\n<p>petitioner and deal with them in accordance with law.<\/p>\n<p>       iv)  if   the   petitioners   were   arrested   prior   to   their    surrender   on<\/p>\n<p>25.07.07, the learned Magistrate as directed in clause (i) above, they<\/p>\n<p>shall   be   released   forthwith   on   their   executing   a   bond   of   Rs.25,000\/-<\/p>\n<p>(Rupees Twenty five thousand only)  without any sureties undertaking<\/p>\n<p>to   appear   before   the   learned   Magistrate   on   25.07.07   as   directed   in<\/p>\n<p>clause(i) above.\n<\/p>\n<\/p>\n<p>                                                              (R.BASANT, JUDGE)<\/p>\n<p>sj<\/p>\n<p>                                      \/TRUE COPY\/<\/p>\n<p>                                                                   P.A.TO JUDGE<\/p>\n<p><span class=\"hidden_text\">B.A.No. 4242 of 2007    3<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court M.Hyder Ali vs State Of Kerala on 13 July, 2007 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl No. 4242 of 2007() 1.
