SINGH, J.;\n<\/p>\n<p>1.Leave granted in both the SLPs.\n<\/p>\n<p>2.The appeal arising out of SLP(C) No.1628 of 1994 has\tbeen<br \/>\nfiled against order dated 8.7.1993 passed by the Maharashtra<br \/>\nAdministrative Tribunal,<br \/>\n<span class=\"hidden_text\">520<\/span><br \/>\nNagpur\tBench, dismissing the Writ Petition filed on  behalf<br \/>\nof the appellant, before the Nagpur Bench of the High  Court<br \/>\nof  Bombay  which was later transferred\t to  the  aforesaid,<br \/>\nTribunal.    By\t the  petition\taforesaid,   the   appellant<br \/>\nquestioned   the  validity  of\tthe  seniority\tlist   dated<br \/>\n29.4.1989,  so far as it changed the position of  respondent<br \/>\nNo.4  (hereinafter  referred to as  &#8216;the  respondent&#8217;)\tfrom<br \/>\nSerial\tNo. 20 to Serial No. 11. The appellant\talso  sought<br \/>\nquashing   of  the  order  dated  5.7.1989   promoting\t the<br \/>\nrespondent   to\t the  post  of\tProfessor,   Department\t  of<br \/>\nObstetrics  and Gynaecology, on the basis of  the  seniority<br \/>\nlist aforesaid by another application filed before the\tTri-<br \/>\nbunal.\n<\/p>\n<p>3.The appellant passed the M.B.B.S. examination in the\tyear<br \/>\n1967.\tShe obtained her Post-Graduate Degree in  Obstetrics<br \/>\nand  Gynaecology from Allahabad University in  April,  1972.<br \/>\nShe   was  appointed  as  Lecturer  in\tthe  Department\t  of<br \/>\nObstetrics  and\t Gynaecology  by a  Government\tOrder  dated<br \/>\n19.1.1977, at Government Medical College, Nagpur, after\t she<br \/>\nwas selected by Maharashtra Public Service Commission.\t She<br \/>\njoined\tthe said post on 11.2.1977. She was appointed  by  a<br \/>\nGovernment  Order dated 6.10.1977, as Reader in the  Depart-<br \/>\nment  of  Obstetrics and Gynaecology at\t Government  Medical<br \/>\nCollege, Nagpur, after her selection by the Maharashtra Pub-<br \/>\nlic  Service Commission.  She joined the post of  Reader  on\n<\/p>\n<p>11. 10. 1977 and continued on the said post till 21.10.1981.<br \/>\nIn the meantime, by a Government Order dated 15.10.1981, the<br \/>\nappellant  was appointed as Associate Professor in  the\t De-<br \/>\npartment  of  Obstetrics and Gynaecology  at  the  aforesaid<br \/>\nMedical College, Nagpur, which post she joined on  22.10.198\n<\/p>\n<p>1.  She was the senior most Associate Professor in the\tsaid<br \/>\ncollege, in the department aforesaid.\n<\/p>\n<p>4.   So\t far as the respondent is concerned, she passed\t her<br \/>\nM.B.B.S. examination in the year 1967 but obtained her Post-<br \/>\nGraduate Degree in Obstetrics and Gynaecology in 1975.\t She<br \/>\nwas  promoted  as Reader on 2.7.1979 in\t the  Indira  Gandhi<br \/>\nMedical\t College, Nagpur, which was then under\tthe  control<br \/>\nand   management  of  the  Nagpur   Municipal\tCorporation.<br \/>\nHowever,  the  State  Government took  over  management\t and<br \/>\ncontrol of the Indira Gandhi Medical College w.e.f  1.4.1981<br \/>\nfrom the Nagpur Municipal Corporation.\n<\/p>\n<p>5.   A\tprovisional seniority list of Readers was  published<br \/>\non   21.11.1986\t and  objections  were\tinvited.   In\tthis<br \/>\nseniority list, the appellant was placed against Serial\t No.<br \/>\n13, whereas the respondent was placed against Serial  No.20.<br \/>\nThe date of appointment of the appellant as Reader was shown<br \/>\nas 11.2.1979, whereas that of respondent as 2.7.1979. In the<br \/>\nfinal  seniority  list, the position of\t the  appellant\t was<br \/>\nshown  against\tSerial No. 14, whereas\tthat  of  respondent<br \/>\nagainst Serial No.20. It is said that in both the draft\t and<br \/>\nfinal seniority lists, it was mentioned against the name  of<br \/>\nthe respondent that she belonged to the then  Non-Government<br \/>\nInstitution viz.  Indira Gandhi Medical College under Nagpur<br \/>\nMunicipal Corporation and her date of appointment as  Reader<br \/>\nwas accepted as 2.7.1979 because it was on that day, she had<br \/>\nbeen  promoted as Reader in that Institution.  However,\t the<br \/>\nState\tGovernment  published  another\tseniority  list\t  on<br \/>\n29.4.1989  in which the name of respondent was shifted\tfrom<br \/>\nserial No.20 to Serial No. 11 and the date of appointment of<br \/>\nrespondent was changed from 2.7.1979 to<br \/>\n<span class=\"hidden_text\">521<\/span><br \/>\n19.1.1977.Thereafter   by  an  order  dated  5.7.1989,\t the<br \/>\nrespondent  was\t promoted  to  the  post  of  Professor\t  of<br \/>\nObstetrics  and\t Gynaecology on the basis of  the  aforesaid<br \/>\nseniority  list,  The,\talteration of the  position  of\t the<br \/>\nrespondent  in\tthe  seniority list was\t challenged  by\t the<br \/>\nappellant,  before the High Court, by a Writ Petition  which<br \/>\nas already mentioned above, was transferred to the Tribunal.\n<\/p>\n<p>6.The Indira Gandhi Medical College, Nagpur, which was under<br \/>\nthe  control  and management of the  Nagpur  Municipal\tCor-<br \/>\nporation, had been taken over by the State Government  w.e.f<br \/>\n1.4.1981 and thereafter the State Government was required to<br \/>\nrefix the seniority of Lecturers, Readers and other teachers<br \/>\nof the said college, in terms of Rule 6 of G.R. of 1.4.1981.<br \/>\nRule 6 is as follows:-\n<\/p>\n<blockquote><p>\t      &#8220;The  seniority  of persons in  the  posts  in<br \/>\n\t      which they are absorbed shall be determined on<br \/>\n\t      the basis of the period of continuous  service<br \/>\n\t      rendered\tby them in the\tcorresponding  posts<br \/>\n\t      under  the Corporation prior to the  appointed<br \/>\n\t      day.   For this purpose, the service  rendered<br \/>\n\t      in  the corresponding posts shall\t be  counted<br \/>\n\t      from the date from which the absorbed  persons<br \/>\n\t      would  have been eligible for  appointment  to<br \/>\n\t      the  posts if the recruitment rules  of  Govt.<br \/>\n\t      then   in\t  force\t  were\t to   govern   their<br \/>\n\t      appointment- &#8221;\n<\/p><\/blockquote>\n<p>The  recruitment rules for the post of Reader issued in\t the<br \/>\nyear  1972  provides  the qualification for  the  post,\t the<br \/>\nrelevant  part whereof has been reproduced in the  order  of<br \/>\nthe Tribunal as follows:-\n<\/p>\n<blockquote><p>\t      &#8220;A  post\tgraduate degree\t in  Obstetrics\t and<br \/>\n\t      Gynaecology  such\t as M.D., M.S.,\t M.O.  of  a<br \/>\n\t      statutory\t University  or\t M.R.D.O.G.  or\t the<br \/>\n\t      qualification awarded by the Speciality  Board<br \/>\n\t      of  Obstetrics  and  Gynaecology\t(U.S.A.)  or<br \/>\n\t      F.R.C.S.\/\t  M.R.C.P.   with   Obstetrics\t and<br \/>\n\t      Gynaecology  as  a Special subject or  a\tpost<br \/>\n\t      graduate degree in Medicine or Surgery of\t the<br \/>\n\t      M.R.C.P.\/\t F.R.C.S. qualification with  D.G.O.<br \/>\n\t      for  the\tpost  of Reader\t in  Obstetrics\t and<br \/>\n\t      Gynaecology;  and possess experience  for\t not<br \/>\n\t      less thin three years of teaching the  subject<br \/>\n\t      concerned\t as Registrar or Lecturer or  in  an<br \/>\n\t\t\t    equivalent post in a teaching institution.&#8221;\n<\/p><\/blockquote>\n<p>The  justification,  which has been given on behalf  of\t the<br \/>\nState, for altering the date of promotion of the  respondent<br \/>\nas  a  Reader  from 2.7.1979 to 19.1.1977, is  Rule  6.\t The<br \/>\nTribunal  on the basis of Rule 6 aforesaid has come  to\t the<br \/>\nfollowing conclusion.\n<\/p>\n<blockquote><p>\t      &#8220;We,  therefore, hold that the  interpretation<br \/>\n\t      of rule 6 by the Govt. is in order and correct<br \/>\n\t      and    are   unable   to\t agree\t with\t the<br \/>\n\t      interpretation of the learned Advocate for the<br \/>\n\t      petitioner, Clearly on the appointed day,\t Dr.<br \/>\n\t      Guhe  was a Reader and was absorbed  as  such,<br \/>\n\t      her seniority has to be fixed on the  strength<br \/>\n\t      of  Rule 6 read with the recruitment rules  of<br \/>\n\t      Govt.  for the post of Reader, then in  force.<br \/>\n\t      She has rightly been given the benefit of\t her<br \/>\n\t      acquisition of requisite qualifications  (M.D.<br \/>\n\t      in  the year 1975) and continuous\t service  in<br \/>\n\t      the  post\t from  which  she  could  have\tbeen<br \/>\n\t      promoted\tas  a Reader.  It is  obvious  that,<br \/>\n\t      second  part of Rule 6 is clearly intended  to<br \/>\n\t      give  benefit  of continuous  service  in\t the<br \/>\n\t      eligibility  grade  for the  determination  of<br \/>\n\t      seniority in the absorbed grade.\tThese  rules<br \/>\n\t      are  the\trules of merger and  absorption\t and<br \/>\n\t      binding  on the Govt.  Because, it is only  on<br \/>\n\t      the  foundation  of these\t rules\tthat  merger<br \/>\n\t      could  take  place.   We\ttherefore,  find  no<br \/>\n\t      substance\t in the arguments of the  petitioner<br \/>\n\t      on  this\tcount.\tOtherwise,  the\t edifice  of<br \/>\n\t      merger crumbles.&#8221;\n<\/p><\/blockquote>\n<p>7.Rule\t6  says that seniority of persons in  the  posts  in<br \/>\nwhich they are absorbed shall be determined on the basis  of<br \/>\nthe  period  of continuous service rendered by them  in\t the<br \/>\ncorresponding  posts  under  the Corporation  prior  to\t the<br \/>\nappointed  day i.e. 1.4.1981. There is no dispute so far  as<br \/>\nthe  first part of Rule 6 is concerned.\t The dispute  is  in<br \/>\nrespect\t of the second part which says that for the  purpose<br \/>\nof  the said rule the service rendered in the  corresponding<br \/>\nposts  shall  be  counted  &#8220;from the  date  from  which\t the<br \/>\nabsorbed persons would have been eligible for appointment to<br \/>\nthe  posts if the recruitment rules of Govt. then  in  force<br \/>\nwere to govern their appointment.&#8221; Factually, respondent was<br \/>\npromoted  as  Reader in the Indira Gandhi  Medical  College,<br \/>\nNagpur, then under the management and control of the  Nagpur<br \/>\nMunicipal  Corporation\ton  2.7.1979.  But  a  notional\t and<br \/>\nfictional date of promotion as Reader for the purpose of her<br \/>\nseniority has been given on the basis of the second part  of<br \/>\nRule  6\t w.e.f 19.1.1977 saying that on that  date  she\t was<br \/>\neligible  to  be  appointed as Reader  having  fulfills\t the<br \/>\nqualifications prescribed for appointment of the Reader\t re-<br \/>\nferred to above.  According to us the second part of Rule  6<br \/>\nhas  not been read in its proper &#8220;text and spirit either  by<br \/>\nthe State Government or by the Tribunal.  In the said Rule 6<br \/>\nemphasis  is not on the eligibility for the post but on\t the<br \/>\n&#8220;period\t of  continuous\t service rendered  by  them  in\t the<br \/>\ncorresponding  posts.&#8221; In other words, the period for  which<br \/>\nthe  persons who are being absorbed had rendered  continuous<br \/>\nservice in the corresponding posts.  Out of such period only<br \/>\nthat period will be taken into consideration, since when the<br \/>\npersons\t concerned were eligible to be appointed  under\t the<br \/>\nrecruitment rules of the Government then in force, This\t can<br \/>\nbe illustrated by giving an example.  In one case, a  person<br \/>\nwithout a post-graduate degree might have been appointed  as<br \/>\na  Reader  in a Non-Government College and lie\tobtains\t the<br \/>\npost-graduate  degree  later, Similarly, in another  case  a<br \/>\nperson\tmight have been appointed as a Reader without  three<br \/>\nyears&#8217;\texperience, as a Registrar or Lecturer in a  private<br \/>\ninstitution.   While  absorbing such person after  the\ttake<br \/>\nover,  only  the continuous service rendered by him  in\t the<br \/>\ncorresponding  post  shall  be\ttaken  into  account   which<br \/>\ncommences  from\t the  date he fulfilled\t all  the  requisite<br \/>\nqualifications\tfor being appointed to the post\t of  Reader.<br \/>\nRule  6 does not purport to give any notional  or  fictional<br \/>\nseniority  as a Reader.\t It need not be pointed out that  if<br \/>\nthis  interpretation of Rule 6 is accepted the\tteachers  of<br \/>\nthe   non-government  medical  colleges\t shall\taffect\t the<br \/>\nseniority  of the persons who had already been appointed  as<br \/>\nReaders\t in  Government Medical Colleges.  In a\t series\t of&#8217;<br \/>\njudgments of this Court, fixation of seniority by conferring<br \/>\nnotional seniority has been deprecated.\t In this connection,<br \/>\nit  will  be  suffice  to  refer  to  the  judgment  of\t the<br \/>\nConstitution  Bench in the case of Direct Recruit  Class  11<br \/>\nEngineering Officers&#8217; Association  v.  State of\t Maharashtra<br \/>\nand others     1990  (2)  SCC 715, where it is\tstated\tthat<br \/>\nonce an incumbent is appointed to a post according to  rule,<br \/>\nhis  seniority\thas  to\t be counted from  the  date  of\t his<br \/>\nappointment.   Even the claim that seniority was  linked  to<br \/>\nthe  date  of  confirmation  was  negatived.   We  do\tnot,<br \/>\ntherefore. understand how any notional seniority could\thave<br \/>\nbeen conferred by the State Government with reference to the<br \/>\ndate  of eligibility, although such person was\tnot  holding<br \/>\nany such post either by direct recruitment or by  promotion.<br \/>\nIn  the\t present case, there is no dispute  that  respondent<br \/>\nnever held<br \/>\n<span class=\"hidden_text\">523<\/span><br \/>\nthe  post of Registrar in the Department of  Obstetrics\t and<br \/>\nGynaecology any time period to 2.7.1979 when the college was<br \/>\nunder  the  management of the Corporation.  Hence  her\tmere<br \/>\neligibility  on\t 19.1.1977  to be  appointed  as  Registrar,<br \/>\ncannot be a ground to antedate her promotion as a Reader, so<br \/>\nas  to\taffect\tseniority of the  appellant,  who  had\tbeen<br \/>\nappointed  as a Reader in the Department of  Obstetrics\t and<br \/>\nGynaecology  at Government Medical College, Nagpur,  by\t the<br \/>\nGovernment  Order dated 6.10.1977 which post she had  joined<br \/>\non II. 10. 1977.  The object of changing the date of senior-<br \/>\nity as Reader, so far as respondent is concerned, appears to<br \/>\nbe to make her senior to the appellant.\t This benefit  could<br \/>\nnot  have  been conferred on her, even if she was  from\t the<br \/>\nvery  beginning in any of the Government Colleges.   In\t the<br \/>\nprocess\t of absorption, she cannot affect the  seniority  of<br \/>\nthose, who were already in the cadre of the State Government<br \/>\nas Readers.\n<\/p>\n<p>8.   Hence, the appeal is allowed and the impugned seniority<br \/>\nlist, so far it fixes the seniority of the respondent w.e.f.<br \/>\n19.1.1977, is quashed.\n<\/p>\n<p>9.   The  appeal  arising out of SLP (C) No.  1629  of\t1994<br \/>\nwhich had been filed on behalf of the appellant, questioning<br \/>\nthe  validity  of  the Order  promoting\t the  respondent  as<br \/>\nProfessor  in the Department of Obstetrics and\tGynaecology,<br \/>\non  the\t basis\tof  the aforesaid  seniority  list  is\talso<br \/>\nallowed,  The State Government is directed to work  out\t the<br \/>\npromotion  to  the  post  of  Professor\t of  Obstetrics\t and<br \/>\nGynaecology  taking  into  consideration  the  case  of\t the<br \/>\nappellant  and the respondent with reference to their  inter<br \/>\nse  seniority  as  determined  above.\tIn  the\t facts\t and<br \/>\ncircumstances  of  the case, there will be no  order  as  to<br \/>\ncosts.\n<\/p>\n<p><span class=\"hidden_text\">524<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Dr. (Mrs.) Pushpa Vishnu Kumar &#8230; vs State Of Maharashtra &amp; Ors on 14 February, 1995 Equivalent citations: 1995 AIR 1346, 1995 SCC Supl.
