DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 13\/05\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>Heard<br \/>\n\tlearned counsel for the parties.\n<\/p>\n<p>This<br \/>\n\tpetition is directed against the order of detention dated 21.11.2009<br \/>\n\tpassed by the respondent No.1 in<br \/>\n\texercise of powers conferred under Section 3(2) of the Gujarat<br \/>\n\tPrevention of Anti Social Activities Act, 1985 (for short &#8220;the<br \/>\n\tAct&#8221;) by detaining the lady-detenue as a &#8220;bootlegger&#8221;<br \/>\n\tas defined under Section 2(b) of the Act.\n<\/p>\n<p>Learned<br \/>\n\tcounsel for the detenue submits that order of detention impugned in<br \/>\n\tthis petition deserves to be quashed and set aside on the ground<br \/>\n\tthat 3 incidents alleged against the detenu<br \/>\n\tare not of such magnitude and intensity as to have the effect of<br \/>\n\tdisturbing the public order so as to pass an order under Section<br \/>\n\t3(1) of the PASA Act. He has further submitted that the detaining<br \/>\n\tauthority has not applied his mind to the vital facts and there was<br \/>\n\tnon-application of mind before recording the order of detention. In<br \/>\n\tsupport of the above contention, the<br \/>\n\tlearned counsel has relied upon the following case-laws:\n<\/p>\n<p>Judgment<br \/>\n\tand order dated 22.8.2000 of the Division Bench of this Court<br \/>\n\t(Coram: M.R. Calla &amp; R.R. Tripathi, JJ.), in Letters Patent<br \/>\n\tAppeal No.223 of 2000 in Special Civil Application No.554 of 2000<br \/>\n\t<a href=\"\/doc\/362856\/\">(Ashok Balabhai Makwana vs. State of Gujarat)<\/a>;\n<\/p>\n<p><a href=\"\/doc\/193102690\/\">Piyush<br \/>\n\tKantilal Mehta vs. Commissioner of<\/a> police, AIR 1989 Supreme Court<br \/>\n<span class=\"hidden_text\">\t491<\/span><\/p>\n<p><a href=\"\/doc\/195612027\/\">Om<br \/>\n\tPrakash vs. Commissioner of Police and others<\/a>, JT 1989 (4) SC 177<\/p>\n<p>Kanuji<br \/>\n\tS. Zala vs. state of Gujrat ando thers, 1999 (2) GLH 415.\n<\/p>\n<p>Learned<br \/>\n\tAGP for the respondent-State supported the detention order passed by<br \/>\n\tthe authority and submitted that sufficient material and evidence<br \/>\n\twas found during the course of investigation, which was also<br \/>\n\tsupplied to the detenue, indicating that the detenue is in the habit<br \/>\n\tof indulging into activities as defined under Section 2(b) of the<br \/>\n\tAct and, considering the facts of the case, the detaining authority<br \/>\n\thas rightly passed the order of detention and the detention order<br \/>\n\tdeserves to be upheld by this Court.\n<\/p>\n<p>Having<br \/>\n\theard learned counsel for the parties and considering the facts and<br \/>\n\tcircumstances of the case, it appears that the subjective<br \/>\n\tsatisfaction arrived at by the detaining authority cannot be said to<br \/>\n\tbe legal, valid and in accordance with law inasmuch as the offences<br \/>\n\talleged in the four  FIRs cannot have any bearing on the public<br \/>\n\torder since the law of the land i.e. Indian Penal Code and other<br \/>\n\trelevant penal laws are sufficient enough to take care of the<br \/>\n\tsituation and that the allegations as have been levelled against the<br \/>\n\tdetenue cannot be said to be germane for the purpose of bringing the<br \/>\n\tdetenue within the meaning of Section 2(b) of the Act unless and<br \/>\n\tuntil the material is there to make out a case that the person<br \/>\n\tconcerned has become a threat and a menace to the society so as to<br \/>\n\tdisturb the whole tempo of the society and that the whole social<br \/>\n\tapparatus is in peril disturbing the public order at the instance of<br \/>\n\tsuch person.  In view of the ratio laid down by the Hon&#8217;ble Supreme<br \/>\n\tCourt in the decisions cited by the learned counsel for the<br \/>\n\tpetitioner, the<br \/>\n\tCourt is of the opinion that the activities of the detenue cannot be<br \/>\n\tsaid to be dangerous to the maintenance of the public order and at<br \/>\n\tthe most fall under the maintenance of &#8220;law and order&#8221;.\n<\/p>\n<p>In<br \/>\n\tthe result, this Special Civil Application is allowed. The impugned<br \/>\n\torder 21.11.2009 of detention  passed by respondent No.1 is hereby<br \/>\n\tquashed and set aside.  The detenue is ordered to be set at liberty<br \/>\n\tforthwith if not required in any other case.  Rule is made absolute<br \/>\n\taccordingly. Direct service is permitted.\n<\/p>\n<p>(ANANT S.
