MN \u00bb udiu\n\nDespite the advance payeent made 'by cthe V\nrespondent, the petitioner failed te sdppiy the pigi\nSet as agreed. upon and in.pthQh1\u00e9irCumgtencee,tptheif\nrespondent demanded to retdrn bf thered\u00a7ence emount\nof Rs.2,oo,ooo-00  ReV;\"4dV,ooo~oo.\nAccordingly, the petiticeer ieeugg g cheque bearing\nNo.244926   iv a sum of\nRs.2,40,000+dO\ufb02drewh ent\u00e9\u00e9pera hank for discharge of\nthe debtaduelfextheareependentxd\n\nThe tr\u00e9epondentr'preeented the said cheque for\n\npayment to ahis ibankerk and the said cheque was\n\nnoe\u00a2e,,\u00abeet'ee \u00e9'2\",'o5.2oo3 by regietered post to the\n\n\n\n4\n\ncomplaint against the petitioner requesting to take\n\naction under Section 138 of the Act.\n\nin pursuance of the summons issued, 'theii\n\npetitioner appeared before them er;g1_,\u00a2og;: ,ana'\n\nduring the Trial, the respondenthr\ufb01as ienamined\",as_\n\nP.W.1 and got marked the docnmentsiE3s;E1oter?:'\ufb01Thei'V\n\npetitioner was examined as D,\ufb01}i_and did\"\ufb02Q\u00a7\ufb01froduce\nany documentary evidence{\\_idThemririal Court on\nappreciation of Wthe znateriai. on irecord, convicted\nthe petitioner for the oftence nnder Section 138 of\nthe Act and  of Rs.3,50,000-00\nand also sentenced. to 'nnderoo simple imprisonment\nfor one fear and in defa\ufb01lt of payment of the fine,\n\nto undergo simglevimerisonment for six months. The\n\n('1'tr:-j_a1{._f:oz;s:t'--- zdirectiediv to pay Rs.3,25,000-00 to the\n\nreseondent as compensation and to credit the rest of\n\niii.\u00bb the amount to the State as fine. Aggrieved by the\n\nhu_ conviction; and the sentence, the petitioner\n\n\"\u00ab approached the Sessions Court in Cri.A. No.936\/2005.\n\ni;_ the said appeal was heard on merits and confirming\n\n'=\u00a7A\u00e9\" conviction of the petitioner for the offence\n\n'under Section 138 of the Act modifying the sentence\n\nenhancing the fine amount to Rs.4,50,000\u00ab0O and set\n\n\n\nadvance amount of Rs.2,00,GOG--0O with a condition\n\nthat the Q.G.Set was to be supplied within a period\n\nof 2 weeks from the date of payment of themedegncedu\n\namount and on failure, an amount of Rs.\u00a7O,QGQ\u00a5QQ ha3d*V\n\nto be paid as penalty for breach of the contractl_\n\nOn going through the evidence it has been ind hy the\ncomglainant and. also the e\ufb01idence of. \ufb01;\u00a7Ll;n there\nappears to be no serious di\ufb01\u00e9kfg \ufb01g reg\u00e9rds olacing\nof the Order for a'DQ$iSet; ,\u00a7\ufb01dfd payment of\nRs.2,oo,ooo\u00bboe _as; an faatateiofa\ufb01g\ufb01nti and further\nbreach of the tgtttttt pf*the oetitioner. So, in\nthe circumstances: as redards the contract between\nthe partiesris tp\ufb01ttrtteivgs the petitioner failed\n\nto give theVp;G,$et within the time fixed, he was\n\ntg pay as 2,4o,ooQ\u00e9Oo and it is in this context that\n\n\"the ',\u00a7etitioner had issued a cheque for\n\nRsi2g4Q,G0u%QQ iini favour of the respondent. The\n\n'ihsaid Acheque' has been produced at Ex.P1 and the\n\n~.f3ignature of the accused is also not in dispute. It\n\n'&lt; is thereefter the respondent presented the cheque to\n\nhiithe bank and the bank endorsement has been produced\n\nih&#039;\u00bbatf Ex.P2. The said cheque was returned with an\n\nd. endorsement of &quot;insufficient funds&quot;. Ex.P3 is the\n\nslip and EX.?4 is the copy of the notice issued to\n\n\n\nAward of fine of Rs.25,000~OO is on higher side and\n\nit may be reduced.\n\n8. The learned counsel for the? \ufb01etitiener .\nsubmits that an amount of Rsg2}50,Q&amp;deeei1\ufb01\u00e9evi\ufb01een\ndeposited in the Triai Court and the said a\ufb01ou\ufb01E*\u00a7aad\nwithdrawn by the respondent and further an a\ufb01ount oft\nRs.S0,000--OO is paidf to~daydwthr0ughd&#039;banker\u00a7 cheque\nNo.152994 drawn on dI5ICIi BanEV dated 03.11.2068,\nthereby the petitienerdnhash_to:d@a\u00a7hfthe remaining\namount of Re\u00e9$d;uQ0edO ,te tired respondent and he\nprays for t\u00a79;aa\u00a7t\ufb01\u00a7 tide fer Qayment of the same.\nSo far as the fine aeoent_is eoncerned, I think it\nwould be just and peapar to reduce the fine amount\n\nto Rs,20,00d*QD;_d In &#039;the Circumstances, I answer\n\n5 point Nogl in affirmative and point No.2 partly in\n\naffireatiye and partly in negative and proceed to\n\n&#039;d=Vi pass the feilo\ufb01ingz\n\nORDER\n<\/pre>\n<p>r The petition is allowed in part. The<\/p>\n<p>veetitioner is ordered to pay the compensation amount<\/p>\n<p>&#8220;5f Rs.3,70,000~OG and out of the said amount, he<\/p>\n<p>shall pay Rs.3,50,000&#8211;GO to the respondent herein<\/p>\n<p>aid<\/p>\n<p><span class=\"hidden_text\">10<\/span><\/p>\n<p>and credit Rs.20,000~0O ix: th@ State.
