              Learned counsel for the State vehemently
\nargued that respondent-workman is not entitled for
\nequal pay for equal work on the post of Chowkidar
\nas ordered by the Judge, Labour Court because with
\nopen    eyes    he    has   accepted     appointment on       daily
\nrate basis and later on after his termination from
\nservice, he has raised an industrial dispute with
\nregard to grant of regular pay scale for the post
\nof Chowkidar. It is further argued that no case is
\nmade out in favour of respondent-workman on the
\nbasis    of     evidence      produced    by     him    before    the
\nJudge, Labour Court.            However, learned Judge has
\ncommitted an error of law while granting regular
\npay scale to the respondent-workman for the post
\nof     Chowkidar       knowingly       well    that    respondent-
\nworkman himself accepted appointment at the rate
\nof Rs.22\/- per day when he was engaged by the
\npetitioner-department.\n<\/p>\n
              Learned counsel for the State has invited
\nattention       of     this    Court     towards       the   recent
\njudgment       of    Hon’ble   Supreme        Court    rendered   in
\n                                       4<\/span><\/p>\n
Secretary,        State        of    Karnataka        Vs.    Uma    Devi    ,
\nreported in 2006 (4) SCC 1 in which the Hon’ble
\nApex    Court     has   held         that    without        any    post    no
\nperson is entitled for regular wages, so also, if
\nany    appointment        is    made        without       following       the
\nprocedure of law then also he is not entitled to
\nbe regularized on the post. Although in para 53 of
\nthe said judgment, it is observed that matter of
\nregularization          after completion of ten years of
\nservice      is   to      be    considered           by     the     Central
\nGovernment,       State    Government          and     instrumentality
\nof State and for that purpose they are required to
\ntake proper steps for the employees who have been
\nappointed irregularly.\n<\/p>\n
             In this view of the matter, I am of the
\nopinion that the award passed by the Judge, Labour
\nCourt   in    Industrial            Dispute    No.38\/99         dated     14th
\nNovember,       2002    granting            regular       pay     scale    to
\nrespondent-workman on the post of Chowkidar for
\nthe service tenure rendered by him w.e.f. 21st May,
\n1991 to 20th October, 1995 is contrary to evidence
\nand    illegal.    Accordingly,              the   writ     petition       is
\nallowed and the award passed by the Judge, Labour
\nCourt   in    Industrial            Dispute    No.38\/99         dated     14th
\nNovember, 2002 is hereby quashed and set aside.
\nHowever, the respondent-workman is held entitled
\n                                   5<\/span><\/p>\n
        for the wages as per prevailing rates paid by the
\n        department   to   similarly   employed   employee.   No
\n        order as to costs.\n<\/p>\n
