Justice R.BASANT\n\n Dated :20\/02\/2007\n\n O R D E R\n                                 R.BASANT, J\n\n                              ----------------------\n\n                          Crl.M.C.No.427 of 2007\n\n                        ----------------------------------------\n\n               Dated this the 20th day of February  2007\n\n\n\n\n                                   O R D E R\n<\/pre>\n<p>      The   petitioner   faces   indictment   in   a   prosecution   under<\/p>\n<p>Section    420  I.P.C.   Cognizance has been  taken  on  the basis of<\/p>\n<p>the   final   report   submitted   by   the   police   after   investigation.     A<\/p>\n<p>warrant   of   arrest   has   been   issued   against   the   petitioner.     The<\/p>\n<p>petitioner  has  not appeared before the learned  Magistrate.   He<\/p>\n<p>filed an application for anticipatory bail which was dismissed by<\/p>\n<p>the   learned   Sessions   Judge   vide   order,   a   copy   of   which   is<\/p>\n<p>produced along with this petition.\n<\/p>\n<p>      2.     The   petitioner   now   wants   to   surrender   before   the<\/p>\n<p>learned Magistrate.   He apprehends that his application for bail<\/p>\n<p>may  not   be   considered   by   the   learned   Magistrate   on   merits,   in<\/p>\n<p>accordance  with  law  and  expeditiously.    He   has  hence   come  to<\/p>\n<p>this court with the prayer that the direction under Section   482<\/p>\n<p>Cr.P.C   may   be   issued   to   the   learned   Magistrate   to   release   the<\/p>\n<p>petitioner on bail when he appears and applies for bail.\n<\/p>\n<p>      3.     It   is   for   the   petitioner   to   appear   before   the   learned<\/p>\n<p>Magistrate   and   explain   to   the   learned   Magistrate,   the<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.427\/07                       2<\/span><\/p>\n<p>circumstances   under   which   he   could   not   earlier   appear   before<\/p>\n<p>the learned Magistrate.\n<\/p>\n<p>       4.    I find absolutely no reason to assume that the learned<\/p>\n<p>Magistrate would not consider the application for bail to be filed<\/p>\n<p>by   the   petitioner   on   merits,   in   accordance   with   law   and<\/p>\n<p>expeditiously.     Every   court   must   do   the   same.     No   special   or<\/p>\n<p>specific   directions   appear   to   be   necessary.     Sufficient   general<\/p>\n<p>directions   have   been   issued   in  <a href=\"\/doc\/147290035\/\">Alice   George   vs.   Deputy<\/p>\n<p>Superintendent of Police<\/a> [2003(1)KLT 339].\n<\/p>\n<p>       5.
