MUKHOPADHAYA)<\/p>\n<p>1.\t\tIn<br \/>\nboth the appeals, as common question of law involved, a common order<br \/>\nis under challenge, they were heard together and disposed of by this<br \/>\ncommon order.\n<\/p>\n<p>2.\t\tA<br \/>\nscheme known as Pandit Dindayal Upadhyay Consumers Stores Scheme<br \/>\n(hereinafter referred to as &#8220;the scheme&#8221;) for allotment of<br \/>\nFair Price shop was enacted by the State. Both the appellants<br \/>\nBipinbhai Bhanjibhai Vaghela (hereinafter referred to as &#8220;the<br \/>\npetitioner&#8221;) and Parmar Nandaben Hansrajbhai (hereinafter<br \/>\nreferred to as &#8220;the 3rd respondent&#8221;) applied pursuant to<br \/>\nnotice dated 22nd February, 2005 for allotment of a Fair Price shop.<br \/>\nA Committee  considered the cases of different persons including<br \/>\npetitioner and the 3rd respondent and on its recommendation,<br \/>\nCollector by order dated 29th August, 2005 allotted Fair Price shop<br \/>\nin favour of the petitioner. In an appeal preferred by the 3rd<br \/>\nrespondent before the State, the same was decided in favour of the<br \/>\n3rd respondent by order dated 31st July\/3rd August, 2008. The matter<br \/>\nmoved upto this Court and on remand, the matter having decided<br \/>\nagainst the petitioner and in favour of the 3rd respondent, the<br \/>\npetitioner preferred the writ petition. Learned Single Judge having<br \/>\ndecided the matter against both the petitioner and the 3rd<br \/>\nrespondent, they have preferred two appeals challenging the common<br \/>\norder.\n<\/p>\n<p>3.\t\tThe<br \/>\nscheme stipulates allotment of Fair Price shop in favour of educated<br \/>\nunemployed persons of the village. Both the petitioner Bipinbhai<br \/>\nVaghela and the 3rd respondent  were denied the allotment on the<br \/>\nground that they were in employment.\n<\/p>\n<p>4.\t\tIt<br \/>\nwill be evident from the Scheme that licence for Fair Price shops<br \/>\nwere to be allotted in favour of educated unemployed with a view to<br \/>\ngive alternative employment to such persons. Under clause 2(9)(i) of<br \/>\nthe Scheme, educated unemployed means a person having minimum<br \/>\nqualification of S.S.C. or equivalent and have no job or employment<br \/>\nor no income whatsoever in nature, subject to age limit of 35 years.\n<\/p>\n<p>5.\t\tAdmittedly,<br \/>\nthe petitioner Bipinbhai Vaghela was employed as Bus conductor in<br \/>\nTransport Corporation as on 22nd February, 2005, that is, the date<br \/>\napplications were called for.  He was transferred and relieved on<br \/>\n30th November, 2004. When the recommendation and order of allotment<br \/>\nwas made in his favour on 29th August, 2005, he was in service of<br \/>\nTransport Corporation as Bus conductor. It is only after allotment of<br \/>\nthe Fair Price shop, he resigned from the post which was accepted on<br \/>\n10th July, 2007.\n<\/p>\n<p>6.\t\tCounsel<br \/>\nfor the petitioner submitted that the petitioner being a daily wager<br \/>\nBus conductor, cannot be said to be in employment. For all purpose,<br \/>\nhe was educated unemployed. But such submission cannot be accepted<br \/>\nfor the reasons discussed hereinunder.\n<\/p>\n<p>7.\t\tThe<br \/>\n3rd respondent Nandaben Parmar in whose favour Appellate Authority<br \/>\nordered to allot Fair Price shop was educated unemployed woman as on<br \/>\nthe date of advertisement, i.e. 22nd February, 2005. She was not<br \/>\nprovided with allotment when Collector passed order in favour of the<br \/>\npetitioner Bipinbhai Vaghela on 29th August, 2005 though the 3rd<br \/>\nrespondent Nandaben Parmar was unemployed. Even on the date the<br \/>\nAppellate Authority passed order in her favour, she was unemployed.<br \/>\nSubsequently, when the matters were pending, by an order dated 17th<br \/>\nOctober, 2006, Taluka Development Officer, Rajkot asked her to<br \/>\nfunction as &#8220;Computer Sahasik&#8221;. Though she was asked to<br \/>\nwork, but she was not paid salary or commission for the work. This<br \/>\nfact has not been disputed   by the respondents.\n<\/p>\n<p>8.\t\tThe<br \/>\nquestion of gainful employment came for consideration before the<br \/>\nSupreme Court  in the case of North-East Karnataka Road Transport<br \/>\nCorporation vs. M.Nagangouda, in (2007) 10 SCC, 765  where the<br \/>\nSupreme Court held as follows:\n<\/p>\n<p>&#8220;17.\t\tOn<br \/>\nthe said question, we are unable to accept the reasoning of the<br \/>\nLabour Court that the income received by the respondent from<br \/>\nagricultural pursuits could not be equated with income from gainful<br \/>\nemployment in any establishment. In our view, &#8220;gainful<br \/>\nemployment&#8221; would also include self-employment wherefrom income<br \/>\nis generated. Income either from employment in an establishment or<br \/>\nfrom self-employment merely differentiates the sources from which<br \/>\nincome is generated, the end use being the same. Since the respondent<br \/>\nwas earning some amount from his agricultural pursuits to maintain<br \/>\nhimself, the Labour Court was not justified in holding that merely<br \/>\nbecause the respondent was receiving agricultural income, he could<br \/>\nnot be treated to be engaged in &#8220;gainful employment&#8221;.\n<\/p>\n<p>Same view was taken by the Supreme Court in Niranjan Cinema vs.<br \/>\nPrakash Chandra Dubey and another, reported in (2007) 14 SCC 349,<br \/>\nwherein the Court held that gainful employment also includes<br \/>\nself-employment as income is generated from that source.\n<\/p>\n<p>9.\t\tIn<br \/>\nthe present case, it will be  evident that the petitioner was in<br \/>\nemployment of Transport Corporation though his status may be that of<br \/>\na daily wager. He was transferred to another place and thereby<br \/>\nrelieved on 30th November, 2004, but was not thrown out of service.<br \/>\nHe filed resignation letter only after grant of Fair Price Shop<br \/>\nlicence, which was accepted on 10th July, 2007. Therefore, as on the<br \/>\ndate of advertisement 22nd February, 2005, he was in employment and<br \/>\nthereby  not eligible for grant of licence in his favour. We uphold<br \/>\nthe order passed by the Appellate Authority so far as the petitioner<br \/>\nis concerned.\n<\/p>\n<p>10.\t\tSo<br \/>\nfar as  3rd respondent is concerned, admittedly, she was not in<br \/>\nemployment on 22nd February, 2005 and was fulfilling all other<br \/>\nconditions. She preferred an appeal challenging the allotment in<br \/>\nfavour of the petitioner and also prayed for allotment in her favour.<br \/>\nIn the meantime, by order dated 17th October, 2006, she was asked to<br \/>\nperform work of Computer Sahasik, but was not paid either salary or<br \/>\ncommission for the said work. Therefore, it would be evident that the<br \/>\n3rd respondent, as on the date of advertisement  was unemployed and<br \/>\nwas otherwise qualified for grant of such licence, and even on the<br \/>\ndate the Appellate Authority decided the case in her favour, she was<br \/>\nnot in employment as she was asked to perform work as Computer<br \/>\nSahasik but was not getting salary or commission.  The learned Single<br \/>\nJudge, though noticed the aforesaid fact,  failed to give any reason<br \/>\nfor coming to a conclusion that the 3rd respondent was also not<br \/>\nentitled for allotment of Fair Price shop.\n<\/p>\n<p>11.\t\tFor<br \/>\nthe aforesaid reasons, while upholding the totality of the order<br \/>\ndated 31st July, 2007\/3rd August, 2007 passed by the Appellate<br \/>\nAuthority in Appeal No. 164 of 2005, we hold that the order of the<br \/>\nlearned Single Judge dated 10th July, 2009 so far as it relates to<br \/>\nthe 3rd respondent is illegal. The order to that extent is set aside.\n<\/p>\n<p>12.\t\tIn<br \/>\nthe result, Letters Patent Appeal No. 1476 of 2009 and Civil<br \/>\nApplication No. 8240 of 2009 are dismissed and Letters Patent Appeal<br \/>\nNo. 2107 of 2009 is allowed.
