The appellants are the original petitioners.  Before the<br \/>\nlearned Single Judge, they had challenged the judgment and order<br \/>\ndated 26.2.2007 passed by the Gujarat Revenue Tribunal in Revision<br \/>\nApplication No. TEN\/BA\/1481\/84.\n<\/p>\n<p>2.\tThe<br \/>\nissue pertains to tenancy rights claimed by the petitioner over the<br \/>\nsuit lands.  The issue after one round of litigation was remitted to<br \/>\nthe Revenue Tribunal for reconsideration by the High Court.  Upon<br \/>\nreconsideration, by judgment and order dated 26.2.2007, the revision<br \/>\napplication was allowed.  The orders passed by the Mamlatdar &amp;<br \/>\nALT and the Deputy Collector holding the present<br \/>\nappellants as the tenants of the suit lands were set aside.  This<br \/>\ndecision was challenged before the learned Single Judge.  The learned<br \/>\nSingle Judge by the impugned order found that the Tribunal has<br \/>\nconsidered the questions of fact and applied correct principles and<br \/>\nthe learned Single Judge, therefore, was of the opinion that no<br \/>\ninterference under Articles 226 and 227 of the Constitution was<br \/>\ncalled for.  It is this decision which is impugned before us in the<br \/>\npresent Letters Patent Appeal.\n<\/p>\n<p>3.\tHaving<br \/>\nheard the learned counsel for the appellants and having perused the<br \/>\nmaterials on record, we find that the Gujarat Revenue Tribunal had<br \/>\nmade detailed analysis of the evidence on record.  After considering<br \/>\nthe materials, the Tribunal found that the case of the appellants<br \/>\nwith respect to the tenancy of the suit lands cannot be accepted.<br \/>\nThe learned Single Judge also perused the materials and took into<br \/>\nconsideration the orders passed by various authorities and in<br \/>\nparticular the order of the Gujarat Revenue Tribunal and came to the<br \/>\nconclusion that the decision of the Revenue Tribunal suffered from no<br \/>\ninfirmity.\n<\/p>\n<p>4.\tIn<br \/>\nparticular, it was found that the Mamlatdar &amp; ALT as well as the<br \/>\nDeputy Collector had relied on certain affidavits, original of which<br \/>\nwere not on record.  The Tribunal found that the same cannot form the<br \/>\nbasis for giving a valid finding in favour of the appellant.  The<br \/>\nTribunal also found that such evidence would not be reliable.\n<\/p>\n<p>5.\tWhen<br \/>\nthe Gujarat Revenue Tribunal came to the factual findings and the<br \/>\nlearned Single Judge found no error in such factual findings, in<br \/>\nexercise of the appellate powers, we see no reason to interfere with<br \/>\nthe same.  The Tribunal examined various materials and found that the<br \/>\nappellant had not established tenancy rights over the land in<br \/>\nquestion. We see no error having been committed by the learned Single<br \/>\nJudge and having found no infirmity in the impugned judgment, we<br \/>\ndismiss the appeal.  Consequently, the Civil Application is also<br \/>\ndismissed.\n<\/p>\n<p>[S.\n<\/p>\n<p>J.
