He submitted that before he has to produce similar<br \/>\ncertificate for another witness, it is necessary that the present<br \/>\npetition is heard and grant of necessary relief is considered.\n<\/p>\n<p>3.\tLearned<br \/>\nadvocate for the petitioners invited attention of the Court to the<br \/>\ncontents of an application given by one Smt.Shusma G.Dalal to the<br \/>\nlearned Civil Judge (S.D.), Bharuch dated 14.06.2009, wherein the<br \/>\nreasons are set out as to why it is not possible for her to come to<br \/>\nthe Court.  It is also mentioned in the said application that the<br \/>\nwitnesses are ready and willing to cooperate with the Court and are<br \/>\nready to get their evidence recorded, if a Court Commissioner is<br \/>\nappointed.\n<\/p>\n<p>3.1\tLearned<br \/>\nadvocate for the petitioners invited attention of the Court to the<br \/>\ncontents of application Exh.178 and the order passed below the same.<br \/>\nHe vehemently submitted that only because the Court Commissioner is<br \/>\nnot going to record the demeanor of the witnesses, is no ground for<br \/>\nnot passing an order of appointment of Court Commissioner.\n<\/p>\n<p>\tThe<br \/>\nsubmissions of the learned advocate for the petitioners are not found<br \/>\nto be acceptable.  The learned Judge has recorded in its order dated<br \/>\n14.06.2009 that as the witnesses have not pleaded to the effect that<br \/>\nthey are not able to discharge their daily routine and that they are<br \/>\nnot bedridden, the request of appointment of Court Commissioner for<br \/>\nrecording the evidence cannot be considered favourably.\n<\/p>\n<p>4.\tLearned<br \/>\nadvocate for the petitioners relied upon a decision of the Hon&#8217;ble<br \/>\nthe Apex Court in the matter of M\/s.Filmistan Private Ltd.,<br \/>\nBombay Vs. M\/s.Bhagwandas Santprakash &amp; Anr.,<br \/>\nreported<br \/>\nin AIR 1971 SC 61,<br \/>\nwherein the Hon&#8217;ble the Apex Court had an opportunity to consider the<br \/>\nprovisions of Section 75 of the Code of Civil Procedure, 1908 and in<br \/>\npar-2, the Court observed as under:-\n<\/p>\n<p> 2.\tAdmittedly<br \/>\nthe witnesses sought to be examined at Kabul are relevant witnesses.<br \/>\nAll of them are living out side the jurisdiction of the Court and<br \/>\nhence they are not amenable to the process of the Court.  It was said<br \/>\non behalf of the appellant that one of the witnesses sought to be<br \/>\nexamined is an agent of the 1st defendant and therefore that<br \/>\ndefendant could have produced him in Court for examination.  As<br \/>\nregards the other witnesses, it was said that the facts that they<br \/>\nwere expected to depose could have been established by other<br \/>\nevidence.  We have no doubt that these facts must have been<br \/>\nconsidered by the learned trial Judge.  The order under appeal is<br \/>\nessentially a discretionary order.  We do not think that a case is<br \/>\nmade out for interfering with the discretion of the learned trial<br \/>\nJudge.  The fact that the witnesses examined on commission cannot be<br \/>\neffectively cross-examined or their examination will entail heavy<br \/>\ncosts are not sufficient circumstances to interfere with the<br \/>\ndiscretion of the learned trial Judge.\n<\/p>\n<p>\tIn<br \/>\nthe considered opinion of this Court, this decision has no<br \/>\napplication to the facts of the present case.  It is true that it is<br \/>\nthe power of the Court to exercise discretion in the matter of<br \/>\ngranting prayer to the effect that the evidence should be recorded by<br \/>\nappointment of Court Commissioner or not.  In the present case, the<br \/>\nCourt has found, on facts, that the circumstances are not such which<br \/>\nwill warrant an order of appointment of Court Commissioner to record<br \/>\nevidence.\n<\/p>\n<p>5.\tIn the<br \/>\nresult, the petition fails and the same is dismissed.  Notice is<br \/>\ndischarged.  Ad interim relief granted earlier is vacated.
