SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 24\/07\/2008 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tIt<br \/>\nprima facie appears from the impugned order passed by the trial court<br \/>\npassed below Exh.5 in Special Civil Suit No.158 of 2003 that there is<br \/>\nno specific finding and\/or discussion by the trial court with respect<br \/>\nto possession. Under the circumstances and with the consent of the<br \/>\nlearned advocates appearing on behalf of the respective parties, the<br \/>\nimpugned order passed by the trial court passed below Exh.5 in<br \/>\nSpecial Civil Suit No.158 of 2003 is hereby quashed and set aside.\n<\/p>\n<p>2.\tShri<br \/>\nDhaval D.Vyas, learned advocate appearing on behalf of the<br \/>\nrespondents No.1 to 7 has submitted that the aforesaid statement made<br \/>\nby him is under the instructions of  his client.  In view of this,<br \/>\nthe matter is remanded to the trial court for deciding the<br \/>\napplication Exh.5 afresh in accordance with law and on merits, and as<br \/>\nthe suit is of the year 2003, the trial court is directed to decide<br \/>\nand dispose of the application Exh.5  within a period of three months<br \/>\nfrom the date of receipt of writ of this order or on production of<br \/>\nthe certified copy of the present order.  It is observed that this<br \/>\nCourt has not expressed any opinion  in favour of either parties and<br \/>\nthe trial court to decide and dispose of application Exh.5 without in<br \/>\nany way being influenced by the present order.\n<\/p>\n<p>3.<br \/>\n With these, present appeal from order is disposed of.\n<\/p>\n<p>4.\tIn<br \/>\nview of disposal of appeal from order, no order in civil application.\n<\/p>\n<p>(<br \/>\nM.R.
