SHARFUDDIN ANSARI\n                                          Versus\n                               THE STATE OF BIHAR\n                                        -----------\n<\/pre>\n<p>2   25.04.2011                Heard learned counsels for the petitioner and<\/p>\n<p>                 the State.\n<\/p>\n<p>                              The    petitioner    being     the   husband   is<\/p>\n<p>                 apprehending his arrest in a complaint case in which<\/p>\n<p>                 cognizance has been taken under Sections 498A and<\/p>\n<p>                 323\/34 of the Indian Penal Code.\n<\/p>\n<p>                              Learned counsels for the petitioner and the<\/p>\n<p>                 complainant, on instructions, submit that both sides are<\/p>\n<p>                 ready for resumption of conjugal life.<\/p>\n<p>                              In that view of the matter, let both, petitioner<\/p>\n<p>                 and the complainant, appear before the learned court<\/p>\n<p>                 below on 9th of May, 2011 when the petitioner will take<\/p>\n<p>                 the complainant to her matrimonial house to keep her<\/p>\n<p>                 as wife with full dignity and honour.<\/p>\n<p>                              Considering the aforesaid facts, let the above<\/p>\n<p>                 named        petitioner,   be    released    on    provisional<\/p>\n<p>                 anticipatory bail for six months, in the event of his<\/p>\n<p>                 arrest or surrender before the learned Court below<br \/>\n<span class=\"hidden_text\">                                    2<\/span><\/p>\n<p>             within a period of 12 weeks from today, on furnishing<\/p>\n<p>             bail bond of Rs. 10,000\/- (ten thousand) with two<\/p>\n<p>             sureties of the like amount each to the satisfaction of<\/p>\n<p>             the learned Chief Judicial Magistrate, Vaishali at<\/p>\n<p>             Hajipur in connection with Complaint Case No. C1-<\/p>\n<p>             507\/2010, subject to the conditions as laid down under<\/p>\n<p>             Section 438(2) Cr.P.C.\n<\/p>\n<p>                           The provisional bail of the petitioner will be<\/p>\n<p>             confirmed in two eventualities (i) if the matrimonial<\/p>\n<p>             harmony is substantially restored or (ii) if the<\/p>\n<p>             complainant deliberately refuses to reside with the<\/p>\n<p>             petitioner.\n<\/p>\n<\/p>\n<p>                                             (Dinesh Kumar Singh, J.)<br \/>\nAmrendra\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Md.
