Doshit, CJ.&amp;                     This Letters Patent Appeal preferred under\nShiva Kirti Singh, J.\n<\/pre>\n<p>                             Clause-10 to the Letters Patent is directed against the<\/p>\n<p>                             judgement and order dated 5th August 2008 passed by the<br \/>\n<span class=\"hidden_text\">                    2<\/span><\/p>\n<p>learned Single Judge in C.W.J.C. No. 3982 of 1993. The<\/p>\n<p>matter at dispute is the appointment of the respondent<\/p>\n<p>No.4 &#8211; the writ petitioner as a clerk in Jagjeevan Avodya<\/p>\n<p>Sanskrit College- respondent No.1 (hereinafter referred<\/p>\n<p>to as \u201ethe College\u201f). The College is affiliated to Sri<\/p>\n<p>Kameshwar      Singh   Darbhanga     Sanskrit    University<\/p>\n<p>(hereinafter referred to as \u201ethe University\u201f). The appeal is<\/p>\n<p>preferred by the Vice Chancellor and the Registrar of the<\/p>\n<p>University.\n<\/p>\n<p>          2. It is not in dispute that the writ petitioner<\/p>\n<p>was a student in the College. In the year1974, though a<\/p>\n<p>minor, he was appointed as a clerk in the College. He<\/p>\n<p>continued in service till the year 1993. In the year 1989<\/p>\n<p>or there about a dispute arose whether the writ petitioner<\/p>\n<p>was senior to one Vijay Singh, another clerk in the<\/p>\n<p>College. The writ petitioner claimed that he was<\/p>\n<p>appointed as a Head Clerk while the aforesaid Vijay<\/p>\n<p>Singh, respondent No.3, was appointed as a clerk in the<\/p>\n<p>year 1979. After a round of litigation the matter was<\/p>\n<p>referred to the Vice Chancellor of the University. The<\/p>\n<p>Vice Chancellor under his order dated 16th February<br \/>\n<span class=\"hidden_text\">                   3<\/span><\/p>\n<p>1993 recorded the findings that on the date of his<\/p>\n<p>appointment the writ petitioner was a minor; that the<\/p>\n<p>College did not have a sanctioned post of Head Clerk;<\/p>\n<p>that the writ petitioner had admitted that his appointment<\/p>\n<p>was of 1st July 1977; that the appointment of the writ<\/p>\n<p>petitioner was made without following the due<\/p>\n<p>procedure. In view of the said findings the Principal of<\/p>\n<p>the College was directed to terminate the service of the<\/p>\n<p>writ petitioner with immediate effect. Consequently, the<\/p>\n<p>service of the writ petitioner came to be terminated on<\/p>\n<p>22nd February 1993.\n<\/p>\n<p>           3. Feeling aggrieved he filed CWJC No. 3982<\/p>\n<p>of 1993 under Articles 226 and 227 of the Constitution<\/p>\n<p>of India. In the writ petition the writ petitioner claimed<\/p>\n<p>that the Vice Chancellor had not only made order against<\/p>\n<p>the writ petitioner but he had also recorded findings<\/p>\n<p>against the aforesaid Vijay Singh. Against Vijay Singh<\/p>\n<p>the Vice Chancellor had observed; that his appointment<\/p>\n<p>was of 1st July 1979 but he had produced a forged<\/p>\n<p>appointment letter of 1st July 1969; that the said Vijay<\/p>\n<p>Singh had manipulated a forged approval letter and had<br \/>\n<span class=\"hidden_text\">                   4<\/span><\/p>\n<p>thus perpetrated fraud. The Vice Chancellor had directed<\/p>\n<p>for termination of service of the said Vijay Singh also.<\/p>\n<p>          4. The petition was contested             by     the<\/p>\n<p>University. The University supported the order of the<\/p>\n<p>Vice Chancellor. The University maintained that the<\/p>\n<p>College had no sanctioned post of Head Clerk. The<\/p>\n<p>University   contended    that   appointment      letter   of<\/p>\n<p>respondent No.3 as of 1st July 1969 was doubtful; that<\/p>\n<p>the appointment of the writ petitioner was illegal, made<\/p>\n<p>without the sanctioned post and; that the writ petitioner<\/p>\n<p>had been given due opportunity of hearing before the<\/p>\n<p>Vice Chancellor. The appointment of the writ petitioner<\/p>\n<p>and the respondent No. 3 was made on a non existent<\/p>\n<p>post, that too without following due procedure.<\/p>\n<p>          5. The learned Single Judge held that &#8220;in<\/p>\n<p>absence of any provision of law for the Universities in<\/p>\n<p>Bihar, the provision relating to services of State<\/p>\n<p>Employees would govern the field&#8221;. The learned Judge<\/p>\n<p>relied upon Section 57 of the Bihar Pension Rules that<\/p>\n<p>provides, &#8220;A government servant in inferior service,<\/p>\n<p>shall not begin until the Government servant<br \/>\n<span class=\"hidden_text\">                   5<\/span><\/p>\n<p>concerned attained the age of 16 years&#8221;. In view of<\/p>\n<p>the said provision the learned Single Judge held that<\/p>\n<p>&#8220;the service of a Government servant will count from<\/p>\n<p>the date on which he attains the age of 16 years&#8221;.<\/p>\n<p>Learned Single Judge held that it was unjustified to<\/p>\n<p>terminate the service of the writ petitioner on the ground<\/p>\n<p>that the writ petitioner was below 18 years on the date of<\/p>\n<p>his appointment. Learned Single Judge took into account<\/p>\n<p>25 years of service the writ petitioner had rendered with<\/p>\n<p>the College and that the order of termination of service<\/p>\n<p>was made without notice to the writ petitioner. In view<\/p>\n<p>of the said findings the learned Single Judge quashed the<\/p>\n<p>order of termination of service dated 22nd February 1993.<\/p>\n<p>The writ petitioner was allowed to be continued in<\/p>\n<p>service as a clerk with consequential reliefs. Therefore,<\/p>\n<p>the present appeal.\n<\/p>\n<p>          6. The facts stated hereinabove are not in<\/p>\n<p>dispute. We are informed at the Bar that the college does<\/p>\n<p>not have a sanctioned post of a Head Clerk and that<\/p>\n<p>pending the writ petition a peon in the College has been<\/p>\n<p>promoted as a Clerk and he has been serving as a clerk<br \/>\n<span class=\"hidden_text\">                     6<\/span><\/p>\n<p>till the date.\n<\/p>\n<p>            7. In view of the above facts, it is indisputable<\/p>\n<p>that the writ petitioner had served the college for more<\/p>\n<p>than 20 years and that his service was terminated<\/p>\n<p>unceremoniously, following the order of the Vice<\/p>\n<p>Chancellor. Though we do not agree with the view<\/p>\n<p>expressed by the learned Single Judge that in absence of<\/p>\n<p>the rules to the contrary, provisions relating to the<\/p>\n<p>services of the State Employees shall apply. In our view,<\/p>\n<p>unless the University had adopted the rules governing the<\/p>\n<p>State employees, such rules cannot apply to the<\/p>\n<p>employees of the University as a matter of course. We<\/p>\n<p>also do not agree with the interpretation of Section 57<\/p>\n<p>put forth by the learned Single Judge. The said Section<\/p>\n<p>should only mean that no person can be employed in<\/p>\n<p>inferior service of the State Government unless he has<\/p>\n<p>attained the age of 16 years (as it stood then).<\/p>\n<p>            8. But we agree with the view that notice to<\/p>\n<p>the writ petitioner was required to be given before his<\/p>\n<p>service was terminated. In view of the lapse committed<\/p>\n<p>by the College and the fact that writ petitioner had<br \/>\n<span class=\"hidden_text\">                    7<\/span><\/p>\n<p>rendered more than 20 years of service, we confirm the<\/p>\n<p>order of the learned Single Judge setting aside the order<\/p>\n<p>of termination of service of the writ petitioner. We are,<\/p>\n<p>however, inclined to modify the reliefs granted by the<\/p>\n<p>learned Single Judge.\n<\/p>\n<p>          9.   In view of quashing of the termination<\/p>\n<p>order dated 22nd February 1993 the writ petitioner Sri<\/p>\n<p>Kapildeo Sharma is entitled for reinstatement in service.<\/p>\n<p>The College will, within six weeks from today, reinstate<\/p>\n<p>the writ petitioner in service. The period from the date of<\/p>\n<p>termination of service of the writ petitioner till the date<\/p>\n<p>of his reinstatement in service will be treated as the<\/p>\n<p>period of Extra Ordinary Leave without pay. The<\/p>\n<p>consequences shall follow. In the event the College fails<\/p>\n<p>to reinstate the writ petitioner in service as aforesaid, the<\/p>\n<p>writ petitioner will be entitled to pay and allowances<\/p>\n<p>commencing from 10th August 2010.\n<\/p>\n<p>          10. In view of appointment of Umakant<\/p>\n<p>Choudhary a peon in the College as the Office Clerk, the<\/p>\n<p>College and the University will be at liberty to create a<\/p>\n<p>supernumerary post of Office Clerk to accommodate the<br \/>\n<span class=\"hidden_text\">                                          8<\/span><\/p>\n<p>                      writ petitioner. The College will be at liberty to approach<\/p>\n<p>                      the State Government for creation of supernumerary post<\/p>\n<p>                      of Office Clerk and for release of the salary grant in<\/p>\n<p>                      respect of the writ petitioner.\n<\/p>\n<p>                                 11. Subject to the above directions, the Letters<\/p>\n<p>                      Patent Appeal is disposed of.\n<\/p>\n<p>                                 12. Interim applications stand disposed of.<\/p>\n<p>                                             (R. M.
