PUBLIC PROSECUTOR for\nRespondent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE J.B.PARDIWALA\n\t\t\n\t\n\n \n\nDate : 11\/05\/2011\n \n \nORAL ORDER<\/pre>\n<p>\tRule.\n<\/p>\n<p>Learned APP, Mr Kodekar, waives service of notice of rule for and on<br \/>\nbehalf of State.\n<\/p>\n<p>2.\tThis<br \/>\nis an application under Section 439 of Criminal Procedure Code<br \/>\npraying for regular bail in connection with offence registered with<br \/>\nChhani Police Station, Vadodara vide C.R.No.I-16  of 2011 for the<br \/>\noffences punishable under Sections 306, 498A read with Section 114 of<br \/>\nIPC.\n<\/p>\n<p>3.\tHeard<br \/>\nlearned advocate Mr YJ Patel for the applicant-accused and Mr<br \/>\nKodekar, learned APP for the State. Perused the FIR.\n<\/p>\n<p>4.\tThe<br \/>\naccused-applicant is father-in-law of the deceased. Prima-facie it<br \/>\nappears that the allegations are in general and related to household<br \/>\ndisputes. There are no direct allegations worth the name against the<br \/>\npresent applicant so far as abetment is concerned.\n<\/p>\n<p>5.\tIn<br \/>\nthis view of the matter,  I am persuaded to exercise my  discretion<br \/>\nin favour of the applicant-accused taking into consideration the<br \/>\nfollowing aspects :-\n<\/p>\n<p><span class=\"hidden_text\">(1)<\/span><\/p>\n<p>\tThe accused-applicant is father-in-law of the deceased, who<br \/>\ncommitted the suicide.\n<\/p>\n<p>(2)\tThere<br \/>\nare no direct allegations against the accused-applicant so far as<br \/>\nabetment is concerned;\n<\/p>\n<p>(3)\tPrima-facie,<br \/>\nit appears from the allegations levelled in the FIR that the dispute<br \/>\nrelated to household matters.\n<\/p>\n<p>(4)\tInvestigation<br \/>\nis over.\n<\/p>\n<p>(5)\tMother-in-law<br \/>\nof the deceased, who is one of co-accused has already been ordered to<br \/>\nbe released on bail by this Court vide order dated 1.3.2011 passed in<br \/>\nCriminal Misc. Application No.2500 of 2011.\n<\/p>\n<p>6.\tConsidering<br \/>\nthe above prima-face aspects of the matter, it is ordered that  the<br \/>\napplicant is ordered<br \/>\nto be released on bail in connection C.R. No.I -16 of 2011 registered<br \/>\nwith Chhani Police Station, Vadodara  on his executing a bond in the<br \/>\nsum of Rs.15,000\/- (Rupees fifteen thousand only) with one surety of<br \/>\nthe like amount to the satisfaction of the lower Court and<br \/>\nsubject to the conditions that he shall,<\/p>\n<p>not<br \/>\n\ttake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>not<br \/>\n\tact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>maintain<br \/>\n\tlaw and order;\n<\/p>\n<p>mark<br \/>\n\this presence before the Chhani Police Station on every 1st<br \/>\n\tand 15th day of English calendar month between 11:00 am<br \/>\n\tto 2:00 pm:\n<\/p>\n<p>not<br \/>\n\tleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned;\n<\/p>\n<p>furnish<br \/>\n\tthe address of his residence at the time of execution of the bond<br \/>\n\tand shall not change the residence without prior permission of  this<br \/>\n\tCourt;\n<\/p>\n<p>surrender<br \/>\n\this passport, if any, to the Lower Court immediately.\n<\/p>\n<p>7.\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to take appropriate action in the<br \/>\nmatter.\n<\/p>\n<p>8.\tBail<br \/>\nbefore the Lower Court having jurisdiction to try the case.\n<\/p>\n<p>9.\tRule<br \/>\nis made absolute.
